It claims that after the Supreme court\u2019s decision striking down <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-depth-federal-state-lawsuits-seek-constitutional-clarity-on-racial-gerrymanders\/\" title=\"Federal and state ...suits aim to clarify constitutionality of &quot;racial gerrymanders.&quot;\">race-based redistricting<\/a> in *Louisiana v. Callais*, Democrats began actively seeking structural changes to achieve favorable judicial outcomes, citing statements from prominent Democrats like Sen. Ruben Gallego, Rep.Ro Khanna, and Rep. Summer Lee.<\/p>\n<p>It also contends that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/poll-44-percent-of-americans-have-never-heard-of-msnbcs-chris-hayes\/\" title=\"POLL: 44 Percent of Americans Have Never Heard of MSNBC\u2019s Chris Hayes\">left-wing views<\/a> of the Court historically treated it as a political instrument rather than a neutral interpreter of the Constitution,especially during the Warren and Burger eras. According to the piece, as Republican presidents and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >conservative legal efforts produced<\/a> more conservative\/originalist justices, the Court became less available to Democrats to advance their agenda through rulings unaccountable to voters and elected representatives. The article concludes that this push would undermine the Court\u2019s legitimacy and the separation of powers if successful.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Democrats will oftentimes play the <a href=\"https:\/\/thefederalist.com\/2026\/02\/17\/virginia-gov-spanberger-claimed-she-was-a-moderate-but-is-governing-as-a-radical\/\" target=\"_blank\" rel=\"noreferrer noopener\">Abigail Spanberger card<\/a> by working with legacy media to hide their radicalism from voters. But when it comes to their goal of packing the Supreme Court with left-wing activists, they\u2019ve taken the mask completely off. <\/p>\n<p>Since the release of its <em>Louisiana v. Callais<\/em> decision <a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">nuking<\/a> race-based redistricting, Democrats have <a href=\"https:\/\/capitalresearch.org\/article\/the-disappearing-court-packers\/\" target=\"_blank\" rel=\"noreferrer noopener\">revamped<\/a> their intention to add more justices to the high court as a means of acquiring judicial outcomes that benefit their party. While some have employed coy language about SCOTUS \u201creforms,\u201d others have been straightforward in their desire to destroy one of America\u2019s last functioning institutions by stacking the court with leftists.<\/p>\n<p>\u201cThis is the most partisan Supreme Court in the history of the nation. Time to add term limits and more justices,\u201d <a href=\"https:\/\/x.com\/RubenGallego\/status\/2053975039343468717?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> <a href=\"https:\/\/azfreenews.com\/2026\/05\/new-timeline-raises-questions-about-gallegos-knowledge-of-swalwell-allegations\/\" target=\"_blank\" rel=\"noreferrer noopener\">Eric Swalwell\u2019s BFF<\/a> Sen. Ruben Gallego, D-Ariz., in a Monday X post.<\/p>\n<p>Rep. Ro Khanna, D-Calif., followed suit on Tuesday. The California Democrat <a href=\"https:\/\/x.com\/RoKhanna\/status\/2054159193637069190?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> that the \u201cnext Democratic White House does not need a court reform commission like some college seminar,\u201d but that, \u201cWe need action.\u201d<\/p>\n<p>\u201cWe need term limits for Justices. We need to expand this morally bankrupt Court from 9 to 13,\u201d Khanna wrote. <\/p>\n<p>In calling for \u201ccourt reform,\u201d Rep. Summer Lee, D-Pa., also <a href=\"https:\/\/x.com\/RepSummerLee\/status\/2053919765933273222?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">backed<\/a> Democrat plans to \u201cExpand the Court\u201d and \u201cSet term limits\u201d as a way of stopping what she characterized as \u201csystematic\u201d \u201cAttacks on our voting rights.\u201d<\/p>\n<p>The officials are but a few of the <a href=\"https:\/\/thefederalist.com\/2026\/05\/01\/dems-revive-court-packing-threats-after-being-told-they-cant-do-racist-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">many Democrats<\/a> or other leftists who have telegraphed \u2014 if not outright declared \u2014 their support for packing the Supreme Court since <em>Callais<\/em>\u2018 release.<\/p>\n<p>While having psychotic meltdowns at not getting their way is nothing new for the left, the open embrace of such power-hungry tactics underscores how Democrats have historically viewed the Supreme Court, and how the body has become yet another flashpoint in the battle for control of Congress. <\/p>\n<p>As Federalist Editor-in-Chief Mollie Hemingway detailed in her new book, <em><a href=\"https:\/\/www.barnesandnoble.com\/w\/alito-mollie-hemingway\/1147952913\" target=\"_blank\" rel=\"noreferrer noopener\">Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution<\/a><\/em>, leftist control of the high court throughout much of the 20th century turned an institution meant for interpreting the law into one that invented law via activist rulings. Under the Warren and Burger Courts, SCOTUS \u201chad functioned as a super-legislature, enacting the Left\u2019s policies by a majority vote of justices, no matter what the Constitution said.\u201d<\/p>\n<p>\u201cThe Left had come to view the Court as its rightful property and would not cede control willingly,\u201d Hemingway wrote. <\/p>\n<p>As Republican presidents and the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/whitehouse-pushes-justice-dept-to-support-controversial-donor-disclosure-rule\/\" title=\"Whitehouse Pushes Justice Dept. to Support Controversial Donor Disclosure Rule\">conservative legal movement<\/a> got better at elevating individuals who would properly interpret the Constitution as written to the bench, the left\u2019s control of SCOTUS steadily waned. Now, with a majority of appointed <a href=\"https:\/\/www.law.cornell.edu\/wex\/originalism\" target=\"_blank\" rel=\"noreferrer noopener\">originalists<\/a>, the high court is no longer available to Democrats to ram their radical agenda into law with zero input from the American people and their elected representatives.<\/p>\n<p>This reality and the wave of constitutional decisions from the conservative justices are what\u2019s driving the left\u2019s bid to stack the court with Ketanji Brown Jackson-style activists \u2014 leftists who will make decisions based on what\u2019s best for the Democrat Party, not the rule of law.<\/p>\n<p>And while potential Supreme Court appointments have long been a facet of federal elections throughout America (see the 2016 presidential race), the dynamic has now changed. <\/p>\n<p>These elections are no longer just about which party gets to appoint justices to the Supreme Court. They\u2019re about whether the number of justices will remain the same or if Democrats will get to pack the court and turn it back into a de-facto legislature that invents new constitutional \u201crights\u201d as a majority of its members see fit. <\/p>\n<p>Should Democrats succeed in their goal, the high court\u2019s legitimacy would shatter, and so too America\u2019s separation of powers. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
