The case is one of the most high-profile legal disputes involving the Trump administration\u2019s scrutiny of the county\u2019s handling of the 2020 election, an issue that has remained politically charged since President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\">Donald Trump<\/a> challenged his election loss in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/georgia\/\" type=\"post_tag\" id=\"164\">Georgia<\/a> and other key swing states nearly six years ago.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">The federal investigation has drawn fierce criticism from county leaders. Fulton County Board of Commissioners Chairman Robb Pitts told the <em>Washington Examiner <\/em>on Monday that officials filed a motion to quash the subpoena on May 4. Ray II, an appointee of Trump, held a hearing on the county\u2019s subpoena challenge on May 19 and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/73398742\/15\/in-re-grand-jury-subpoena\/\">created a briefing schedule<\/a> for additional filing deadlines for both parties due later this month.<\/p>\n<p class=\"wp-block-paragraph\">In a May 28 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.gand.359862\/gov.uscourts.gand.359862.19.0.pdf\">post-hearing brief<\/a>, Special Attorney to the Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4511150\/bondi-taps-us-attorney-who-voted-against-biden-2020-certification-for-election-integrity-role\/\">Dan Bishop<\/a>, a former Republican representative of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/north-carolina\/\">North Carolina<\/a>, urged the court to reject Fulton County\u2019s motion and grant the government\u2019s cross-motion to enforce the subpoena. Bishop argued that Fulton County is improperly asking the judge to speculate about whether any future charges might be barred by statutes of limitations before investigators have completed their work.<\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">Rep. (Alex Brandon\/AP Photo)<\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">\u201cGiven that the investigation is ongoing, that simply is not feasible or procedurally proper,\u201d Bishop wrote in the 22-page brief, arguing that prematurely evaluating possible charges would \u201ccircumvent the grand jury\u2019s chief function as an investigative body.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Federal grand jury subpoenas are among the DOJ\u2019s most powerful investigative tools and generally receive substantial deference from courts. Prosecutors typically need only show that the requested information may be relevant to an investigation, while parties seeking to quash a subpoena face a significant legal burden.<\/p>\n<p class=\"wp-block-paragraph\">The unsealing order does not resolve the underlying subpoena dispute. Instead, it allows the public and media access to the docket and future filings as the court weighs whether the subpoena should ultimately be enforced.<\/p>\n<p class=\"wp-block-paragraph\">\u201cAs the public can now see, Fulton County is fighting and will always fight to protect the rights of our election officials, election workers, and voters,\u201d Pitts said.<\/p>\n<p class=\"wp-block-paragraph\">In recent days, lawyers for the county, including prominent Trump critics Norm Eisen and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3786112\/trump-foes-longtime-washington-lawyer-abbe-lowell-defense\/\">Abbe Lowell<\/a>, have been admitted as the counsel of record for the plaintiffs challenging the DOJ\u2019s subpoenas.<\/p>\n<p class=\"wp-block-paragraph\">The unsealing effort comes months following a late-January <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/fbi\/\">FBI<\/a> search warrant execution in which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-agents-continue-to-crackdown-on-counterfeit-n95-masks\/\" title=\"Federal agents continue to crackdown on counterfeit N95 masks\">federal agents seized<\/a> more than 600 boxes of election-related records from the Fulton County Elections Hub and Operations Center.<\/p>\n<p class=\"wp-block-paragraph\">Fulton County has occupied a central role in election-related disputes since 2020. Trump and his allies have repeatedly argued that election irregularities affected the outcome in Georgia, while state and local election officials have consistently rejected those allegations.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4558469\/fulton-county-georgia-2020-ballots-fbi-doj\/\">JUDGE DENIES FULTON COUNTY BID TO RETRIEVE 2020 BALLOTS SEIZED BY FBI<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">During the May 19 hearing, a prosecutor working with the grand jury in Fulton County told a federal judge that the DOJ intends to interview local election workers who took part in the 2020 election process once it receives information from the related subpoena.<\/p>\n<p class=\"wp-block-paragraph\">So far, the county has been unsuccessful in its efforts to regain ballot materials seized by the FBI in January.
