Board of Regents of the University System of Georgia*, a case testing whether employees at federally funded schools can sue for sex discrimination under Title IX-despite students already being able to bring similar claims under federal law. The dispute arose from two sex discrimination cases: one by Georgia Tech women\u2019s basketball coach machelle joseph,who alleged unequal resources and termination after speaking out,and another by Augusta University professor Thomas Crowther,who alleged he was treated differently after a sexual harassment investigation because he is a man and that he wasn\u2019t given a chance to present his case.  <\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-rejects-orchestrated-campaign-to-remove-judge-cannon-from-docs-lawfare-case\/\" title=\"... dismisses coordinated effort to oust Judge Cannon from Docs Lawfare lawsuit\">federal appeals court dismissed<\/a> both claims, ruling that Title IX does not allow an \u201cimplied\u201d private right of action for employment discrimination. Joseph and Crowther petitioned the Supreme Court, warning the decision would severely weaken uniform Title IX enforcement and could destabilize enforcement of other spending-clause civil-rights statutes that also <a href=\"https:\/\/amzn.to\/3YuVZYV\" >lack explicit private enforcement provisions<\/a> but are treated by courts as allowing lawsuits. Crowther was fired after an investigation into an allegation of sexual harassment filed against him by a student, but he claims the school treated him differently throughout the investigation because he is a man and alleged the university declined to give him a hearing to plead his case. The federal appeals court dismissed both cases, finding \u201cthat Title IX does not provide an implied right of action for sex discrimination in employment.\u201d<\/p>\n<p>In their <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-183\/369003\/20250806130430109_25-%20Joint%20Petition.pdf\" type=\"link\" id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-183\/369003\/20250806130430109_25-%20Joint%20Petition.pdf\">petition<\/a> asking the Supreme Court to take up their appeal, Joseph and Crowther warned that the 11th Circuit\u2019s ruling has \u201cfar-reaching implications\u201d for Title IX and undermines the landmark law\u2019s enforcement.<\/p>\n<p>\u201cIt undermines the uniform enforcement of Title IX across the country,\u201d the petition reads. \u201cIt threatens to destabilize enforcement of anti-discrimination provisions under other Spending Clause statutes that, like Title IX, lack explicit private rights of action but have long been interpreted by courts to allow individuals to sue for violations.\u201d<\/p>\n<p>The Trump administration <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-183\/404072\/20260409172353690_25-183_Crowther_CVSG.pdf\" type=\"link\" id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-183\/404072\/20260409172353690_25-183_Crowther_CVSG.pdf\">urged<\/a> the Supreme Court to take up the case, calling on it to resolve the split among appeals courts and to uphold the 11th Circuit\u2019s ruling.<\/p>\n<p>\u201cThis Court has never recognized a private right of action for employment discrimination under Title IX,\u201d the Justice Department\u2019s filing to the high court said. \u201cThe statutory text and structure do not support expanding the right of action inferred in <em>Cannon v. University of Chicago<\/em> to reach such claims. \u2018Congress, not this Court, should extend th[at] implied cause[] of action\u2019 if it so chooses.\u201d<\/p>\n<p>The Supreme Court is expected to hear arguments in the case during its next term, which will begin in October. Oral arguments will likely be scheduled sometime between Oct. 5, 2026, and April 27, 2027.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4572406\/supreme-court-tosses-racial-redistricting-rulings-mississippi-north-dakota\/\" type=\"post\" id=\"4572406\">SUPREME COURT TOSSES RACIAL REDISTRICTING RULINGS IN MISSISSIPPI AND NORTH DAKOTA<\/a><\/strong><\/p>\n<p>In the coming weeks, the high court will issue a ruling in another case where <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4408609\/pair-supreme-court-cases-put-title-ix-future-in-balance\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4408609\/pair-supreme-court-cases-put-title-ix-future-in-balance\/\">Title IX<\/a> is at the center of the dispute, when it releases its decision in one of the two cases this term involving <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4416613\/supreme-court-questions-biological-differences-womens-sports\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4416613\/supreme-court-questions-biological-differences-womens-sports\/\">state laws barring biological men from women\u2019s sports<\/a>. In <em>West Virginia v. B.P.J.<\/em>, the Supreme Court will decide whether West Virginia\u2019s Save Women\u2019s Sports Act violates either the equal protection clause of the 14th Amendment or Title IX.<\/p>\n<p>The <em>West Virginia<\/em> case was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4415304\/supreme-court-defining-sex-transgender-sports-bans\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4415304\/supreme-court-defining-sex-transgender-sports-bans\/\">argued<\/a> before the justices in January, immediately following arguments in <em>Little v. Hecox<\/em>, where the Supreme Court weighed whether Idaho\u2019s Fairness in Women\u2019s Sports Act, which also bans biological men from women\u2019s sports, violates the equal protection clause.
