Callais that congressional districts formed based on race are unconstitutional.<\/p>\n<p>Californians passed Proposition 50 last fall, which seeks to add up to five additional Democratic seats in the state\u2019s congressional delegation. It was sold as a means to counter <a href=\"https:\/\/www.westernjournal.com\/supreme-court-gives-republicans-much-needed-redistricting-win-texas-ruling\/\" target=\"_blank\" rel=\"noopener\">Texas\u2019s redistricting<\/a>, where the legislature had redrawn its map to add up to five GOP seats.<\/p>\n<p>California\u2019s U.S. House delegation could go from a <a href=\"https:\/\/www.270towin.com\/2026-house-election\/states\/california\" target=\"_blank\" rel=\"noopener\">43-9 split<\/a> in favor of Democrats, with two current vacancies, to a 47-4 with one toss-up. Meanwhile, Texas could move from 25-13 in favor of the GOP, with one vacancy, to <a href=\"https:\/\/www.270towin.com\/2026-house-election\/states\/texas\" target=\"_blank\" rel=\"noopener\">28 to 9<\/a>, with one toss-up.<\/p>\n<p>But <a href=\"https:\/\/justthenews.com\/politics-policy\/elections\/prop-50\" target=\"_blank\" rel=\"noopener\">Just the News<\/a> reported that opponents of <a href=\"https:\/\/www.westernjournal.com\/doj-sues-california-gov-gavin-newsom-prop-50-redistricting-plan-unlawful-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">Proposition 50<\/a> argue that, in making its new districts, California relied too heavily on race, thereby violating the U.S. Supreme Court\u2019s ruling in Callais.<\/p>\n<p>\u201cNow, with multiple federal lawsuits moving through the courts, the battle over Proposition 50 has evolved into a high-stakes constitutional fight. Challengers argue that California\u2019s maps violate the Equal Protection Clause because <a href=\"https:\/\/amzn.to\/3YuVZYV\" >race allegedly eclipsed traditional redistricting principles<\/a> such as compactness, contiguity, and respect for existing political boundaries,\u201d Just the News said.<\/p>\n<p>Justice <a href=\"https:\/\/www.westernjournal.com\/scotus-justice-samuel-alito-fires-back-dems-refuses-step-aside-trump-jan-6-cases\/\" target=\"_blank\" rel=\"noopener\">Samuel Alito<\/a>, writing for the majority in Callias, said that race cannot be the \u201cpredominant motivating factor.\u201d<\/p>\n<p>\u201cDemocratic lawmakers used it to draw district lines designed to maximize Democratic electoral performance,\u201d Just the News said. \u201cPartisan gerrymandering alone generally cannot be challenged in federal court. But challengers argue California\u2019s maps did something more: They relied so heavily on racial demographics that they crossed into constitutionally prohibited territory.\u201d<\/p>\n<p>The question that will be litigated is whether race was the overriding criterion.<\/p>\n<p>Earlier this year, before the Callais ruling, a three-judge panel of the 9th U.S. Circuit Court of Appeals upheld Proposition 50 in a 2-1 ruling. However, Judge Kenneth Lee, in his <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2026\/01\/california-gerrymandering-prelim-inj-denial.pdf\" target=\"_blank\" rel=\"noopener\">dissent<\/a> to Tangipa v. Newsom, used the same reasoning the Supreme Court later employed.<\/p>\n<p>Citing other Supreme Court precedent, he wrote, \u201cIt is a sordid business, this divvying us up by race.\u201d<\/p>\n<p>\u201cTo be sure, California\u2019s main goal was to add more Democratic congressional seats. But that larger political gerrymandering plan does not allow California to smuggle in racially gerrymandered seats. In other words, a state can create a map with the larger goal of political gerrymandering but still run afoul of the Fourteenth Amendment if it relies on race as a predominant factor in drawing certain districts,\u201d Lee added.<\/p>\n<p>In light of this, the judge would have enjoined California\u2019s entire new congressional map from being implemented, because \u201cit is infected with racial gerrymandering.\u201d<\/p>\n<p><a href=\"https:\/\/www.scotusblog.com\/2026\/02\/supreme-court-allows-california-to-use-congressional-map-benefitting-democrats\/\" target=\"_blank\" rel=\"noopener\">SCOTUSblog<\/a> reported in February that the U.S. Supreme Court declined to hear an appeal of the 9th Circuit\u2019s ruling at that time.<\/p>\n<p>\u201cIn a one-sentence order, the justices turned down a request from a group of California Republicans that would have required the state to continue to use the map in place for the last several federal elections in the state while their challenge to the map moves forward. There were no public dissents from the court\u2019s ruling,\u201d SCOTUSblog\u2019s Amy Howe said.<\/p>\n<p>She noted that those representing Democratic lawmakers argued in their <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A839\/395005\/20260129152743936_25A839%20Tangipa%20v.%20Newsom%20State%20Opposition.pdf\" target=\"_blank\" rel=\"noopener\">brief<\/a> to the Supreme Court that the new map was not based on race.<\/p>\n<p>Further, they contended challengers of the 9th Circuit\u2019s ruling were \u201casking the Court to treat California\u2019s map differently from how it treated Texas\u2019s map, thereby allowing a Republican-led State to engage in partisan gerrymandering while forbidding a Democratic-led State from responding in kind.\u201d<\/p>\n<p>Assuming California is allowed to keep its map, looking at the political landscape nationwide, political watchers believe that Republicans have still gained a net of <a href=\"https:\/\/www.westernjournal.com\/redistricting-wars-stand-2026-midterms-approach\/\" target=\"_blank\" rel=\"noopener\">10 to 12 seats<\/a> in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/heres-where-the-redistricting-wars-stand-as-the-2026-midterms-approach\/\" title=\"Here&#039;s Where the ...
