The decision lifted a lower court injunction that had said the map was an unlawful racial gerrymander, noting that the lower court failed to apply the Supreme Court\u2019s standard from *Louisiana v. Callais<\/a><\/em>, which significantly raised the legal bar for proving claims of intentional racial discrimination when drawing congressional maps. Its view that conducting the elections under court-imposed maps would be more convenient for the State was not a valid justification for that intervention,\u201d the ruling said.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWhile federal courts should not impose changes close to an election, States are free to decide for themselves whether last-minute changes to an election are in their best interests,\u201d the unsigned ruling continued.<\/p>\n<p class=\"wp-block-paragraph\">Justice Sonia Sotomayor wrote a dissenting opinion, joined by Justices Elena Kagan and Ketanji Brown Jackson, claiming that \u201cjust as Alabama doubled down on racial discrimination, the Court today doubles down on chaos\u201d by allowing the quick redraw of the congressional map to take effect.<\/p>\n<p class=\"wp-block-paragraph\">\u201cBefore the Court are two paths. Down one lies an orderly election, held under a tried-and-tested congressional map that protects Black Alabamians\u2019 right to vote and with which all voters, elections officials, and candidates alike are familiar,\u201d Sotomayor wrote for the dissent. \u201cDown the other lies a chaotic election, held under a never-before-used congressional map that intentionally discriminates against Black Alabamians, that Alabama adopted in unashamed defiance of a prior court order directly affirmed by this Court, and that will require officials to change the voter registrations of hundreds of thousands of voters in just days at best, a task that Alabama previously represented would take months.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe majority chooses the second path and disregards both democratic values and the rule of law. I respectfully dissent,\u201d she added.<\/p>\n<p class=\"wp-block-paragraph\">The congressional map the Supreme Court reinstated for Alabama wipes away one of the two black-majority districts, which had been a safely Democratic seat, into a seat Republicans are likely to flip in November, almost certainly changing the state\u2019s congressional delegation from five Republicans and two Democrats to six Republicans and one Democrat.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4583620\/alabama-asks-supreme-court-unblock-gop-friendly-map\/\" type=\"post\" id=\"4583620\">ALABAMA ASKS SUPREME COURT TO UNBLOCK GOP-FRIENDLY CONGRESSIONAL MAP<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Alabama delayed primaries for House seats affected by the state\u2019s implementation of the GOP-favorable map to Aug. 11 after the Supreme Court previously cleared the way for the state to use the map. The Supreme Court\u2019s Tuesday ruling on Alabama\u2019s trio of emergency petitions means the delay to the primaries for the state\u2019s 1st, 2nd, 6th, and 7th congressional districts will not have been for nothing.<\/p>\n<p class=\"wp-block-paragraph\">Since the <em>Callais<\/em> ruling in April, several Republican-led states have redrawn congressional maps in hopes of gaining House seats after the requirements for majority-minority districts were significantly changed.
