In a May 14 letter, DOJ cited evidence that Black and Hispanic applicants had substantially higher odds of receiving interviews than white and Asian applicants with similar academic credentials-an outcome DOJ says can\u2019t be explained by coincidence.<\/p>\n<p>Supporters of yale\u2019s approach argue that since admitted students are all highly qualified and seats are limited, race could be used as a tie-breaker. The article counters that, legally, race (and factors functioning as proxies for race) cannot be used in admissions decisions regardless of applicants\u2019 test scores.<\/p>\n<p>It also disputes defenses that frame race-based admissions as rewarding \u201covercoming hardship.\u201d The argument is that assuming disadvantage by race relies on stereotypes,and an individual\u2019s race alone doesn\u2019t establish merit shaped by life circumstances.<\/p>\n<p>According to DOJ, Yale\u2019s process went beyond what is lawful: (1) Yale admissions staff were reportedly guided by a \u201cholistic metrics model\u201d that listed \u201crace\u201d and \u201cnational origin\u201d as factors-contrary to the Supreme Court\u2019s students for fair Admissions ruling; and (2) DOJ says Yale\u2019s outcomes didn\u2019t change after that ruling, despite Yale having claimed it&#8217;s demographics would shift if it stopped using race, suggesting continued noncompliance.<\/p>\n<p>The piece concludes that Yale may consider many non-test-related factors, but it cannot consider race or race proxies when making admissions decisions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>As Yale celebrated its 325th commencement last week, the institution\u2019s medical school faced new scrutiny for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-justice-department-scraps-investigation-into-yales-discriminatory-admissions-process\/\" title=\"Biden ... ... Scraps Investigation Into ...s Discriminatory ... Process\">alleged racial discrimination<\/a> in admissions. <a href=\"https:\/\/www.justice.gov\/crt\/media\/1440601\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">The Department of Justice sent a letter to Yale School of Medicine<\/a> on May 14 notifying it that \u201cthe Department finds that Yale continues to intentionally discriminate against applicants based on their race.\u201d<\/p>\n<p>That letter presents evidence that black and Hispanic students were significantly more likely to be admitted than white and Asian students with the same MCAT scores and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/following-covid-4-in-10-baltimore-public-high-students-earned-below-a-1-0-gpa\/\" title=\"Following COVID, 4 In 10 Baltimore Public High ... Earned Below A 1.0 GPA\">grade point averages<\/a>, an outcome that \u201ccannot be explained by a coincidence.\u201d Specifically, \u201cYale\u2019s use of race resulted in a Black applicant being as much as 29 times higher odds of getting an interview for admission than an equally strong Asian applicant with similar academic credentials.\u201d<\/p>\n<p>The finding by the department that Yale Medical School continues to racially discriminate in its admissions was greeted by criticisms that seem to misunderstand what constitutes racial discrimination. For example, <a href=\"https:\/\/x.com\/JeffAnderson_\/status\/2055150455865356308?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">a radiologist named Jeff Anderson responded on X<\/a> that all groups of students who were admitted to Yale Medical School had very high standardized scores: \u201cEvery last one of these are overly qualified I assure you. There\u2019s just simply not enough seats.\u201d The implicit argument is that once applicants have met a certain threshold on their scores, race can be used as a tie-breaker to allocate the limited number of spots.<\/p>\n<p>But as far as the law is concerned, \u201cgood enough\u201d is not good enough: Race simply cannot be used as a criterion in admissions decisions no matter how high applicants\u2019 scores are. Yale Medical School is not obligated to accept the students with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michael-barone-we-dont-need-racial-quotas-to-showcase-americas-diversity\/\" title=\"Michael Barone: We Don&#039;t Need Racial Quotas to Showcase America&#039;s Diversity\">highest test scores<\/a> and is free to consider other factors, as long as race or ethnicity (or factors that are proxies for race and ethnicity) are not among them. Given the staggering differences by race in the odds of receiving an interview among similarly academically situated students, it strains credibility that Yale passes the test.<\/p>\n<p>Neither the Supreme Court nor the Department of Justice is suggesting that test scores are the only indication of merit. But they are both clearly stating that the racial background of the applicant is not a lawful consideration for admission.<\/p>\n<p>A prominent surgeon, Terry Simpson, seemed to confuse racial background with the merit of overcoming challenges when he <a href=\"https:\/\/x.com\/drterrysimpson\/status\/2056038456074387811?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">argued on X<\/a>: \u201cIf you have 100 applicants from privileged, high-performing educational pipelines with nearly identical scores, resumes, research access, tutoring, and opportunities, it is not irrational to also value the applicant who achieved similar academic success despite poverty, instability, underfunded schools, family hardship, or lack of institutional advantages.\u201d<\/p>\n<p>Dr. Simpson oddly assumed, with no information from Yale Medical School, that white and Asian applicants are privileged while black and Hispanic applicants are disadvantaged. But making this assumption is built on nothing more than racist stereotypes, attributing to all black and Hispanic applicants the merit of having overcome challenges based on nothing more than the color of their skin, without any other individualized evidence whatsoever. An applicant\u2019s race, by itself, does not indicate this type of merit or lack thereof.<\/p>\n<p>So, why does the Department of Justice believe that Yale has in fact used race in this impermissible way rather than having collected and considered information about personal challenges that happen to correlate with race? According to the DOJ, first, Yale gave its admissions staff <a href=\"https:\/\/www.justice.gov\/crt\/media\/1440601\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">a \u201cholistic metrics model\u201d developed by the Association of American Medical Colleges<\/a> to guide the school\u2019s assessment of applicants. That model specifically listed \u201crace\u201d and \u201cnational origin\u201d as criteria for the admissions staff to consider, which is clearly prohibited by the <em>Students for Fair Admissions<\/em> decision.<\/p>\n<p>Second, the Department of Justice noted that Yale Medical School\u2019s test score differences between accepted students by race had not changed following the <em>Students for Fair Admissions<\/em> decision. More than three years ago in that case, <a href=\"https:\/\/www.justice.gov\/crt\/media\/1440601\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">Yale argued in its amicus brief<\/a> that \u201cno workable race-neutral alternatives [would yield] the level of racial diversity \u2026 necessary.\u201d <a href=\"https:\/\/www.justice.gov\/crt\/media\/1440601\/dl\" target=\"_blank\" rel=\"noreferrer noopener\">As the department notes<\/a>, \u201cGiven this statement, the lack of any change in Yale\u2019s admissions outcomes after Harvard [is] evidence [of] a willful failure to comply with that decision.\u201d<\/p>\n<p>That is, Yale asserted that its admissions demographics would change if the school ceased considering race; yet its admissions demographics have remained unchanged, pointing to ongoing noncompliance with <a href=\"https:\/\/amzn.to\/3YuVZYV\" >civil rights laws forbidding racial discrimination<\/a>.<\/p>\n<p>By its own admission, Yale Medical School has seemingly been caught engaging in racial discrimination, not engaging in holistic admission decisions, the latter of which would be legally permissible as long as race were not among the holistic criteria. Defenders of Yale seem to think race can still be considered as long as everyone is high-scoring or if we imagine that race is equivalent to disadvantage.
