And it\u2019s becoming increasingly clear that her colleagues are no longer shy about putting such incoherence in its place. <\/p>\n<p>The latest incident came on Thursday in the Supreme Court\u2019s <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-556_8m58.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Fernandez v. United States<\/a><\/em>  decision, in which the 8-1 majority held that \u201cthe supposed invalidity\u201d of a prisoner\u2019s conviction \u201cis not among the \u2018extraordinary and compelling reasons\u2019 that justify compassionate release.\u201d (<a href=\"https:\/\/famm.org\/wp-content\/uploads\/2018\/04\/FS-Fed-Comp-Rel-Criteria.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Compassionate release<\/a> is a process by which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/he-spent-19-years-in-prison-after-being-wrongfully-convicted-of-attempted-murder-he-just-won-1-6-million-in-compensation\/\" title=\"He Spent 19 Years In Prison After Being Wrongfully ... Of Attempted Murder. He Just Won .6 Million In Compensation.\">convicted individuals<\/a> may seek a reduced sentence or early release due to \u201cextraordinary and compelling reasons\u201d like age and medical condition.)<\/p>\n<div id=\"fdrlst__b89e9-4279567659\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The high court rejected convicted prisoner Joe Fernandez\u2019s motion for compassionate release, in which he argued that \u201cextraordinary and compelling reasons \u2014 above all, that he was innocent \u2014 warranted a sentencing reduction.\u201d The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-15-best-zingers-maxims-and-mic-drops-from-clarence-thomas-harvard-concurrence\/\" title=\"Top 15 Zingers, Maxims, and Mic-Drops in Clarence Thomas&#039; Harvard Concurrence\">majority opinion authored<\/a> by Justice Amy Coney Barrett was joined by the court\u2019s conservative justices, while Justice Sonia Sotomayor penned a separate opinion (which Justice Elena Kagan joined) concurring in the judgement. <\/p>\n<p>Throughout her solo dissent, Jackson, while pretending to be a <a href=\"https:\/\/www.law.cornell.edu\/wex\/textualism\" target=\"_blank\" rel=\"noreferrer noopener\">textualist<\/a>, claimed \u201cnothing about the text or history of the compassionate-release provision suggests that Congress meant for this discretionary second-look opportunity to be cabined in the way the majority suggests.\u201d She further accused the majority of employing an \u201catextual and unsupported limitation on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chinese-american-group-on-essential-race-concept-racist-repressive-discriminatory\/\" title=\"Chinese-American Group On Essential Race Concept: \u2018Racist, Repressive, Discriminatory\u2019\">district court\u2019<\/a>s sentencing discretion,\u201d which she characterized as \u201can unnecessary rewriting of the statute Congress wrote and an unwarranted revision of the compassionate-release scheme Congress intended to establish.\u201d<\/p>\n<p>Writing on behalf of her conservative colleagues, Barrett wasted little time in torching the Biden appointee\u2019s illogical tirade. <\/p>\n<p>In one footnote, Barrett noted how Jackson \u201cperplexingly\u201d accused the majority of \u201cfailing to define \u2018what it means for a prisoner to \u201ccollaterally attac[k] the validity of his conviction\u201d\u2018 \u2026 and characterizes this limit as unworkable.\u201d Calling out her junior colleague\u2019s apparent illiteracy, the Trump appointee underscored how the majority did, in fact, explain its \u201cholding in detail,\u201d and how \u201cits application is straightforward.\u201d<\/p>\n<p>\u201cThere is an obvious distinction between a prisoner who asserts that he should not have been convicted in the first place and one who asserts that his present circumstances warrant an exercise of compassion,\u201d Barrett wrote. \u201cIndeed, we <a href=\"https:\/\/amzn.to\/3YuVZYV\" >routinely require courts<\/a> to draw much finer distinctions than this.\u201d<\/p>\n<p>Barrett went on to detail how Jackson \u201cbetray[s] the weakness of [her] criticism\u201d by relying on \u201ca source that offers no support.\u201d \u201c[T]his source,\u201d Barrett wrote, \u201cdescribes the difficulty of determining when relief other than a release from custody (for example, a damages award) would \u2018necessarily imply the invalidity of [the plaintiff\u2019s] conviction\u2019 within the meaning of [the Supreme Court\u2019s 1994] <em><a href=\"https:\/\/www.oyez.org\/cases\/1993\/93-6188\" target=\"_blank\" rel=\"noreferrer noopener\">Heck v. Humphrey<\/a><\/em> [decision].\u201d<\/p>\n<p>But \u201c[t]hat issue has no bearing on today\u2019s case,\u201d Barrett wrote. <\/p>\n<p>The Trump appointee chastised Jackson in a separate footnote over the latter\u2019s dismissal of Supreme Court precedents the majority cited in its opinion. She explained how the Biden appointee seemingly misunderstood how those decisions handled \u201cthe relevant statutes\u201d and how the court \u201cundertake[s] the same inquiry\u201d in the <em>Fernandez<\/em> case. <\/p>\n<p>Thursday\u2019s decision is hardly the only instance in which Barrett has excoriated Jackson\u2019s lackluster argumentation. In the court\u2019s 2025 <em>Trump v. CASA<\/em> ruling on nationwide injunctions, the former <a href=\"https:\/\/thefederalist.com\/2025\/06\/27\/justice-barrett-takes-a-flamethrower-to-kbjs-reality-challenged-dissent-in-birthright-citizenship-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">slammed<\/a> part of the latter\u2019s solo dissent for being \u201cat odds with more than two centuries\u2019 worth of precedent, not to mention the Constitution itself.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"gW59Zs0zyArniIdb3NSpBGQT1kJfD8EhK76cMHvLPOqxmuaVteCo2\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Justice Barrett clearly rebuts significant chunks of Justice Jackson&#39;s solo dissent in footnotes.
