The GOP argues it\u2019s too late to reinstate the results because the deadline for using the disputed map has passed,and they also contend the case lacks a federal legal basis the Supreme Court can consider.<\/p>\n<p>Democrats had asked the supreme Court to reverse a state ruling finding Virginia officials illegally rushed the April 21 referendum to voters. The voided vote narrowly passed and would have shifted congressional districts to give Democrats about a 10-1 advantage rather than their current 6-5 edge. Virginia\u2019s GOP also emphasized that the ballot measure was derailed because the legislature violated state constitutional requirements by moving to a referendum without following the two<a href=\"https:\/\/amzn.to\/3YuVZYV\" >-stage voting process mandated<\/a> by law.<\/p>\n<p>While Gov. Abigail Spanberger said Virginia will use the current congressional map for 2026, she argued the Supreme Court should still address the broader issues raised in the petition. Senator...s Bill Is Specifically for Taxpayers 65 and Older\">state constitutional amendment process<\/a>, all so that they can redraw congressional districts weeks before early voting begins in the primary,\u201d the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1240\/408888\/20260514160845177_Scott%20v%20McDougle%20Plaintiffs%20Opposition%20to%20Stay%20Application.pdf\" type=\"link\" id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1240\/408888\/20260514160845177_Scott%20v%20McDougle%20Plaintiffs%20Opposition%20to%20Stay%20Application.pdf\">brief<\/a> said.<\/p>\n<div class=\"article-paywall\">\n<p>\u201cBut the application is even more extraordinary for what it omits: any mention of a deadline for relief, any discussion of the injunction in a separate case that renders the application meaningless, and any federal question providing this Court a basis for review,\u201d  the brief continued.<\/p>\n<p>The referendum at the center of the dispute, which narrowly passed last month, would have changed Virginia\u2019s congressional districts to give Democrats a likely 10-1 edge over the GOP, compared to their current 6-5 advantage.<\/p>\n<p>The April 21 vote was ruled null and void by the commonwealth\u2019s highest court last week, after the state legislature violated the Virginia Constitution when sending the referendum to voters. The Virginia Constitution requires ballot measures to be voted on by the state legislature in two stages, with an election in between to give voters the opportunity to weigh the amendment when they vote for their representatives.<\/p>\n<p>The Virginia Republican leaders\u2019 filing to the Supreme Court noted Virginia Democrats previously listed May 12 as the \u201cpoint of no return\u201d to be able to implement the congressional map approved by voters in the voided vote, a deadline which has already passed. Gov. Abigail Spanberger (D-VA) <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/4569122\/abigail-spanberger-concedes-defeat-redistricting\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/4569122\/abigail-spanberger-concedes-defeat-redistricting\/\">conceded in an interview with WTOP News<\/a> that the state would use the current congressional map for the 2026 elections, but still said the emergency petition to the Supreme Court had important issues for the future that the high court should decide.<\/p>\n<p>The last-ditch effort by Virginia Democrats is widely considered a long shot, especially because the lawsuit appealed from the Virginia Supreme Court deals with issues interpreting the Virginia Constitution rather than the U.S. Constitution.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4563668\/virginia-democrats-ask-supreme-court-to-reinstate-nullified-redistricting-amendment\/\" type=\"post\" id=\"4563668\">VIRGINIA DEMOCRATS ASK SUPREME COURT TO REINSTATE NULLIFIED REDISTRICTING AMENDMENT<\/a><\/strong><\/p>\n<p>The U.S. Supreme Court typically lacks jurisdiction to review cases appealed from state supreme courts that do not have a federal constitutional issue at the center.
