His appointment came shortly after veteran national security prosecutor <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4531862\/doj-prosecutor-brennan-south-florida-sources\/\">Maria Medetis Long<\/a> was removed from overseeing portions of the South Florida investigation, including matters tied to Brennan, although she remains employed in the office.<\/p>\n<p class=\"wp-block-paragraph\">DiGenova served as U.S. attorney for Washington, D.C., from 1983 to 1988 under President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ronald-reagan\/\">Ronald Reagan<\/a> before later becoming one of the most outspoken legal critics of the FBI\u2019s Trump-Russia investigation and eventually joining Trump\u2019s legal team during the late special counsel <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/4499650\/robert-mueller-died-trump-says-glad\/\">Robert Mueller<\/a>\u2019s investigation.<\/p>\n<h2 id=\"h-why-forming-a-criminal-civil-rights-unit-matters\" class=\"wp-block-heading\">Why forming a criminal civil rights unit matters<\/h2>\n<p class=\"wp-block-paragraph\">Over the years, diGenova repeatedly accused former Obama-era intelligence and law enforcement officials of improperly weaponizing federal investigative powers against Trump.<\/p>\n<p class=\"wp-block-paragraph\">In a November 2024 interview with <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/justthenews.com\/videos\/joe-digenova-obama-should-receive-first-grand-jury-subpoena-violating-trumps-civil-rights\"><em>Just the News<\/em><\/a>, diGenova pointed specifically to 18 U.S.C. \u00a7 241, the federal conspiracy against rights statute, as a possible framework for investigating conduct surrounding the Russia inquiry.<\/p>\n<p class=\"wp-block-paragraph\">At the time, diGenova argued one of the \u201cultimate outcomes\u201d of the alleged conspiracy was the August 2022 FBI raid on Trump\u2019s Mar-a-Lago estate, which he suggested helped justify South Florida\u2019s jurisdictional role in the matter.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI think there was a violation of Title 18 \u00a7 241 that violated the civil rights of Donald Trump,\u201d diGenova said. \u201cThere is no doubt that there was a conspiracy.\u201d<\/p>\n<p class=\"wp-block-paragraph\">He said the conspiracy began during a January 2017 Oval Office meeting involving then-President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/barack-obama\/\">Barack Obama<\/a>, Brennan, Comey, then-Vice President Joe Biden, then-national security adviser Susan Rice, and others, where officials discussed the Russia collusion theory despite, according to diGenova, knowing it was false. Documents uncovered years later suggested <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3482784\/russiagate-definitive-timeline-how-new-intelligence-documents-fit-in\/\">Hillary Clinton\u2019s campaign had developed a plan<\/a> months earlier to invent the Russian collusion plot in order to damage Trump\u2019s campaign.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe president of the United States, Barack Obama, authorized the FBI to investigate it knowing that it was false,\u201d diGenova said. \u201cBarack Obama should get the first grand jury subpoena.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Recent activity has also suggested the inquiry may be expanding geographically.<\/p>\n<p class=\"wp-block-paragraph\">CBS News reported last month that cooperating witnesses were subpoenaed to appear before a federal grand jury in Washington shortly after diGenova assumed his DOJ role. It\u2019s pretty prominent,\u201d Rahmani told the <em>Washington Examiner<\/em>.<\/p>\n<p class=\"wp-block-paragraph\">Rahmani said he could envision prosecutors attempting to construct a sweeping conspiracy theory tied to alleged efforts to deprive Trump of his rights, although he expressed skepticism such a prosecution would survive judicial scrutiny.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI guess you\u2019re going to charge this mass conspiracy, right?\u201d Rahmani said. \u201cThey\u2019re all conspiring in a massive criminal conspiracy to deprive Trump of his civil rights.
