The map is intended to help Republicans potentially flip a Democratic seat in the 2026 elections.<\/p>\n<p>Alabama argues that the lower court\u2019s injunction conflicts with the Supreme Court\u2019s recent ruling in *Louisiana v. Callais*, wich raised the standard for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-clears-the-way-for-alabama-to-redraw-congressional-map\/\" title=\"... clears the way for ... to redraw ...\">proving <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/4-devastating-consequences-of-the-democrat-for-the-people-act\/\" title=\"4 Devastating Consequences Of The Democrat \u2018For The People Act\u2019\">intentional racial discrimination<\/a><\/a> in redistricting. Alabama says the district court effectively ignored *Callais* by requiring Alabama to create two black-majority districts despite the updated legal framework, and it also claims the injunction disrupts election preparations in violation of equal protection principles.<\/p>\n<p>Alabama is asking for a decision by Monday morning (or as soon as possible) so it can determine which map to use for upcoming house primaries affecting Alabama\u2019s 1st, 2nd, 6th, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cook-political-report-projects-gop-is-favored-to-win-house-majority-in-2022\/\" title=\"Cook Political Report Projects GOP Is Favored to Win House Majority in 2022\">7th congressional districts<\/a>. The outcome could influence whether Alabama\u2019s delayed primaries ultimately benefit Republicans.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<article class=\"fn-body\">\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/alabama\/\" type=\"post_tag\" id=\"1172\">Alabama<\/a> filed a pair of emergency petitions to the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" type=\"post_tag\" id=\"203\">Supreme Court<\/a> on Wednesday, urging it to lift a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4581727\/court-blocks-alabama-republicans-plan-instate-new-maps\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4581727\/court-blocks-alabama-republicans-plan-instate-new-maps\/\">lower court\u2019s block<\/a> of a new congressional map that could help the GOP flip a Democratic seat in the 2026 elections.<\/p>\n<p class=\"wp-block-paragraph\">Earlier this month, the Supreme Court tossed a three-judge panel\u2019s previous finding that the map was the result of an unlawful racial gerrymander, asking the panel to reconsider the case in light of the justices\u2019 ruling in <em><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4410470\/supreme-court-strikes-down-race-based-redistricting-map-in-louisiana\/\">Louisiana v. Callais<\/a><\/em>, which significantly raised the legal bar for proving claims of intentional racial discrimination when drawing congressional maps. The three-judge panel came to the same conclusion as it did in its previous ruling on Tuesday, and Alabama Solicitor General A. Callais<\/em>,\u201d the pair of emergency petitions reads.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">Alabama argued in its petition that the state followed the standard set out in <em>Callais<\/em>, while promoting its goals of protecting incumbents, among other race-neutral objectives, when drawing the map but that the lower court still insisted that officials needed to create two black-majority districts despite the high court\u2019s recent ruling on race-based redistricting.<\/p>\n<p class=\"wp-block-paragraph\">\u201c<em>Callais<\/em> vindicates Alabama\u2019s position on the lawfulness of the 2023 Plan, yet the district court decided in one week that <em>Callais<\/em> changed nothing,\u201d the emergency petitions read.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWorse, the district court doubled down on its constitutional holding that finds no home in our Constitution: that Alabama intentionally discriminated by refusing to intentionally discriminate,\u201d they continue.<\/p>\n<p class=\"wp-block-paragraph\">Alabama officials requested that the high court issue a ruling on the pair of petitions by 10 a.m. Monday, \u201cor as soon as possible thereafter,\u201d to ensure that officials may have time to prepare the upcoming House primaries with whichever map is permitted by the justices for 2026.<\/p>\n<p class=\"wp-block-paragraph\">\u201cA stay is warranted so that Alabama is not again precluded from using its legislatively enacted 2023 Plan based on a decision that defies <em>Callais<\/em>, manipulates the <em>Purcell<\/em> principle, and offends the Constitution\u2019s promise of equal protection for all,\u201d Alabama\u2019s emergency petitions read.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4581727\/court-blocks-alabama-republicans-plan-instate-new-maps\/\" type=\"post\" id=\"4581727\"><strong>COURT BLOCKS ALABAMA REPUBLICANS\u2019 PLAN TO INSTATE NEW MAP<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">Alabama delayed primaries for House seats affected by the state\u2019s implementation of the GOP-favorable map to Aug. 11 after the Supreme Court cleared the way for the state to use the map. The Supreme Court\u2019s eventual ruling on Alabama\u2019s pair of new emergency petitions could determine if the delay to the primaries for the state\u2019s 1st, 2nd, 6th, and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >7th congressional districts ends<\/a> up providing no advantage to the GOP.<\/p>\n<p class=\"wp-block-paragraph\">Since the <em>Callais<\/em> ruling last month, several Republican-led states have redrawn congressional maps in hopes of gaining House seats after the requirements for majority-minority districts were significantly changed.
