TJ Cox Indicted For ..., Faces Up To 55 Years In Prison\">including wire fraud<\/a>, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">making false statements<\/a> to a bank, and money laundering. The defence argues the prosecution is \u201cvindictive,\u201d claiming the indictment is based on conclusory accusations and political hostility, pointing to public statements and press activity by federal officials after the charges were filed rather than addressing the underlying conduct.<\/p>\n<p>The article contends that media coverage often repeats the \u201cvindictive prosecution\u201d framing and avoids detailed discussion of the specific allegations: that SPLC opened bank accounts under the names of companies that never existed, made written acknowledgments to a bank about those false accounts, and used the purported fake entities in financial transfers. It says those claims, if proven, match straightforward fraud and false-statement theories described by money-laundering experts.<\/p>\n<p>the piece draws a parallel to earlier arguments by SPLC\u2019s attorney Abbe Lowell in Hunter Biden\u2019s case, where a similar \u201cpolitical pressure\u201d theory later gave way to convictions, followed by a presidential pardon.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In a 390-page Tuesday filing, lawyers for the Southern Poverty Law Center have asked a federal judge to throw out felony charges of wire fraud, making false statements to a bank, and money laundering. You can read the indictment <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.almd.90264\/gov.uscourts.almd.90264.1.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, and the defense memorandum arguing for dismissal <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.almd.90264\/gov.uscourts.almd.90264.49.1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a> (without the hundreds of pages of exhibits that accompanied the motion).<\/p>\n<p>Now represented by nine lawyers at three law firms, including Hunter Biden lawyer and D.C. fixer Abbe Lowell, the SPLC argues that it\u2019s the victim of vindictive prosecution. They charge that \u201cthis Administration\u2019s animus over the past year culminated in the criminal charges against the SPLC \u2014 an indictment premised on conclusory accusations but devoid of provable facts or a proper statement of the law.\u201d<\/p>\n<p>In fact, as The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/04\/28\/analysts-splc-fraud-money-laundering-charges-could-be-the-tip-of-the-iceberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">has reported<\/a>, experts in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/analysis-journalists-struggle-to-speak-truth-to-power-in-biden-era\/\" title=\"ANALYSIS: Journalists Struggle To \u2018Speak Truth to Power... in ... Era\">money laundering investigations<\/a> have described the allegations as straightforward descriptions of wire fraud and an organization making false statements to banks, concluding that the indictment alleges obvious crimes if the fact claims in the document can be proved in court.<\/p>\n<p>Among other allegations, federal prosecutors allege that the SPLC opened bank accounts in the names of companies that have never existed or conducted legitimate business. The indictment also alleged that SPLC officials responded to a bank investigation by acknowledging to the bank, in writing and over the signature of SPLC leaders, that the accounts for fake businesses had been opened by the SPLC. The SPLC has <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-our-vote-matters-is-suing-facebook-dominion-mark-zuckerberg-certain-state-officials-others-for-infringing-upon-right-to-vote-assemble-and-speak-freely-you-can-jo\/\" title=\"Group \u201cOur Vote Matters\u201d Is Suing Facebook, Dominion, Mark Zuckerberg, Certain State Officials, Others for Infringing Upon Right to Vote, Assemble and Speak Freely \u2013 You Can Join Too\">due process rights<\/a> and is entitled to a presumption of innocence, but if the indictment correctly describes that letter, a legal expert has previously described the letter to The Federalist as \u201can admission of fraud against the bank.\u201d<\/p>\n<p>The memorandum filed on Tuesday by the SPLC doesn\u2019t mention any of that, ignoring the substance of the charges to focus on Donald Trump\u2019s personal tendency toward meanness. Sample argument, from pg. 9 of the PDF file linked above (which is pg. 4 of the memorandum): \u201cAfter the indictment, the Administration\u2019s assault on the SPLC\u2019s free speech rights continued. President Trump, Acting Attorney General Todd Blanche, Deputy Associate Attorney General Aakash Singh, and FBI Director Kash Patel spoke at press conferences and televised interviews.\u201d<\/p>\n<p>That\u2019s the heart of the argument: The SPLC can\u2019t be prosecuted because <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal officials held press conferences<\/a>, which supposedly proves unlawful and vindictive targeting. <\/p>\n<p>The memorandum goes on to frame the indictment as an attempt to intimidate a political enemy, again evading discussion of the actual charges: \u201cThe attempts by President Trump to muzzle and intimidate the SPLC did not deter it from carrying out its mission. The SPLC continued to publicly criticize and challenge many of the Administration\u2019s policies.\u201d You\u2019ll find that quote on pg. 11 of the memorandum, which is pg. 16 of the linked PDF file.<\/p>\n<p>What you will not find in the defense memorandum arguing for dismissal is a discussion of the allegations that the SPLC opened bank accounts in the names of businesses that didn\u2019t exist, giving false statements to banks in order to open the accounts and subsequently transferring money in the names of those non-existent businesses.<\/p>\n<p>Following the framing from defense lawyers, media coverage omits discussion of the actual charges, focusing on questions that don\u2019t figure into the indictment. \u201cThe motion was filed against the backdrop of other politically charged prosecutions that have raised concerns that the Justice Department is operating as a weapon to target Trump\u2019s opponents,\u201d PBS News <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/southern-poverty-law-center-seeks-dismissal-of-vindictive-justice-department-indictment\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> on Tuesday.<\/p>\n<p>\u201cLawyers for the SPLC have already argued that law enforcement agencies have long known that the nonprofit paid informants to report on the movements of hate groups,\u201d PBS added. But the SPLC is not charged with crimes simply for paying informants.<\/p>\n<p>These are the consistent themes of the media coverage, as the news stories scrupulously avoid mentioning the actual charges. Without mentioning bank accounts opened in the name of fake businesses, The Hill <a href=\"https:\/\/thehill.com\/homenews\/administration\/5896865-southern-poverty-law-center-doj-indictment-dismissal-bid\/\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> that the Trump administration \u201cbrought charges against the group in April, accusing the organization of\u00a0defrauding its donors\u00a0by using a now-defunct informant program to funnel money to the extremist groups they were spying on.\u201d Again, the SPLC is not charged with a crime simply for paying informants.<\/p>\n<p>In a similar strategy two years ago, Lowell <a href=\"https:\/\/www.politico.com\/news\/2024\/02\/20\/hunter-biden-legal-offensive-tax-prosecution-00142359\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> that Hunter Biden was being vindictively prosecuted by a DOJ that had given in to political pressure. After that strategy failed, Biden was <a href=\"https:\/\/www.justice.gov\/archives\/sco-weiss\/pr\/robert-hunter-biden-convicted-three-felony-tax-offenses-and-six-misdemeanor-tax-offenses\">convicted<\/a> on multiple federal tax charges, but was <a href=\"https:\/\/www.justice.gov\/d9\/2024-12\/biden_warrant.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">pardoned by his father<\/a>. <\/p>\n<hr>\n<p>      Chris Bray is a senior correspondent at The Federalist and a former infantry sergeant in the U.S. Army.
