B.P.J.* appeared near the top of events at West virginia\u2019s recent girls\u2019 high school track championships, according to a letter filed by the state\u2019s attorney general to the U.S. Supreme Court.<\/p>\n<p>in the case, the Supreme Court is weighing whether West Virginia\u2019s Save Women\u2019s Sports Act-barring biological men from women\u2019s sports-violates equal protection or Title IX. As the Court deliberates behind closed doors, Attorney general John B. McCuskey\u2019s office argued that the athlete, identified in court as \u201cB.P.J.\u201d (Becky Pepper-Jackson), has results that conflict with prior claims by the athlete\u2019s lawyers that she performed poorly against girls.<\/p>\n<p>The letter says Pepper-Jackson finished fourth in the women\u2019s discus and won the women\u2019s shot put state championship, outperforming the nearest competitor by more than 5%. the state\u2019s solicitor general added that B.P.J. is \u201cdefeating every &#8211; or nearly every &#8211; female\u201d in the state for these events, and asked the justices to circulate the letter.<\/p>\n<p>Pepper-Jackson\u2019s lawyers previously claimed that in middle school cross-country, she routinely placed near the back, though they also saeid her field-event performance improved enough to allow postseason participation where results remain within the range of biological girls her age. The letter noted that Pepper-Jackson, identified in court filings as \u201cB.P.J.,\u201d \u201coutthrew the nearest competitor in shot put by more than 5% (11.88 m to 11.25 m).\u201d The state championship results, combined with other recent high finishes for Pepper-Jackson, are at odds with Pepper-Jackson\u2019s lawyers\u2019 previous claims understating the transgender athlete\u2019s performance in girls\u2019 events.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">\u201cAs a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jd-vance-urges-americans-to-share-26-second-clip-from-kamala-harris-60-minutes-interview\/\" title=\"JD Vance Urges Americans to Share 26-Second Clip from Kamala Harris&#039; &#039;60 Minutes&#039; Interview\">high-school sophomore<\/a>, B.P.J. is not finishing \u2018near the back of the back,\u2019 but is instead defeating every \u2014 or nearly every \u2014 female in the State in these events,\u201d West Virginia Solicitor General Michael Williams said in the letter from McCuskey\u2019s office to the high court. \u201cI would appreciate it if you could circulate this letter to Members of the Court.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In the brief filed to the high court ahead of January\u2019s oral arguments, Pepper-Jackson\u2019s lawyers claimed that in cross-country events in middle school, Pepper-Jackson \u201croutinely placed near the back of the pack.\u201d The brief did note that in field events, such as shot put and discus, Pepper-Jackson \u201cimproved enough\u201d to \u201cparticipate in post-season events where [Pepper-Jackson\u2019s] performance is well within the range of [biological] girls her age.\u201d<\/p>\n<p class=\"wp-block-paragraph\">During January oral arguments, Joshua Block, the lawyer for Pepper-Jackson, again emphasized that Pepper-Jackson finished \u201cnear the back\u201d of a middle school cross-country team where every participating athlete made the cut. Justice Brett Kavanaugh then grilled Block about whether he would make the same arguments if the team did have cuts, and Block answered by noting that \u201cgirls don\u2019t make the team when competing against other [biological] girls all the time,\u201d implying that an athletically-advantaged biological boy making the team over a girl would present no separate ethical or legal issue.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court spent much of the January oral arguments grappling with the biological advantage men tend to have over women in sports, and whether there is validity to claims that a man\u2019s biological advantage can be suppressed by hormone drugs.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4416613\/supreme-court-questions-biological-differences-womens-sports\/\" type=\"post\" id=\"4416613\">SUPREME COURT QUESTIONS WHETHER HORMONE DRUGS CAN ERASE BOYS\u2019 BIOLOGICAL ADVANTAGE OVER GIRLS IN SPORTS<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-justice-dept-asks-supreme-court-to-save-obamacare\/\" title=\"Biden Justice Dept. Asks ... to Save Obamacare\">high court heard arguments<\/a> in the <em>West Virginia<\/em> case, along with another case about a state law barring biological men from women\u2019s sports in <em>Little v. Hecox<\/em>.
