After the Virginia supreme Court (4-3) ruled that the Democrat-controlled General Assembly violated the state constitution by sidestepping required procedures to place a redistricting amendment on the April ballot, Democrats are discussing alternative strategies.<\/p>\n<p>One idea, described by The New York Times as audacious and possibly unlikely, would involve \u201ccourt packing\u201d at the state level. According to the report, a proposed legislative change would lower the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/its-time-to-end-the-d-c-gerontocracy\/\" title=\"It\u2019s Time to End the D.C. Gerontocracy\">mandatory retirement age<\/a> for Virginia Supreme Court justices from 75 to as young as 54 (the age of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/developing-virginia-dems-plotting-overthrow-of-entire-state-supreme-court-to-save-redistricting-scheme\/\" title=\"Developing: Virginia Dems Plotting Overthrow of Entire State ... to Save Redistricting Scheme\">youngest current justice<\/a>). Because the General Assembly can appoint justices, the plan would enable Democrats to replace the entire court with judges aligned with their agenda.<\/p>\n<p>The article uses this reported proposal to argue that Democrats\u2019 broader willingness to manipulate courts extends to federal politics as well. It points to revived calls-after Supreme Court decisions limited states\u2019 ability to use race-based gerrymandering-for adding seats or otherwise restructuring the U.S. Supreme Court, emphasizing remarks by House Democratic leader Hakeem Jeffries that \u201ceverything is on the table.\u201d  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>If at first you don\u2019t succeed, throw out the rules and rig the game in your favor.<\/p>\n<p>That\u2019s the strategy Democrats are looking to embrace after the Virginia Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/05\/08\/virginia-supreme-court-strikes-down-democrat-gerrymander\/\" target=\"_blank\" rel=\"noreferrer noopener\">slapped down<\/a> their illegal efforts to gerrymander the commonwealth in their favor ahead of the 2026 midterms. The state\u2019s <a href=\"https:\/\/amzn.to\/3YuVZYV\" ><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hollywood-celebs-rage-in-defeat-after-barrett-confirmation-revolting-disgraceful-unconscionable\/\" title=\"Hollywood Celebs R... in Defeat After Barrett Confirmation: &#039;Revolting. Disgraceful. Unconscionable&#039;\">high court<\/a> found<\/a> (4-3) that the Democrat-run General Assembly violated the Virginia Constitution by bypassing procedural requirements necessary for the redistricting amendment to appear on the state\u2019s April ballot. <\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/05\/09\/virginias-pro-gerrymander-dems-argued-election-is-single-day-after-forcing-45-day-vote\/\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia\u2019s Pro-Gerrymander Dems Argued Election Is Single Day After Forcing 45-Day Vote<\/a>]<\/strong><\/p>\n<p>Not content with accepting defeat, Democrats are exploring ways to resurrect their failed gerrymandering gambit ahead of the 2026 elections, The New York Times <a href=\"https:\/\/www.nytimes.com\/2026\/05\/10\/us\/politics\/democrats-virginia-plans-gerrymandering.html\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> over the weekend. Democrats\u2019 brainstorming session included one \u201caudacious\u201d and \u201cpossibly far-fetched\u201d idea that involves packing the Virginia Supreme Court with new Democrat appointees. Floated on a purported phone call between U.S. House Minority Leader Hakeem Jeffries, D-N.Y., and Virginia Democrat House leaders, the proposal involves the Virginia General Assembly and Democrat Gov. Abigail Spanberger approving legislation that would lower the retirement age for state Supreme Court justices.<\/p>\n<p>According to the Times, after undertaking a series of legal actions that seek to tee up the redistricting amendment for additional court review, the state legislature would then pass a bill \u201clowering the mandatory retirement age for Virginia\u2019s Supreme Court from 75 to 54, the age of the youngest current justice, or less.\u201d Given that the General Assembly possesses the power to appoint justices to the state\u2019s high court, this means that Democrats would be able to replace every single justice currently serving on the Virginia Supreme Court \u201cwith sympathetic Democratic lawyers.\u201d<\/p>\n<p>While unlikely to advance in time to have any effect on the 2026 midterms, the radical plan, as reported by the Times, indicates how far Democrats are willing to go in the name of power. More to the point, however, it\u2019s also an omen for what their party plans to do to the U.S. Supreme Court should they retake trifecta control of the federal government.<\/p>\n<p>Democrats have not been shy about their vociferous support for packing SCOTUS with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kamala-harris-condemns-d-c-demonstrators-despite-past-encouragement-of-violent-blm-mobs\/\" title=\"Kamala Harris condemns D.C. demonstrators despite past encour...ment of violent BLM mobs\">left-wing activists<\/a> whose primary objective would be ruling on issues in their favor. <\/p>\n<p>While <a href=\"https:\/\/thefederalist.com\/2026\/04\/07\/unraveling-the-far-left-group-seeking-to-derail-future-republican-scotus-nominees\/\" target=\"_blank\" rel=\"noreferrer noopener\">prominent<\/a> during Joe Biden\u2019s presidency, leftist calls to pack the court recently <a href=\"https:\/\/thefederalist.com\/2026\/05\/01\/dems-revive-court-packing-threats-after-being-told-they-cant-do-racist-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">resurfaced<\/a> after the justices released their <em>Louisiana v. Callais<\/em> decision <a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">crippling<\/a> states\u2019 ability to engage in racial gerrymandering. Among those to telegraph support for the policy was Jeffries, who said that \u201ceverything is on the table\u201d should he win the speaker\u2019s gavel after the 2026 contests. <\/p>\n<p>\u201cThe Supreme Court is a disgrace. And then, in the new Congress, we\u2019re gonna have to do something about the Supreme Court,\u201d Jeffries said. \u201cAnd let me be very clear: Everything is on the table \u2014 everything \u2014 to deal with this corrupt MAGA majority that is issuing political opinions that are designed to bolster the prospects of the Republican Party. And we will not allow them to succeed.\u201d<\/p>\n<p>In her new bestselling book, <em><a href=\"https:\/\/www.barnesandnoble.com\/w\/alito-mollie-hemingway\/1147952913\" target=\"_blank\" rel=\"noreferrer noopener\">Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution<\/a><\/em>, Federalist-Editor-In-Chief Mollie Hemingway traces Democrats\u2019 open embrace of court-packing back to how the high court previously served as the left\u2019s vehicle for sidestepping the traditional amendment process. She notes how, dating back to years of Chief Justice Earl Warren, SCOTUS \u201chad functioned as a super-legislature, enacting the Left\u2019s policies by a majority vote of justices, no matter what the Constitution said.\u201d<\/p>\n<p>\u201cThe Left had come to view the Court as its rightful property and would not cede control willingly,\u201d Hemingway writes. <\/p>\n<p>With the Supreme Court now no longer available as an avenue of power, the left has set its sights on destroying the last functioning institution in America by any means necessary.
