The Court said that compelling private donor information is highly likely to discourage reasonable people from supporting the organization, implicating First Choice\u2019s First Amendment rights.<\/p>\n<p>After the decision, New Jersey\u2019s Democratic Attorney General Jennifer Davenport sent a letter to a state judge arguing that the state case should proceed to enforce the subpoena, saying the Court had not ruled on the subpoena\u2019s merits and that the state should not pause while federal litigation continues. First Choice\u2019s attorney, representing the Alliance Defending Freedom, criticized the move as an attempt to evade the Supreme Court ruling and continued pressure on the center despite its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illinois-gov-pritzker-signs-law-barring-pregnancy-centers-from-using-misinformation\/\" title=\"Illinois Gov. demanding that they hand over their donor list, the state government reiterated its desire to obtain the list.<\/p>\n<p>The Supreme Court ruled 9-0 in favor of First Choice Women\u2019s Center last week, with Justice Neil Gorsuch writing for the unanimous majority that \u201can official demand for private donor information is enough to discourage reasonable individuals from associating with a group,\u201d per a <a href=\"https:\/\/www.christianpost.com\/news\/new-jersey-ag-targets-pregnancy-center-despite-scotus-ruling.html\" target=\"_blank\" rel=\"noopener\">report<\/a> from The Christian Post.<\/p>\n<p>New Jersey Democratic Attorney General Jennifer Davenport immediately sent a <a href=\"https:\/\/adflegal.org\/wp-content\/uploads\/2026\/05\/first-choice-womens-resource-centers-v-davenport-2026-04-30-ag-letter.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a> to Superior Court Judge Lisa Adubato demanding that the legal battle continue.<\/p>\n<p>\u201cThe Court determined that First Choice has Article III standing to proceed with a federal-court challenge to the Division of Consumer Affairs\u2019 November 15, 2023 subpoena at issue in this case,\u201d Davenport wrote.<\/p>\n<p>\u201cThe Court, however, did not \u2018decide the merits of First Choice\u2019s\u2019 challenge to the Subpoena,\u201d she noted. \u201cThis Court should now proceed to resolve the enforceability of that Subpoena.\u201d<\/p>\n<p>Davenport contended that \u201cthere is no basis for this Court to stay its hand while the federal-court litigation proceeds simultaneously.\u201d<\/p>\n<p>Erin Hawley, the attorney for the Alliance Defending Freedom who argued the case before the Supreme Court, said in a <a href=\"https:\/\/adfmedia.org\/case\/first-choice-womens-resource-centers-v-davenport\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> that Davenport was seeking to defy the Supreme Court decision.<\/p>\n<p>\u201cNew Jersey\u2019s attorney general is doubling down on her predecessor\u2019s hostile crusade to keep First Choice from vindicating its First Court\u2019s ruling and underscores the stark reality of this case: For more than two years, New Jersey state officials have targeted First Choice simply because they dislike its pro-life views.\u201d<\/p>\n<p>Hawley emphasized, \u201cBut this week, the Supreme Court sent a clear message: First Choice is entitled to its day in federal court.\u201d<\/p>\n<p>The Christian Post noted that 17 Democratic attorneys general signed a letter in 2023 claiming that anti-abortion pregnancy centers spread \u201cmisinformation and harm\u201d by purportedly \u201cmisleading consumers and delaying access\u201d to abortion.<\/p>\n<p>Now-former New Jersey Democratic Attorney General Matthew Platkin had claimed at the time that he wanted to \u201ccontact a representative sample\u201d of First Choice\u2019s donors to see if they had \u201cbeen misled\u201d about the organization\u2019s \u201cmission and operations,\u201d per a <a href=\"https:\/\/nypost.com\/2026\/04\/29\/us-news\/supreme-court-unanimously-sides-with-nj-crisis-pregnancy-center-against-dems-bid-to-get-donor-list\/\" target=\"_blank\" rel=\"noopener\">report<\/a> from the New York Post.<\/p>\n<p>Gorsuch added in his opinion that \u201cin his view, First Choice\u2019s solicitation materials \u2014 including a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotuss-9-0-ruling-against-new-jerseys-ag-hasnt-stopped-her-harassment-of-pro-life-pregnancy-centers\/\" title=\"New Jersey&#039;s AG abortions.\u201d<\/p>\n<p>He added that \u201cover and again, we have held those demands burden the exercise of First Amendment rights.\u201d<\/p>\n<p>\u201cThe Attorney General has offered a variety of arguments.
