The FDA\u2019s decision undid restrictions mandating in-person screening before and after dispensing the pill.<\/p>\n<p>Louisiana Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/author\/liz-murrill\/\">Liz Murrill <\/a>argued in the case that the FDA\u2019s removal of the in-person requirement harmed her state, along with the other 12 states that have outlawed elective abortion following the overturning of <em>Roe v. Wade.<\/em><\/p>\n<p>Abortion policy experts estimate that the slight increase in the number of abortions each year in the United States, reaching <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4501520\/abortions-increased-2025-guttmacher-institute-data\/\">1.1 million last year<\/a>, is largely due to online abortion sales, including in the states that have banned elective abortions. <\/p>\n<p>Mifepristone is used in roughly two-thirds of all abortions in the U.S. A report last year from the anti-abortion <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/3393359\/severe-abortion-pill-complications-higher-fda-discloses-study\/\">Ethics and Public Policy Center<\/a> that examined insurance claims data found that nearly 11% of women who undergo mifepristone abortions require medical care for complications.<\/p>\n<p>The 5th Circuit sided with Louisiana, acknowledging that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/after-insane-ivermectin-freakout-left-pushes-actual-horse-meds-for-diy-chemical-abortions\/\" title=\"After Insane Ivermectin Freakout, Left Pushes Actual Horse Meds For DIY Chemical Abortions\">emergency room visits due<\/a> to complications from at-home abortions significantly contribute to the state\u2019s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/medicaid\/\">Medicaid budget<\/a>, which covers health expenses for low-income residents.<\/p>\n<p>The 5th Circuit opinion, written by Trump-nominated Judge Stuart Kyle Duncan, agreed with Louisiana and said the state has \u201csuffering irreparable harm\u201d because being able to obtain the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >pills online effectively nullifies state law prohibiting elective abortion<\/a>.<\/p>\n<p>Alito issued his temporary pause on the 5th Circuit opinion last week after the two pharmaceutical companies that make mifepristone, Danco Laboratories and GenBioPro, filed emergency petitions with the Supreme Court.<\/p>\n<p>The pharmaceutical companies argued that the appeals court ruling \u201cinjects immediate confusion and upheaval into highly time-sensitive medical decisions.\u201d<\/p>\n<p>The Supreme Court\u2019s decision is likely complicated by the precedent the justices set last year regarding universal injunctions,\u00a0 in which judges at lower courts block federal policies for everyone rather than just the plaintiffs involved in the case.<\/p>\n<p>Last year, the high court ruled in the case <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3455997\/supreme-court-nationwide-injunctions-trump-birthright-citizenship-case\/\"><em>Trump v. Casa<\/em><\/a>  that federal district and circuit courts do not have the constitutional authority to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-republicans-must-resist-bidens-judicial-nominees\/\" title=\"Senate Republicans Must Resist Biden&#039;s Judicial Nominees\">issue nationwide injunctions<\/a>.<\/p>\n<p>The Supreme Court in 2024 upheld the FDA\u2019s regulations allowing mifepristone to be prescribed online, unanimously ruling that the doctor\u2019s group that sued the FDA, the Alliance for Hippocratic Medicine, did not have proper standing to file the legal challenge in the first instance.<\/p>\n<p>But during oral arguments in the 2024 case, conservative justices appeared sympathetic to the arguments from the doctor group, signaling that Louisiana\u2019s case against the Trump administration might have a chance if the full case is argued before the Supreme Court next term.<\/p>\n<p>The Trump administration, through the Justice Department, has remained silent during the legal proceedings thus far, not filing briefs or making statements in support of the FDA\u2019s 2023 decision.<\/p>\n<p>Social conservatives in Congress have increasingly put pressure on the Trump administration and FDA Commissioner Marty Makary to reinstitute in-person screening requirements for mifepristone.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4557387\/fda-chief-marty-makary-fire-multiple-directions\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4557387\/fda-chief-marty-makary-fire-multiple-directions\/\">FDA CHIEF MARTY MAKARY UNDER FIRE FROM MULTIPLE DIRECTIONS<\/a><\/strong><\/p>\n<p>Makary and Health and Human Services Secretary Robert F.
