Jared Polis, a Democrat, on Friday afternoon.<\/p>\n<p>The 70-year-old Peters will be released from prison on June 1, <a href=\"https:\/\/apnews.com\/article\/tina-peters-polis-colorado-clemency-trump-eca56e2167a72e306a54b99b847d918c\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a> reported.<\/p>\n<p>The move comes after a Colorado appeals court upheld her data breach conviction last month but found that the sentencing of Peters violated her First Amendment rights because the judge took her political beliefs into account.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/steve-bannons-trial-raises-question-democrats-resurrected-mccarthyism\/\" target=\"_blank\" rel=\"noopener\">Peters was indicted in 2022<\/a> on 10 counts, both felonies and misdemeanor, after she allowed another election integrity activist to access secure areas of the county\u2019s election system in an attempt to find if fraud had been perpetrated in the 2020 election.<\/p>\n<p>The judge at her sentencing, District Judge Matthew Barrett, made explicit reference to the fact that Peters had been a supporter of Donald Trump\u2019s claims of voter fraud and indicated it factored into him giving her a nine-year prison sentence.<\/p>\n<p>\u201cYou are no hero. You abused your position and you\u2019re a charlatan \u2026 It\u2019s just more lies. No objective person believes them. No, at the end of the day, you cared about the jets, the podcasts and people fawning over you,\u201d he said at the sentencing.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/tina-peters-9-year-prison-sentence-thrown-massive-victory-70-year-old-election-integrity-advocate-america\/\" target=\"_blank\" rel=\"noopener\">The appeals court<\/a> agreed that the verdict was fair but that the sentencing, especially given the judge\u2019s language, was not.<\/p>\n<p>\u201cThe trial court\u2019s comments about Peters\u2019s belief in the existence of 2020 election fraud went beyond relevant considerations for her sentencing,\u201d the court ruled in a 3-0 decision.<\/p>\n<p>\u201cHer offense was not her belief, however misguided the trial court deemed it to be, in the existence of such election fraud; it was her deceitful actions in her attempt to gather evidence of such fraud.\u201d<\/p>\n<p>The case had been referred to Mesa County courts for resentencing, but Gov. Polis effectively put an end to that Friday by offering her clemency and a release date just a few weeks away.<\/p>\n<p>While <a href=\"https:\/\/www.westernjournal.com\/developing-massive-news-tina-peters-political-prisoner-case-freedom-just-days-away\/\" target=\"_blank\" rel=\"noopener\">Polis<\/a> said in his letter to Peters that the crimes she was convicted of deserved prison time, \u201cthis is an extremely unusual and lengthy sentence for a first time offender who committed nonviolent crimes.\u201d<\/p>\n<p>\u201cShe thought she was trying to back up the software before it was updated. She did it illegally. There\u2019s no question about it. And she deserves to go to prison. And I think this is a more appropriate, even harsh, frankly sentence for that crime,\u201d Polis said Friday, according to the <a href=\"https:\/\/sentinelcolorado.com\/state-and-region-news\/gov-polis-commutes-prison-sentence-for-ex-gop-clerk-tina-peters-sparking-outrage\/\" target=\"_blank\" rel=\"noopener\">Colorado Sentinel<\/a>.<\/p>\n<p>He added that <a href=\"https:\/\/www.westernjournal.com\/let-murderers-keep-colorado-political-prisoner-tina-peters-sends-letter-pleading-us-marshals-save\/\" target=\"_blank\" rel=\"noopener\">Peters\u2019<\/a> application for clemency \u201cdemonstrates taking responsibility for your crimes, and a commitment to follow the law going forward.\u201d<\/p>\n<p>\u201cI made mistakes, and for those I am sorry. Five years ago I misled the Secretary of State when allowing a person to gain access to county voting equipment. That was wrong,\u201d Peters said in a statement.<\/p>\n<p>\u201cI have learned and grown during my time in prison and going forward I will make sure that my actions always follow the law, and I will avoid the mistakes of the past.\u201d<\/p>\n<p>Opposite sides of the political spectrum, obviously, reacted quite differently.
