Sen. Chris Murphy pressed him on whether DHS would follow orders, but Mullin argued that courts have become \u201cpoliticized,\u201d repeatedly using their decisions in ways he believes reflect political views rather than the rule of law. mullin also accused higher courts of frequently overturning lower-court rulings,which he cited as evidence of politicization.<\/p>\n<p>Murphy said the exchange was alarming-pointing to claims that an immigration judge has found Immigration and Customs Enforcement violated nearly 100 court orders-and argued it prevents Congress from properly funding an agency that may not be complying with the law. The hearing also focused on DHS immigration enforcement funding and included a dispute involving Mullin\u2019s remarks about new Jersey Democrats and protests outside the Delaney Hall detention center, where <a href=\"https:\/\/amzn.to\/3YuVZYV\" >state health inspectors<\/a> had limited access.<\/p>\n<p>Ultimately,Murphy argued that both parties would likely resist court orders they view as politically motivated,partly because of precedents set during the Trump management,while Mullin continued to insist the courts are often acting politically rather than consistently applying the law. id=\"21441\">Markwayne Mullin<\/a> suggested on Tuesday that \u201cpoliticized\u201d courts are the reason why he didn\u2019t directly commit to obeying court rulings concerning the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\/\" type=\"post_tag\" id=\"3083\">Department of Homeland Security<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">In his first congressional hearing as the new DHS chief, Mullin repeatedly said his department will \u201cenforce the law\u201d and is \u201cnever going to break the Constitution.\u201d But when Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/chris-murphy\/\" type=\"post_tag\" id=\"2927\">Chris Murphy<\/a> (D-CT) pressed him on DHS abiding by court rulings, the secretary declined to provide a definitive answer.<\/p>\n<section class=\"explore-more-section\" class=\"wp-block-paragraph\">\u201cIf we didn\u2019t think courts were politicized, then I would probably be able to answer that,\u201d Mullin responded. \u201cBut we see courts over and over again that use their bench for their political opinion, not just the rule of law.\u201d<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">When Murphy said the witness indicated DHS will not follow court orders, Mullin told the senator, \u201cDon\u2019t start putting words in my mouth. \u2026 You\u2019re making an assumption on court orders I haven\u2019t seen.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Astounded by the response, Murphy said his Republican and Democratic colleagues on the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/senate\/\" type=\"post_tag\" id=\"8765\">Senate<\/a> appropriations subcommittee presiding over the hearing \u201cshould be really, really freaked out.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Mullin fired back, saying, \u201cWe should be really concerned about the rulings that come out of the courts and how often they get overturned.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cNot all judges are above the law, but sometimes they think they are,\u201d he said. \u201cThat\u2019s why we see lower courts get overturned by higher courts constantly.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The back-and-forth began when Murphy noted a Republican-appointed federal judge said <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\">Immigration and Customs Enforcement<\/a> has violated nearly 100 court orders.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis is a really important discussion for us to have, because this is, whether you want to believe it or not, at the root of our disagreement,\u201d Murphy said, adding, \u201cThat it is very hard for us to figure out how to fund an agency that is violating the law.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The purpose of the hearing was to review the department\u2019s budget request for the upcoming fiscal year. DHS is requesting $118.4 billion in overall funding. Of that money, $10.5 billion is set aside for ICE and $22.9 billion is reserved for <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/customs-and-border-protection\/\" type=\"post_tag\" id=\"1764\">Customs and Border Protection<\/a>. Federal immigration enforcement was a hot topic during the hearing.<\/p>\n<p class=\"wp-block-paragraph\">Near the end of his testimony, Mullin accused <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-jersey\/\" type=\"post_tag\" id=\"1065\">New Jersey<\/a> Democrats of politicizing the protests outside Delaney Hall by claiming that state health inspectors were <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-declines-to-block-ice-advanced-notice-policy-for-lawmakers\/\" title=\"Judge declines to block ICE advanced notice policy for lawmakers\">denied full access<\/a> to the facility. The state health officials were granted limited access instead.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe\u2019ll always allow them to have access,\u201d he said. \u201cBut because they want to politicize it, the governor wants to politicize it by saying that they weren\u2019t allowed access. It\u2019s not true.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Murphy then said the secretary\u2019s excuses were \u201cendless,\u201d firing back at the witness.<\/p>\n<p class=\"wp-block-paragraph\">\u201cAnytime somebody disagrees with you, whether it\u2019s a member of this committee, whether it\u2019s a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/novo-nordisk-weight-loss-drug-wegovy-launched-in-germany-first-big-eu-market\/\" title=\"Wegovy, Novo Nordisk&#039;s weight-loss drug, now available in Germany, EU&#039;s major market.\">state public health agency<\/a>, whether it\u2019s a federal court, they are politicizing the Department of Homeland Security,\u201d he said as Mullin accused the senator of doing the same.<\/p>\n<p class=\"wp-block-paragraph\">Returning to his original question about DHS\u2019s commitment to follow court orders, Murphy argued both parties will end up disobeying rulings because of the precedent set by the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\" type=\"post_tag\" id=\"339\">Trump administration<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIf Republican administrations don\u2019t implement court orders that they believe to be politicized, then Democratic administrations will not implement court orders that they believe to be politicized,\u201d the Connecticut Democrat said.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4591443\/new-jersey-attorney-general-sues-delaney-hall\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4591443\/new-jersey-attorney-general-sues-delaney-hall\/\">NEW JERSEY ATTORNEY GENERAL SUES OPERATOR OF DELANEY HALL DETENTION CENTER<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Mullin doubled down on his view that the courts are politicized, alluding to court rulings that have set back the administration\u2019s agenda.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWhat I would love to see is the courts actually do their job and not play politics,\u201d he said. \u201cBut we also see that the upper courts always overturn, or a lot of times, overturn these lower courts. So, you tell me if they\u2019re being politicized.
