The gun and diary were discovered at a police station and were considered consistent with department protocol, while the other items were taken from the backpack at a McDonald\u2019s before a warrant was obtained, which the judge said was not properly justified. He also noted that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/must-be-dismantled-ben-jerrys-attacks-americas-police-system\/\" title=\"...Must Be Dismantled\u2019: Ben &amp; Jerry\u2019s Attacks America\u2019s Police System\">body-worn camera footage<\/a> did not show that a gun was a concern motivating the search, and there was no \u201cexigency\u201d that would have made retrieving a gun from the backpack possible at that moment.<\/p>\n<p>Even though the McDonald\u2019s evidence was barred,prosecutors argue the diary and gun are central: the diary is described as a \u201cmanifesto\u201d that helps establish motive and link Mangione to the shooting. Carro said that the search at the police station was in line with the Altoona Police Department\u2019s protocol, while the search at the restaurant, done before obtaining a warrant, was not. He said that the police failed to properly justify their logic that the search was intended to uncover any dangerous weapons.<\/p>\n<div class=\"article-paywall\">\n<p>\u201cHowever, while the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >body-worn camera footage showed<\/a> that officers did express concern at the scene that the backpack might contain a bomb, there was no evidence that a gun was a concern or that it was the basis for the search,\u201d Carro wrote.<\/p>\n<p>\u201cBut even if it were a legitimate concern, there was no possibility at the time of the search that the defendant might retrieve a gun from the backpack, and thus no exigency,\u201d he said.<\/p>\n<p>Despite the loss of the McDonald\u2019s backpack evidence, the approval of the gun and diary, two of the biggest pieces of evidence, prosecutors say show a motive and link Mangione to the shooting. Prosecutors have described the diary as a \u201cmanifesto.\u201d<\/p>\n<p>\u201cI finally feel confident about what I will do,\u201d Mangione wrote in an August 2024 entry, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.cnn.com\/2025\/06\/04\/us\/luigi-mangione-diary-entries-murder-case\">according to court filings.<\/a> \u201cThe details are coming together. And I don\u2019t feel any doubt about whether it\u2019s right\/justified.
