A conservative group, the Heritage Foundation, sued under the Freedom of Information act to obtain the recordings, and a federal status report in March District Court set deadlines for Biden\u2019s team to act. The Justice Department says that if Biden does not intervene by may 12, the government will disclose the material shortly afterward; otherwise, it will release it on June 15.  <\/p>\n<p>The Justice Department indicated it intends to provide both audio recordings and written transcripts to the House Judiciary Committee and the plaintiffs. If President Biden does not seek to intervene on or before May 12, the Department will disclose the material shortly thereafter. Otherwise, the Department will disclose the material on June 15.\u201d<\/p>\n<p>The document went on to state that the DOJ intends to release \u201cthe written transcript\u201d and audio recordings, \u201cpursuant to a request from the Chair of the House Judiciary Committee, as well as to Plaintiffs.\u201d<\/p>\n<p>Biden spokesman TJ Ducklo claimed the case is about \u201cpolitics\u201d rather than \u201ctransparency,\u201d adding, \u201cThe DOJ themselves have said these tapes serve no public interest.\u201d<\/p>\n<p>President of Heritage\u2019s Oversight Project One, Mike Howell, who is also one of the plaintiffs in the case, begged to differ.<\/p>\n<p>\u201cThese tapes will further prove the massive lie regarding Biden\u2019s fitness for office and the fact Biden revealed classified information,\u201d he told Politico.<\/p>\n<p>And he included a stab at Biden\u2019s notorious <a href=\"https:\/\/www.westernjournal.com\/president-trump-declares-biden-autopen-documents-hereby-terminated\/\" target=\"_blank\" rel=\"noopener\">use of an autopen<\/a> to sign crucial documents during his presidency:<\/p>\n<p>\u201cThe shenanigans aren\u2019t over: At the last possible second, and after every delay tactic possible, the autopen is objecting to the American People receiving transparency.\u201d<\/p>\n<p>Biden has maintained that he never d classified info with \u201c<a href=\"https:\/\/www.amazon.com\/Promise-Me-Dad-Hardship-Purpose\/dp\/1250171679\" target=\"_blank\" rel=\"noopener\">Promise Me, Dad<\/a>\u201d ghostwriter Marc Zwonitzer.<\/p>\n<p>Zwonitzer initially attempted to <a href=\"https:\/\/www.congress.gov\/118\/meeting\/house\/117488\/documents\/HMKP-118-JU00-20240627-SD004.pdf\" target=\"_blank\" rel=\"noopener\">delete<\/a> the recordings, but investigators were able to restore them.<\/p>\n<p>The audio recordings in question were obtained by special counsel Robert Hur, who was appointed by former Attorney General Merrick Garland back in 2023.<\/p>\n<p>Hur was tasked with determining if Biden had mishandled classified materials that were in his Delaware home and former office following his tenure as vice president.<\/p>\n<p>Hur\u2019s February 2024 report <a href=\"https:\/\/www.westernjournal.com\/watch-priceless-look-hurs-face-finally-admits-biden-lied\/\" target=\"_blank\" rel=\"noopener\">didn\u2019t recommend criminal charges<\/a>, despite finding that Biden \u201cwillfully retained classified materials after the end of his vice presidency when he was a private citizen.\u201d<\/p>\n<p>The former special counsel told the House Judiciary Committee in 2024 that, \u201cIt would be difficult to convince a jury that they should convict him \u2014 by then a former president well into his eighties \u2014 of a serious felony that requires a mental state of willfulness.\u201d<\/p>\n<p>Axios <a href=\"https:\/\/www.axios.com\/2026\/05\/10\/biden-justice-department-ghostwriter-tapes-classified-docs\" target=\"_blank\" rel=\"noopener\">reported<\/a> on the story as well and highlighted how Hur discovered that Biden read journal entries containing classified information \u201cnearly verbatim,\u201d at least three times.<\/p>\n<p>The article also stated that the recordings \u201ccapture the former president telling Zwonitzer: \u2018I just found all the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-makes-address-after-counsel-report-defends-memory-but-confuses-presidents\/\" title=\"Biden Addresses ... ..., Defends Memory Amid Presidential Confusion\">classified stuff downstairs<\/a>.&#8217;\u201d<\/p>\n<p>This is an especially hot topic, given that Biden\u2019s Justice Department <a href=\"https:\/\/www.westernjournal.com\/bombshell-fbi-official-testifies-mar-lago-raid-lists-massive-concerns-search\/\" target=\"_blank\" rel=\"noopener\">raided<\/a> President Donald Trump\u2019s Mar-a-Lago estate in 2022, accusing him of the very same crimes.<\/p>\n<p>Shortly thereafter, Trump accused Hur of being hypocritical in a  post, <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111425807235011029\" target=\"_blank\" rel=\"noopener\">writing<\/a>: \u201cWOW!
