In a brief, unsigned order on the emergency docket, the high court denied the petition and gave no description or dissents, ending Democrats\u2019 hopes of reshaping congressional districts for the 2026 elections-when they were aiming to flip as manny as four of virginia\u2019s 11 House seats.<\/p>\n<p>Democrats had argued that the state constitution\u2019s \u201celection\u201d should refer only to the single election day,not the early-voting period,and they claimed the U.S. Supreme court had jurisdiction to review the dispute even though it centered on state constitutional rules. The Virginia Supreme Court\u2019s 4-3 ruling had found the amendment was passed after more than 1 million early votes had already been cast, making the April 21 referendum null and void.<\/p>\n<p>While Gov. The Virginia Constitution requires ballot measures to be voted on by the state legislature in two stages, with an election in between to give voters the opportunity to weigh the amendment when they vote for their representatives.<\/p>\n<div class=\"article-paywall\">\n<p>The 4-3 majority on the Virginia Supreme Court ruled that because the state legislature passed the constitutional amendment after more than 1 million votes had been cast through early voting in the 2025 election, the April 21 referendum was null and void.
