The decision lets mail-order delivery of the abortion pill continue, and the Court did not resolve the underlying merits of the dispute-rather, it focused on whether the manufacturers met the standard for emergency relief. <\/p>\n<p>The article says the 5th Circuit had paused the FDA\u2019s mail-order permissions at the request of Louisiana, but the Supreme court temporarily halted that block before ultimately allowing the relaxed REMS rules to stand during further legal proceedings. Justices Clarence Thomas and Samuel Alito dissented, arguing the case shoudl not be paused on the basis of lost profits from an alleged unlawful scheme and warning about issues such as compliance with federal restrictions. <\/p>\n<p>The piece also claims that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/louisiana-demands-fda-end-illegal-mail-order-abortion-pills\/\" title=\"... Pills\">pro-life plaintiffs<\/a> and groups view the \u201cstatus quo\u201d as insufficient, arguing safeguards like in-person dispensing and other controls reduce risk-while the FDA and the manufacturers maintain that the current framework is about maintaining the existing regulatory position and conducting a science-based safety review.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Online abortion pill sellers can continue illegally trafficking mifepristone into pro-life states until litigation over a landmark abortion drug lawsuit out of Louisiana is resolved, the Supreme Court ruled on Thursday. The high bench\u2019s grant of mifepristone manufacturers\u2019 emergency appeal endangers women and babies who are not required by the U.S. Food and Drug Administration to receive in-person medical care before or after obtaining abortion pills. <\/p>\n<p>The 5th Circuit Court of Appeals initially paused the FDA\u2019s mail-order abortion permissions when it <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2026\/05\/2026-05-01-Fifth-Circuit-Order-Granting-Stay-of-2023-REMS.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unanimously granted<\/a> Louisiana\u2019s request for a stay at the beginning of May. Two days later, the Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/05\/04\/supreme-court-temporarily-revives-fda-rule-allowing-mailing-of-harmful-abortion-drugs\/\" target=\"_blank\" rel=\"noreferrer noopener\">temporarily halted<\/a> the 5th Circuit\u2019s block. <\/p>\n<p>After hearing briefs from both sides, the Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a1207_21p3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled seven to two<\/a> on Thursday evening that mifepristone manufacturers had demonstrated enough of a case for emergency relief from the 5th Circuit\u2019s intervention by claiming \u201csubstantial financial interest.\u201d Under this ruling, the <a href=\"https:\/\/thefederalist.com\/2024\/03\/05\/selling-abortion-pills-bloodies-the-hands-of-walgreens-and-cvs\/\" target=\"_blank\" rel=\"noreferrer noopener\">radically relaxed <\/a><a href=\"https:\/\/chrissmith.house.gov\/news\/documentsingle.aspx?DocumentID=398811\" target=\"_blank\" rel=\"noreferrer noopener\">abortion pill policies<\/a> introduced by the Biden administration and allowed to stand under the Trump FDA will remain while the case is further litigated in the 5th Circuit.<\/p>\n<p>SCOTUS may not have weighed in on the merits of the case, but <a href=\"https:\/\/thefederalist.com\/2026\/05\/14\/thomas-alito-blast-scotus-for-helping-undermine-dobbs-with-abortion-drug-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">dissenting Justices Clarence Thomas and Samuel Alito<\/a> did not hold back on chastising the majority for its decision. Thomas, in addition to emphasizing the 5th Circuit\u2019s belief that abortion pill makers \u201chave not satisfied their burden for securing interim relief,\u201d warned that the prevalence of mail-order mifepristone violates the Comstock Act.<\/p>\n<p>\u201cApplicants are not entitled to a stay of an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-lifts-block-on-mail-order-abortion-pills\/\" title=\"Supreme ... lifts block on mail-... ... pills\">adverse court order based<\/a> on lost profits from their criminal enterprise,\u201d Thomas continued. \u201cThey cannot, in any legally relevant sense, be irreparably harmed by a court order that makes it more difficult for them to commit crimes.\u201d<\/p>\n<p>Alito warned in his dissent that even if the FDA \u201cwere to execute an abrupt about-face and commence enforcement of the in-person-dispensing requirement,\u201d mifepristone makers still \u201chave not shown that they would suffer irreparable injury.\u201d <\/p>\n<p>Alito further reprimanded his colleagues by dubbing their \u201cunreasoned order granting stays in this case\u201d as \u201cremarkable.\u201d <\/p>\n<p>\u201cWhat is at stake is the perpetration of a scheme to undermine our decision in <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>, 597 U. S. 215 (2022), which restored the right of each State to decide how to regulate abortions within its borders,\u201d Alito wrote. <\/p>\n<p>Even more at stake than the sovereignty of states like Louisiana are the babies and women who are at risk of harm and abuse linked to abortion drugs sent by mail. <\/p>\n<p>Mifepristone maker Danco Laboratories, the FDA, and <a href=\"https:\/\/thefederalist.com\/2025\/05\/28\/study-abortion-lobby-medias-claims-that-mifepristone-is-safer-than-tylenol-are-hogwash\/\" target=\"_blank\" rel=\"noreferrer noopener\">corporate media<\/a> insist that pregnancy-ending pills are <a href=\"https:\/\/thefederalist.com\/2025\/07\/23\/missouri-ag-sues-planned-parenthood-for-falsely-advertising-dangerous-abortion-drug-as-safe\/\" target=\"_blank\" rel=\"noreferrer noopener\">safe<\/a>, but it\u2019s no secret that chemical abortion is associated with side effects such as <a href=\"https:\/\/prochoice.org\/wp-content\/uploads\/phone_triage_guide.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">bleeding<\/a>, <a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfast, weak pulse,\u201d \u201ctrouble breathing,\u201d diarrhea, dizziness, headache, vomiting<\/a>, <a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cpain\u201d across the back, arms, neck, and abdomen<\/a>. <\/p>\n<p>A 2025 analysis of insurance data found that more than <a href=\"https:\/\/thefederalist.com\/2025\/04\/28\/study-rate-of-serious-or-life-threatening-complications-after-abortion-pill-is-22-times-higher-than-fda-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">one in 10 women<\/a> who take mifepristone suffer even more serious complications such as hemorrhage or infection. The risk of contracting a life-threatening event is at least 22 times higher than what the FDA and Danco claim. Peril only increases if a mother whose pregnancy is further along than the recommended <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s025Lbl.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">10 weeks<\/a> uses mifepristone, an easy thing to do without an in-person doctor visit to diagnose gestational age. <\/p>\n<p>Mifepristone is the most popular abortion drug on the market, even without <a href=\"https:\/\/www.guttmacher.org\/2024\/03\/medication-abortion-accounted-63-all-us-abortions-2023-increase-53-2020\" target=\"_blank\" rel=\"noreferrer noopener\">data<\/a> accounting for pills illegally mailed to women in pro-life states. The prominence and promotion of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/as-thousands-march-for-life-democrats-are-out-of-step-with-majority\/\" title=\"As Thousands March For Life, Democrats Are Out Of Step With Majority\">mail-order abortion drugs<\/a> has <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">undoubtedly<\/a> contributed to the<a href=\"https:\/\/thefederalist.com\/2025\/08\/11\/man-allegedly-murdered-his-unborn-baby-by-spiking-her-moms-hot-cocoa-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\"> deadly and dangerous consequences<\/a> of\u00a0forced chemical abortion. <\/p>\n<p>Stories about <a href=\"https:\/\/thefederalist.com\/2025\/06\/11\/tx-man-arrested-after-allegedly-poisoning-his-girlfriend-murdering-his-child-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">women<\/a> like plaintiff Rosalie Markezich <a href=\"https:\/\/thefederalist.com\/2025\/08\/11\/man-allegedly-murdered-his-unborn-baby-by-spiking-her-moms-hot-cocoa-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">suffering<\/a> but <a href=\"https:\/\/thefederalist.com\/2025\/08\/26\/illinois-man-charged-with-killing-girlfriends-baby-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">surviving<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion pill<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/11\/12\/suspended-ohio-doctor-posed-as-ex-wife-to-get-abortion-drugs-then-allegedly-forced-them-on-girlfriend\/\" target=\"_blank\" rel=\"noreferrer noopener\">poisonings<\/a> and <a href=\"https:\/\/lozierinstitute.org\/hidden-epidemic-nearly-70-of-abortions-are-coerced-unwanted-or-inconsistent-with-womens-preferences\/\" target=\"_blank\" rel=\"noreferrer noopener\">coerced<\/a> <a href=\"https:\/\/thefederalist.com\/2026\/02\/26\/another-tx-man-charged-after-allegedly-murdering-his-unborn-baby-with-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortions<\/a> flooded the airwaves ahead of Louisiana\u2019s landmark lawsuit against the FDA and mifepristone manufacturers. It\u2019s abortion pill makers\u2019 concerns about \u201ccompliance costs and mifepristone profits,\u201d however, that have temporarily won out over concerns about women and babies.  <\/p>\n<p>The FDA continues to claim in the wake of <a href=\"https:\/\/thefederalist.com\/2026\/05\/13\/as-makary-steps-down-pro-lifers-await-movement-from-trump-fda-on-abortion-drugs\/\" target=\"_blank\" rel=\"noreferrer noopener\">Commissioner Marty Makary\u2019s exit<\/a> that it is \u201ccommitted to protecting the health and safety of women\u201d and emphasizes that the Supreme Court\u2019s order simply \u201cmaintains the status quo.\u201d <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">FDA is committed to protecting the health and safety of women.\u00a0The Supreme Court\u2019s order, issued today, maintains the status quo with respect to the REMS governing mifepristone.\u00a0The FDA will press forward to complete its science-based safety review of the mifepristone REMS and,\u2026<\/p>\n<p>\u2014 U.S. FDA (@US_FDA) <a href=\"https:\/\/twitter.com\/US_FDA\/status\/2055043549062991971?ref_src=twsrc%5Etfw\">May 14, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>To Louisiana, Markezich, and the pro-life groups who have called on the FDA to reinstate some of the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >common-sense abortion pill safeguards<\/a>, which <a href=\"https:\/\/www.fda.gov\/media\/128651\/download\" target=\"_blank\" rel=\"noreferrer noopener\">do not require a full review to restore<\/a>, the \u201cstatus quo\u201d isn\u2019t good enough. <\/p>\n<p>\u201cWe are disappointed by this decision that allows the FDA and the abortion industry to continue nullifying <em>Dobbs<\/em> and its promise to return the issue of abortion to the people,\u201d Alliance Defending Freedom Counsel Erin Hawley <a href=\"https:\/\/adfmedia.org\/case\/the-state-of-louisiana-v-u-s-food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in statement. \u201cIt\u2019s high time the Biden FDA be held accountable for the destruction it has caused with this high-risk drug. Together with Louisiana Attorney General Liz Murrill\u2019s office, we look forward to litigating our appeal at the 5th Circuit to protect mothers and their children.\u201d<\/p>\n<p>SBA Pro-Life America President Marjorie Dannenfelser wrote her organziation is \u201cdeeply disappointed the Supreme Court will not respond to the harm occurring nationwide with mercy\u201d and admonished the Trump administration to \u201cdo the right thing.\u201d <\/p>\n<p>\u201cSettle this case and restore in-person dispensing immediately, while moving forward on a comprehensive safety review of mifepristone without delay,\u201d Dannenfelser concluded.
