The Virginia supreme Court struck down the referendum Democrats pushed-saying the process was unconstitutional and nullified the referendum\u2019s legal effect-while the U.S. Supreme Court also removed a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >key left-leaning tool<\/a> by rejecting racial gerrymandering. Supporters of the decision argue Democrats moved too quickly,violated state constitutional requirements,and used misleading ballots and advertising,while democrats denounced it as shocking and vowed to keep fighting.<\/p>\n<p>The ruling is portrayed as a notable advantage for Republicans heading into November, perhaps affecting multiple House seats and boosting GOP odds to keep or gain control. Rules Child Gender Transitions Can Be Investigated As Child Abuse\">state supreme court struck<\/a> down that referendum Democrats spent $64 million on, but the U.S. Supreme Court tossed a favorite tool of the Left \u2014 racial gerrymandering \u2014 triggering a massive race to redraw the entire red South. Suddenly, the plans for a November victory parade seem surprisingly premature.<\/p>\n<p>On Friday, in a decision that several legal experts expected, the Commonwealth\u2019s justices ruled that \u201cthe legislative process employed\u201d to advance the referendum was unconstitutional and \u201cincurably taints the resulting referendum vote and nullifies its legal efficacy.\u201d<\/p>\n<p>It was an outcome that former Virginia Attorney General Ken Cuccinelli predicted, noting that there were <a href=\"https:\/\/x.com\/KenCuccinelli\/status\/2046763761264984137\">at least four violations of the state constitution<\/a> in the process that led to the Democrats\u2019 narrow win at the ballot box. And to many, that win, a squeaker at 51-49%, proved why the purple state should have never been redrawn in the first place.<\/p>\n<p>For Republicans, who were furious at the power grab in Governor Abigail Spanberger\u2019s (D) state, the ruling gives voice to millions of disenfranchised voters who stood to lose four seats in the U.S. House.<\/p>\n<p>\u201cThis is the correct decision, and it was always going to end up this way,\u201d Rep. Ben Cline (R-Va.) agreed. \u201cDemocrats broke laws that they helped write in the first place, blew through deadlines, wrote a biased and misleading ballot question, and lied to the voters in all of their advertising to support the referendum.<\/p>\n<p>The voters of Virginia banned gerrymandering six years ago, and that ban remains in effect today,\u201d he reiterated. \u201cThis is a great day for fair elections and the rule of law, and it\u2019s a great day for the Commonwealth of Virginia.\u201d<\/p>\n<p>House Speaker Mike Johnson (R-La.), who already has an uphill climb for the midterms, cheered the result as \u201ca victory for democracy.\u201d \u201c[It] ensures Virginians have fair representation in Congress,\u201d he said.<\/p>\n<p>On the Left, Jeffries and company decried the decision as \u201cshocking,\u201d while Virginia House Speaker Don Scott (D) issued a statement saying, \u201cWe respect the decision of the Supreme Court of Virginia. We respect the court. But we will keep fighting for a democracy where voters \u2014 not politicians \u2014 have the final say. Because in Virginia, power still belongs to the people,\u201d he argued.<\/p>\n<p>And while Democrats complain about the \u201cunfairness\u201d of the decision, Rep. Morgan Griffith (R-Va.) said it didn\u2019t take a legal genius to see that this was a possibility.<\/p>\n<p>\u201cThey didn\u2019t pay attention to the fact that they had to follow the Virginia Constitution. And they rushed it through. And they made a number of mistakes [by not following the letter of the law].\u201d But \u201cthey\u2019re still complaining that, \u2018Well, it went to the voters in the referendum, and those people\u2019s votes didn\u2019t count.\u2019 Well,\u201d Griffith said on Friday\u2019s \u201cWashington Watch,\u201d \u201cthey should have anticipated that and gotten all of the i\u2019s dotted, and the t\u2019s crossed. When you do something in an unconstitutional manner under the Virginia Constitution, you\u2019ve got to expect that the court will take action against it. Whether a million people voted in the referendum or 1,000,006 voted in the referendum is not the issue. The issue is, did you follow the rules?\u201d<\/p>\n<p>Frankly, he suspects, \u201cIn their heart of hearts, deep down, when they\u2019re not playing politics, I think even the Democrats know that they were pushing the envelope and trying to get by with one quickly. They thought the referendum would basically cow the court into doing it. And I give the court credit for having the fortitude to recognize that they\u2019re going to irritate the legislature, which appoints them.\u201d<\/p>\n<p>Yet, at the end of the day, \u201cThe court did its job. It was tough for them to do it. Some of them are likely not to be reappointed by the legislature because of it. But they did the right thing anyway. And I just have great respect for the Virginia Supreme Court for doing the right thing.\u201d<\/p>\n<p>Meanwhile, the setback on the Democratic map is a huge blow heading into November, Axios <a href=\"https:\/\/www.axios.com\/2026\/05\/08\/virginia-supreme-court-redistricting-democrats\">admits<\/a>. While a lot of pundits have been crowing that the GOP is on the verge of a midterm bloodbath, the reality is that this is \u201ca huge boost to Republicans\u2019 chances of keeping the House,\u201d the outlet notes. \u201cEven some Democrats now concede that they basically need to run the table in November.\u201d<\/p>\n<p>It also drives home just how much work the Left has to do in agenda-setting. They can\u2019t rely on anti-Trump sentiment carrying the day, as one anonymous House Democrat conceded. \u201c[We] cannot take a midterm victory for granted,\u201d the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-lawmakers-to-watch-as-johnson-tries-to-pass-fisa-extension\/\" title=\"... lawmakers to watch as Johnson tries to pass FISA extension\">member told reporters<\/a>. \u201cRelying too much on the administration\u2019s unpopularity and not enough of their own positive agenda could put an otherwise sure victory at risk.\u201d<\/p>\n<p>With the 10-1 edge in Virginia off the table, Democrats will struggle to make up a lot of ground in the redistricting arms race that has launched in earnest in the South after the U.S. Supreme Court\u2019s rollback of racial gerrymandering. As Punchbowl News <a href=\"https:\/\/punchbowl.news\/article\/house\/dems-redistrict-fight\/\">warns<\/a> the Left, \u201cAs many as 10 seats could now swing toward Republicans in a worst-case scenario for Democrats,\u201d while adding, \u201cthis all remains very fluid.\u201d<\/p>\n<p>Already, <a href=\"https:\/\/www.nbcnews.com\/politics\/2026-election\/alabama-takes-step-new-congressional-map-awaiting-court-action-rcna344220\">Alabama<\/a>, <a href=\"https:\/\/gov.louisiana.gov\/news\/5093\">Louisiana<\/a>, <a href=\"https:\/\/abcnews4.com\/news\/local\/sc-house-panel-approves-2-month-delay-in-congressional-primary-amid-redistricting-push\">South Carolina<\/a>, and <a href=\"https:\/\/www.dailysignal.com\/2026\/05\/08\/republican-redistricting-war-heats-up-in-mississippi\/\">Mississippi<\/a> have rocketed out of the gates to redraw their maps after the justices\u2019 ruling in Louisiana v. Callais \u2014 some states even postponing their primary elections to make sure they get their new districts approved first.<\/p>\n<p>The governors of one of those states, Louisiana\u2019s Jeff Landry (R), <a href=\"https:\/\/thisweekoncapitolhill.com\/gop-primary-victories-bolster-hopes-for-midterms\">agreed<\/a> it was about time that the stranglehold of the Voting Rights Act was loosened. \u201cI think that the Supreme Court has finally helped untangle Louisiana and many states, especially across the South, [from] a nasty wave of litigation that\u2019s been going on since the 90s. \u2026 Louisiana has been engaged in 27 federal lawsuits since the 1990s, which has basically taken away the legislature\u2019s power to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nh-dem-blasts-pelosi-voting-reform-bill\/\" title=\"NH Dem Blasts Pelosi Voting Reform Bill\">draw congressional districts<\/a>.\u201d No longer, he continued, can Democrats \u201cblame the Civil Rights Act for losing elections. That\u2019s the bottom line.\u201d<\/p>\n<p>Finally, Landry told Family Research Council President Tony Perkins, \u201cThe Supreme Court has instilled fairness and cemented the rule of law in our election process and the way we draw districts in the United States for the U.S. House of Representatives.\u201d<\/p>\n<p>Fellow Louisianan Mike Johnson echoed that sentiment, pointing to a GOP pick-up of at least eight to 10 seats. \u201cIt depends on how many states get in on this,\u201d he <a href=\"https:\/\/thisweekoncapitolhill.com\/gop-primary-victories-bolster-hopes-for-midterms\">stressed<\/a> to Perkins. \u201cAnd this trend was long overdue. I mean, for years, we argued \u2026 that the common sense reading of the Constitution says you cannot use race as a determining factor [to draw districts]. You can\u2019t discriminate against voters of any skin color. And that\u2019s what the previous regime, the previous kind of rules, had done. So the Supreme Court has finally set that right. And you see a number of states jumping in to correct that.\u201d<\/p>\n<p>In Tennessee, mayhem broke out on the floor of the state House when the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-jersey-democrats-pass-bill-requiring-database-of-handgun-ammo-purchasers\/\" title=\"New Jersey Democrats Pass Bill Requiring Database of Handgun Ammo Purchasers\">general assembly passed<\/a> a map that turned all nine of the congressional districts red. Governor Bill Lee (R) called lawmakers back into a special session after the Supreme Court\u2019s ruling in Callais to right what many see as a long-time wrong. The state\u2019s House speaker, Cameron Sexton, defended the move on \u201c<a href=\"https:\/\/youtu.be\/nDo9spmr4Mw\">Washington Watch<\/a>,\u201d calling out the \u201caggressive, vile protestors\u201d and Democratic caucus for creating chaos in the Capitol. \u201cWe\u2019ve gone through that before,\u201d he shrugged. \u201cWe powered through it. We passed it out, and now it\u2019s law.\u201d If the other side sues, Sexton isn\u2019t worried. \u201cWe\u2019re prepared. I feel comfortable that we\u2019re going to win it in the long term, and then the maps will be upheld at some point.\u201d<\/p>\n<p>Ultimately, the entire landscape is changing, David Wasserman, senior editor and elections analyst for the Cook Political Report, <a href=\"https:\/\/www.youtube.com\/watch?v=cgiT2_kZnCg\">underscored<\/a> to \u201cWashington Watch\u201d guest host Jody Hice. \u201cKeep in mind that by 2029, we could see states across the Deep South sending zero Democrats or black representatives to Congress from states that have some of the highest black populations in the country. This is going to have the effect of eradicating Democrats from red states, and blue states eradicating Republicans from their delegations.\u201d Places like Illinois could pass a map, he warned, with 17 Democrats and zero Republicans by drawing downstate of Chicago. \u201cSame thing in California. Democrats could draw [a] 52-to-0 map. And so, this is further polarizing Congress.\u201d<\/p>\n<p>At the end of the day, he explained, \u201cWhat it means is that the battle for control of the House is going to come down to a small group of states with neutral maps that were installed by courts or commissions. And that\u2019s why the bulk of the toss-ups in our chart right now are in Arizona, Michigan, Pennsylvania, [and] Iowa \u2014 states where neither party dominates this process.\u201d<\/p>\n<p>And that\u2019s just fine with most Americans, whose biggest concern is a fair and level playing field. \u201cWe [need] maps that accurately reflect the population of [our] states,\u201d Johnson <a href=\"https:\/\/thisweekoncapitolhill.com\/supreme-court-bombshell-rocks-midterms\">insisted<\/a> to Perkins. \u201cAnd this is the genius of the Founders, how they set up the three branches of the federal government for checks and balances. And you can\u2019t allow political issues to be the main driving factor in making sure that people are fairly represented in their states,\u201d he argued. \u201cThe court has to look at this objectively. They have to evaluate these ideas on the basis of the Constitution.
