The commonwealth\u2019s far-left governor has called the time of death.<\/p>\n<p>\u201cIt\u2019s really over. The body is still flopping around on the table, but it\u2019s dead,\u201d former Virginia Attorney General Ken Cuccinelli told me Thursday in an interview on <a href=\"https:\/\/www.iheart.com\/podcast\/477-the-dan-odonnell-show-27550539\/now-playing\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Dan O\u2019Donnell Show<\/em><\/a>  on NewsTalk 1130 WISN in Milwaukee. <\/p>\n<p>Cuccinelli, who serves as national chairman of the <a href=\"https:\/\/electiontransparency.org\" target=\"_blank\" rel=\"noreferrer noopener\">Election Transparency Initiative,<\/a> expects the U.S. Supreme Court on Friday to bury the Democrats\u2019 desperate <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1240\/408563\/20260511151941216_25A%20Application%20for%20Stay.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">application for stay<\/a> without comment. If this delightful melodrama had a soundtrack it would be Simon &#038; Garfunkel\u2019s \u201c<a href=\"https:\/\/www.youtube.com\/watch?v=4fWyzwo1xg0\" target=\"_blank\" rel=\"noreferrer noopener\">Th<\/a><a href=\"https:\/\/www.youtube.com\/watch?v=4fWyzwo1xg0\"><em>e Sounds of Silence.<\/em><\/a>\u201d Gov. Abigail Spanberger, Democrat L. Louise Lucas, the nasty, loudmouthed state senator under a <a href=\"https:\/\/www.foxnews.com\/politics\/fbi-raids-spanberger-ally-office-federal-corruption-probe-targets-cannabis-business\" target=\"_blank\" rel=\"noreferrer noopener\">cloud of corruption<\/a>, and the rest of the insufferable pols once so cocksure all wearing the black garb of mourning and mouthing the words as they lower the coffin filled with the aborted remains of their gerrymandering plan into a fresh grave.<\/p>\n<p><em>Hello Darkness, my old friend<\/em><\/p>\n<p><em>I\u2019ve come to talk with you again<\/em> <\/p>\n<p>\u201cYou\u2019ll probably hear from the Supreme Court [Friday], but what you\u2019ll hear is a great big nothingness,\u201d Cuccinelli said. \u201cI don\u2019t think a single justice is going to have a single thing to say about this other than that they will pass on the opportunity to even weigh in.\u201d<\/p>\n<h2>\u2018Unprecedented Manner\u2019<\/h2>\n<p>Earlier this week, Virginia Attorney General <a href=\"https:\/\/thefederalist.com\/2025\/10\/07\/gun-control-zealots-other-lefties-stand-by-two-bullets-jay-jones\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jay \u201cTwo Bullets\u201d Jones<\/a> and lawyers for Virginia Democrats begged SCOTUS to do what it generally doesn\u2019t: overrule a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-supreme-court-sides-with-abbott-blocks-mask-mandates\/\" title=\"Texas ... Sides With Abbott, Blocks Mask Mandates\">state supreme court decision<\/a>. Still stinging over the Virginia Supreme Court\u2019s 4-3 ruling a week ago stopping the gerrymandering attempt, Dems hope the nation\u2019s high court will let them go ahead with their power trip. <\/p>\n<p>As The Federalist\u2019s Breccan Thies <a href=\"https:\/\/thefederalist.com\/2026\/05\/08\/virginia-supreme-court-strikes-down-democrat-gerrymander\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported,<\/a> the Virginia Supreme Court found Democrats had violated the commonwealth\u2019s constitution in their attempt to amend it to ram through a new congressional map. The court rejected the \u201cunprecedented\u201d way in which the Democrat state legislative majority passed the resolution setting up the April election on the amendment, which was narrowly approved despite an <a href=\"https:\/\/thefederalist.com\/2026\/04\/24\/blatantly-dishonest-language-on-virginia-ballots-fits-long-pattern-of-democrat-word-abuse\/\" target=\"_blank\" rel=\"noreferrer noopener\">egregiously misleading ballot question<\/a> and supporters outspending referendum opponents <a href=\"https:\/\/wset.com\/news\/local\/nearly-100-million-spent-as-virginia-redistricting-vote-is-declared-null-and-void-referendum-congressional-maps-democrats-republicans-may-2026\" target=\"_blank\" rel=\"noreferrer noopener\">3 to 1<\/a>. <\/p>\n<p>\u201cIn this case, the Commonwealth submitted a proposed constitutional amendment to Virginia voters in an unprecedented manner that violated the intervening-election requirement in Article XII, Section 1 of the Constitution of Virginia,\u201d the court <a href=\"https:\/\/www.vacourts.gov\/static\/opinions\/opnscvwp\/1260127.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote.<\/a> \u201cThis violation irreparably undermines the integrity of the resulting referendum vote and renders it null and void. For this reason, the congressional district maps issued by this Court in 2021 pursuant to Article II, Section 6-A of the Constitution of Virginia remain the governing maps for the upcoming 2026 congressional elections.\u201d<\/p>\n<p>Democrats thought the court unfair for stopping their unfair gerrymander, aimed at taking four U.S. House seats from Republicans, expanding Democrats\u2019 representative advantage from 6 to 5 to 10 to 1. <\/p>\n<p>The National Association for the Advancement of Colored People, which has long endorsed race-based, affirmative action gerrymanders, filed an <a href=\"https:\/\/naacp.org\/sites\/default\/files\/documents\/2026-05-13%20FINAL%20NAACP%20Amicus.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus<\/a> brief on Wednesday asserting that the state Supreme Court\u2019s ruling disregards the will of the 3.1 million voters who supported the referendum. <\/p>\n<p>\u201cThe NAACP will not stand by idly in the face of this blatant attempt to overrule the will of Virginia voters,\u201d NAACP President and CEO Derrick Johnson <a href=\"https:\/\/naacp.org\/articles\/naacp-files-brief-support-virginians-after-state-supreme-court-nullifies-redistricting\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in a statement, disregarding the will of the people who would like to see Virginia\u2019s constitution adhered to. <\/p>\n<h2>\u2018Hoisted Up On Their Own Petard\u2019<\/h2>\n<p>Curiously, Virginia Democrats are trying to make the case before SCOTUS that federal law \u201cexpressly fixes a single day for the \u2018election\u2019 of Representatives and Delegates to Congress.\u201d They\u2019re right. It\u2019s the same <a href=\"https:\/\/www.oyez.org\/cases\/2025\/24-1260\" target=\"_blank\" rel=\"noreferrer noopener\">argument<\/a> Republicans are making in a case before the U.S. Supreme Court aiming to end the months-long election season of early voting that liberals love so much. Virginia Democrats in charge of the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >government gave voters 45-day election seasons<\/a>. <\/p>\n<p>As The Federalist\u2019s Elle Purnell <a href=\"https:\/\/thefederalist.com\/2026\/05\/14\/scotus-could-do-the-funniest-thing-and-mandate-a-single-election-day-at-jay-jones-request\/\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> in a piece mocking the Virginia Dems\u2019 cynical legal argument, left-wing news outlet Vox <a href=\"https:\/\/www.vox.com\/politics\/488391\/supreme-court-virginia-gerrymander-scott-mcdougle-jay-jones\" target=\"_blank\" rel=\"noreferrer noopener\">cautioned<\/a> that Jones was shooting Democrat interests in the foot by asking the Supreme Court to weigh in on that claim. <\/p>\n<p>Cuccinelli said Jones\u2019 out-of-state attorneys argued before the Virginia Supreme Court that \u201cvoters vote early at their own risk.\u201d <\/p>\n<p>\u201cAnd this is the same party who\u2019s been telling us that early voting is holy writ for so long,\u201d the former AG said. \u201cAnd it is amusing that they got hoisted up on their own petard in that regard.\u201d<\/p>\n<p>Reality has set in for Spanberger, whose far-left policy agenda has repeatedly crashed into reality in her opening months as Virginia governor. The new maps and their grandiose designs of helping the Democratic Party take back the House this midterm won\u2019t be in place this year, even if the U.S. Supreme Court grants a stay. Spanberger told Virginia media that the deadline to have the congressional maps in place has passed. <\/p>\n<p>\u201c\u2026[W]hen it comes to the execution of elections, no matter the outcome in that case, we will be running our elections beginning next month with early voting on the current maps that we have,\u201d she <a href=\"https:\/\/www.denvergazette.com\/2026\/05\/14\/spanberger-concedes-defeat-on-redistricting-and-says-2026-elections-will-use-old-map\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> WTOP News. <\/p>\n<p>Cuccinelli called the Democrats\u2019 campaign to redraw Virginia\u2019s maps \u201cgangster legislating.\u201d It definitely woke up red states that had been sleep-walking on the subject of mid-decade redistricting, <a href=\"https:\/\/www.wabe.org\/georgia-joins-redistricting-effort-for-2028-as-louisiana-advances-plan-for-new-us-house-districts\/\" target=\"_blank\" rel=\"noreferrer noopener\">escalating<\/a> the gerrymandering war. Alabama, Georgia, Florida, Louisiana, <a href=\"https:\/\/www.nbcnews.com\/politics\/2026-election\/south-carolina-governor-mcmaster-calls-special-session-redistricting-rcna345104\" target=\"_blank\" rel=\"noreferrer noopener\">South Carolina<\/a>, and Tennessee are all moving toward redrawing their maps, driven by the Democrats\u2019 Virginia gambit and the U.S. Supreme Court\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/04\/30\/scotus-crowns-good-week-for-the-rule-of-law-by-gutting-racial-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent ruling<\/a> all but ending race-based gerrymanders that have long been the political tools of Democrats. <\/p>\n<p>\u201cSo [Democrats] successfully ticked everybody off and got a bunch of other states motivated to get going and then lost their four seats in Virginia,\u201d Cuccinelli said, laughing at the left\u2019s hubris. <\/p>\n<p>It all amounted to a \u201cgreat big nothingness\u201d for the scheming Democrats, to borrow from Cuccinelli\u2019s colorful turn of phrase. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
