It also asked the Court for guidance on whether the NVRA preempts state efforts made within 90 days of a federal election to remove noncitizens from voter rolls, and whether states may require proof of citizenship for federal-form registrants when those people vote in federal elections or by mail.<\/p>\n<p>The petition points to the Supreme Court\u2019s <a href=\"https:\/\/amzn.to\/3YuVZYV\" >earlier partial emergency stay related<\/a> to Arizona\u2019s proof-of-citizenship rules,and it contends that the issues should be resolved under the NVRA. The DOJ also said it preferred the Republican National Commitee\u2019s case as the vehicle for review rather than petitions filed by Arizona state legislators, arguing the legislators\u2019 arguments raise additional questions the Court should not address yet.<\/p>\n<p>The supreme Court requires at least four justices to agree before a case will be heard.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Trump Department of Justice (DOJ) formally requested on Tuesday that the U.S. Supreme Court resolve a challenge to provisions of Arizona law requiring residents to prove they\u2019re American citizens when registering to vote. <\/p>\n<p>The agency\u2019s request came in the form of a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-1017\/409848\/20260526161649066_Mi%20Familia_OSG_final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">petition for certiorari<\/a> that asked the high court to take up and hear arguments in a legal dispute over Arizona statutes governing voter registration.<\/p>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2024\/08\/10\/republicans-ask-scotus-to-greenlight-arizonas-proof-of-citizenship-requirement-for-voter-registration\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the contested provisions mandate residents to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-sues-arizona-over-proof-of-citizenship-requirement-for-federal-elections\/\" title=\"Biden Administration Sues Arizona Over Proof Of ... ...ment For ...s\">show documentary proof<\/a> of citizenship (DPOC) when registering via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules\/\" title=\"Arizona can reject ...r registrations without ... proof, ... rules\">state voter registration forms<\/a>. They also required such proof for individuals submitting mail-in ballots and voting in presidential contests. (In Arizona, individuals who do not provide DPOC when registering to vote are <a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a> to do so as \u201cfederal-only voters\u201d and only cast ballots in federal elections).<\/p>\n<p>The DOJ petition takes aim at a February 2025 ruling by the 9th Circuit Court of Appeals that <a href=\"https:\/\/azmirror.com\/2025\/02\/25\/appeals-court-blocks-arizona-laws-targeting-federal-only-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> portions of the laws from taking effect. More specifically, the appellate court panel agreed (2-1) with the district court that the challenged sections violated provisions of the 1964 Civil Rights Act and 1993 <a href=\"https:\/\/www.fvap.gov\/uploads\/FVAP\/Policies\/nvralaw.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">National Voter Registration Act (NVRA)<\/a>, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/massachusetts-governor-activates-national-guard-to-help-deal-with-flood-of-immigrants\/\" title=\"Massachusetts Governor mobilizes National Guard to address influx of immigrants.\">requires state officials<\/a> to make \u201ca reasonable effort to remove the names of ineligible voters from the official lists of eligible voters.\u201d<\/p>\n<p>The Justice Department asked SCOTUS to address numerous questions pertaining to the NVRA and whether it preempts states like Arizona from \u201cimplementing a program to remove noncitizens from its voter rolls within 90 days of a federal election.\u201d The agency further requested that the high court provide definitive answers on whether the NVRA bars states from mandating residents show DPOC when \u201cregistering to vote in federal elections using the state registration form\u201d or \u201cfrom denying individuals who used the federal registration form, which does not require documentary proof of citizenship, the ability to vote by mail.\u201d<\/p>\n<p>The DOJ pointed to the Supreme Court\u2019s <a href=\"https:\/\/thefederalist.com\/2024\/08\/22\/scotus-partly-restores-arizonas-proof-of-citizenship-voter-requirements-for-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">partial emergency stay (\u201cpause\u201d)<\/a> of a lower court block against Arizona\u2019s \u201ccommonsense election-integrity measures\u201d ahead of the 2024 election to substantiate its argument that \u201cthese policies are not preempted\u201d by the NVRA and that \u201cfurther review is warranted.\u201d The agency also provided arguments as to why the court should side with it on the questions presented.<\/p>\n<p>\u201cAs to the voter-roll question, the NVRA\u2019s restrictions on removing individuals from the list of eligible voters do not apply to noncitizens who were never eligible to register in the first place,\u201d the petition reads. \u201cAs to the registration-form question, while the current federal form requires only that applicants attest to their citizenship, the NVRA grants States the flexibility to require on their own forms that applicants supply documentary proof of citizenship.\u201d<\/p>\n<figure><\/figure>\n<p>The DOJ said that the petition filed by the Republican National Committee (RNC) in the dispute is a better vehicle to address the contested issues than those filed by a group of Arizona legislators and the state. The administration argued that the latter\u2019s\u2019 petitions \u201craise additional questions that do not warrant this Court\u2019s review at this time,\u201d such as the legislators\u2019 challenge to the 9th Circuit\u2019s holding that the NVRA bars Arizona from mandating voters \u201cwho registered using the federal form \u2014 and thus without documentary proof of citizenship \u2014 to vote in person rather than by mail.\u201d<\/p>\n<p>\u201cBut this Court previously denied a stay on this question \u2026 and it should not grant certiorari now. The NVRA requires States to \u2018accept and use\u2019 the federal registration form \u2026 and it is far from clear whether and how States may nevertheless subject federal-form registrants to special voting restrictions,\u201d the petition reads. \u201cFurther percolation would be beneficial, as this is a novel question that, to our knowledge, no other courts have addressed because no other States have enacted such laws.\u201d<\/p>\n<p>At least four justices must agree to hear a case before it can be considered by the full Supreme Court. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
