But after radical pro-trans groups dropped their appeals in the 5th and 6th Circuits, Defending Education \u2014 a group that sued the Biden Department of Education to stop the rule in the 11th Circuit \u2014 was able to <a href=\"https:\/\/defendinged.org\/press-releases\/defending-educations-challenge-to-biden-era-title-ix-rule-ends-in-victory\/\" target=\"_blank\" rel=\"noreferrer noopener\">file a motion to dismiss<\/a> its case as moot. The court accepted the motion on Wednesday.<\/p>\n<p>A Better Balance and Victim Rights Law Center, two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/antifa-blm-vandalize-ice-building-burn-original-starbucks\/\" title=\"Antifa, BLM vandalize ICE building, burn original Starbucks\">left-wing groups<\/a>, were the intervenors in the cases from Tennessee in the 6th Circuit and Texas in the 5th Circuit. Those groups dismissed their 6th Circuit appeal last week and the 5th Circuit appeal on Tuesday, where the Alliance Defending Freedom sued to block the Biden rule.<\/p>\n<p>Defending Education told The Federalist that those groups dropping their appeals allowed Defending Education to file to dismiss its own case, which was a safeguard in the event that the other circuits ruled in favor of the Biden rule.<\/p>\n<p>\u201cAt long last the national nightmare that was Biden\u2019s Title IX rewrite has come to a victorious close,\u201d said Sarah Parshall Perry, vice president and senior legal fellow at Defending Education. \u201cWe are incredibly pleased that the court accepted our recommendation that the appeal be dismissed as moot, preventing future intervenors and closing out any further attempts to defend a rule that was a violation of civil rights, Constitutional, and administrative law.\u201d<\/p>\n<p>Biden\u2019s Title IX rewrite shredded civil rights protections for women and girls attending school, making sex-specific facilities like restrooms and locker rooms into federal civil rights violations if schools did not allow opposite-sex use. That means boys would be able to sleep in the same rooms on overnight field trips and use girls\u2019 facilities at will, putting females at risk every day. The Biden administration made this rule even after <a href=\"https:\/\/wjla.com\/features\/i-team\/loudoun-county-public-school-parents-called-domestic-terrorists-scott-smith-sex-assault-victim-father-wants-apology\" target=\"_blank\" rel=\"noreferrer noopener\">cases<\/a> of boys claiming to be girls <a href=\"https:\/\/adflegal.org\/case\/thomas-v-city-schools-decatur\/\" target=\"_blank\" rel=\"noreferrer noopener\">sexually assaulting<\/a> girls and committing other <a href=\"https:\/\/ocpathink.org\/post\/independent-journalism\/place-holdlawsuit-says-edmond-schools-violated-bathroom-lawer-2\" target=\"_blank\" rel=\"noreferrer noopener\">acts of violence<\/a> in their restrooms at school.<\/p>\n<p>The Biden administration used the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2971440\/biden-administration-finalizes-controversial-title-ix-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">reasoning<\/a> in <em>Bostock v. Clayton County<\/em> \u2014 the infamous case (written by Justice Neil Gorsuch) that invented \u201ctransgender\u201d protections in Title VII employment discrimination cases \u2014 to redefine \u201csex\u201d as it relates to civil rights in educational institutions.<\/p>\n<p>Another part of the Biden Title IX rewrite <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3104372\/rights-on-title-ix-campus-due-process-biden-harris-overhaul\/\" target=\"_blank\" rel=\"noreferrer noopener\">stripped the due process rights<\/a> of college students accused of sexual harassment going through Title IX proceedings. The purpose was to effectively block the accused \u2014 mostly male students \u2014 from being able to defend themselves against bogus sexual harassment claims.<\/p>\n<p>It went as far as to lower the burden of proof to find the accused guilty, as well as block the accused from reviewing the full scope of evidence against them, essentially barring them from being able to have an effective defense.<\/p>\n<p>The Trump 45 rules, which are back in place, have a high burden of proof and allow the accused to develop a proper defense against accusations. In contrast to the regime put in place by the Obama administration, the Trump rules protect the accused from having their lives ruined by wanton, false accusations leveled against them, while still providing a robust process for genuine harassment claims.<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Breccan F.
