In a draft notice submitted to the Federal Register, the Office of Personnel Management (OPM) said a standardized NDA would improve consistency across agencies, better protect confidential information, and clarify federal employees\u2019 rights and responsibilities.<\/p>\n<p>OPM proposed a broad definition of \u201cConfidential Government Information,\u201d covering nonpublic confidential or proprietary material, including internal operations, personnel and procurement matters, and sensitive pre-decisional or deliberative work. expected to be published on Wednesday and remain open for a 30-day public comment period.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">The proposal adopts a broad definition of \u201cConfidential Government Information,\u201d describing it as \u201call non-public, confidential, or proprietary information,\u201d including material related to internal agency operations, personnel matters, procurement processes, and \u201csensitive, pre-decisional or deliberative material\u201d that is not publicly available.<\/p>\n<p class=\"wp-block-paragraph\">OPM pointed to several recent leaks it said endangered military operations and federal employees.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn early 2026, the<em> New York Times<\/em> and <em>Washington Post<\/em> received unauthorized disclosures from Federal employees divulging the secret U.S. raid on Venezuela prior to it occurring,\u201d the draft said. \u201cThese leaks put the lives of members of the armed forces at risk.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The agency also referenced the leak of personal information belonging to approximately 4,500 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/washingtonexaminer.com\/tag\/ice\" type=\"link\" id=\"washingtonexaminer.com\/tag\/ice\">Immigration and Customs Enforcement<\/a> employees, including nearly 2,000 front-line enforcement officers. According to the draft, the disclosure included \u201cnames, addresses, email addresses, phone numbers, and job titles\u201d and \u201cjeopardized the safety of the agents.\u201d<\/p>\n<p class=\"wp-block-paragraph\">OPM said it believes a standardized NDA form would help \u201cbetter protect confidential information\u201d and clarify federal workers\u2019 responsibilities regarding nondisclosure obligations.<\/p>\n<p class=\"wp-block-paragraph\">The office said the NDA would be issued as an optional form, meaning agencies would decide whether to require employees to sign it.<\/p>\n<p class=\"wp-block-paragraph\">\u201cShould agencies elect to use the NDA, it would be administered to newly hired employees as part of the onboarding process and to current Federal employees,\u201d the draft said.
