Josh Stein securing early release for an untold number of criminals when he was still the state\u2019s attorney general.<\/p>\n<p>Former Democratic Gov. Roy Cooper drew criticism since 2021 for the COVID-19-inspired inmate releases that Stein\u2019s office negotiated. Stein\u2019s office played a crucial role by capitulating to leftist criminal reform groups who <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/05\/Complaint-NAACP-v.-Cooper-Wake-Co.-Sup.-Ct.-April-20-2020_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">sued in 2020<\/a> over the pandemic\u2019s effect on prisons, but he skated to the governor\u2019s mansion in the <a href=\"https:\/\/ballotpedia.org\/Josh_Stein\" target=\"_blank\" rel=\"noopener noreferrer\">2024 elections<\/a> without enduring as much controversy.<\/p>\n<p>The list of inmates getting released included at least <a href=\"https:\/\/amzn.to\/3YuVZYV\" >51 parole-eligible criminals serving life sentences<\/a> for murder and sex offenses, <a href=\"https:\/\/www.charlotteobserver.com\/news\/politics-government\/article314664852.html\" target=\"_blank\" rel=\"noopener noreferrer\">The Charlotte Observer reported<\/a>. State officials under Cooper and Stein chose 3,500 inmates to release six months after the settlement, though they have\u00a0been unclear about <a href=\"https:\/\/www.wral.com\/story\/waters-muddied-on-early-release-after-lawmakers-told-only-non-violent-offenders-included\/19553809\/\" target=\"_blank\" rel=\"noopener noreferrer\">whose sentences<\/a> the settlement actually shortened versus those who were slated for release regardless of the lawsuit.<\/p>\n<p>Cooper and Stein\u2019s list captured <a href=\"https:\/\/dailycaller.com\/2025\/09\/09\/democrat-da-pushed-racial-equity-as-crime-spiked-before-horrific-train-stabbing\/\" target=\"_blank\" rel=\"noopener noreferrer\">national attention<\/a> after surveillance footage was released in September that showed a man \u2014 identified as <a href=\"https:\/\/dailycaller.com\/2025\/09\/09\/doj-pledges-harsh-penalties-for-charlotte-stabbing-suspect\/\" target=\"_blank\" rel=\"noopener noreferrer\">repeat arrestee<\/a> Decarlos Brown Jr. \u2014 <a href=\"https:\/\/dailycaller.com\/2025\/09\/09\/bystanders-tried-to-help-charlotte-stabbing-victim-in-her-dying-moments\/\" target=\"_blank\" rel=\"noopener noreferrer\">fatally stabbing<\/a> 23-year-old <a href=\"https:\/\/www.westernjournal.com\/trump-hits-dems-refusing-acknowledge-grieving-mother-iryna-zarutska-killed-policies\/\" target=\"_blank\" rel=\"noopener\">Iryna Zarutska<\/a> on a Charlotte train. The state included Brown on its list of 3,500 releases before his latest arrest, but later <a href=\"https:\/\/www.wsoctv.com\/news\/local\/man-charged-fatal-light-rail-stabbing-was-early-release-list-during-covid\/IRQQZ3PUEVA55HNBSNORABUP6M\/\" target=\"_blank\" rel=\"noopener noreferrer\">claimed<\/a> that his armed robbery sentence was set to end anyway, meaning he was not released early.<\/p>\n<p>An upcoming GOP-led investigation could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-lawyer-lights-up-bong-while-first-son-is-over-for-a-visit-report\/\" title=\"Report: Hunter Biden&#039;s lawyer allegedly smokes bong during visit with First Son.\">bring unwanted attention<\/a> on the COVID settlement for the <a href=\"https:\/\/www.multistate.us\/insider\/2025\/4\/22\/heres-what-america-thinks-of-its-governors-governors-ranked-by-approval-rating\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.multistate.us\/insider\/2025\/4\/22\/heres-what-america-thinks-of-its-governors-governors-ranked-by-approval-rating&#038;source=gmail&#038;ust=1778334851895000&#038;usg=AOvVaw3j4KVRs_TqdLMoDYa0fStl\">governor,<\/a> whom <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/01\/25\/2028-democrats-whitmer-shapiro-harris-buttigieg\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.washingtonpost.com\/politics\/2025\/01\/25\/2028-democrats-whitmer-shapiro-harris-buttigieg\/&#038;source=gmail&#038;ust=1778334851895000&#038;usg=AOvVaw21hzum_rhIxont295rsE1S\">The Washington Post<\/a> called \u201cthe brightest star\u201d among current Democratic governors who are considered potential contenders for the party\u2019s presidential nomination 2028.<\/p>\n<p>\u201cThis was a lawsuit brought on by Roy Cooper and Josh Stein\u2019s far-left allies, and it was settled in a way that shielded the public from knowing the true extent of its impact,\u201d a representative of Republican North Carolina state Sen. Phil Berger told the Daily Caller News Foundation. Berger is co-leading a new legislative commission tasked with investigating the settlement.<\/p>\n<p>\u201cThe Stein administration is just as responsible\u201d for the criminals\u2019 releases as Cooper, the representative said.<\/p>\n<p>Stein\u2019s office did not respond to the DCNF\u2019s requests for comment. A Cooper spokesperson previously <a href=\"https:\/\/www.newsobserver.com\/news\/politics-government\/article315471038.html\" target=\"_blank\" rel=\"noopener noreferrer\">told a local paper<\/a> that his administration used similar standards as President Donald Trump when he released some federal prisoners over COVID in 2020, a move Trump reversed before his first term ended, according to <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/doj-says-prisoners-released-home-confinement-because-covid-can-stay-n1286406\" target=\"_blank\" rel=\"noopener noreferrer\">NBC News<\/a>. The president\u2019s policy allowed <a href=\"https:\/\/www.bop.gov\/news\/20200405_covid19_home_confinement.jsp\" target=\"_blank\" rel=\"noopener noreferrer\">home confinement<\/a> for some inmates after <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/05\/20200405_covid-19_home_confinement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">factoring in<\/a> health risk from the virus and their crimes\u2019 severity.<\/p>\n<p>Both sides of the North Carolina lawsuit are required not to disclose the details of discussions that led to their settlement, American Civil Liberties Union attorney Kristi Graunke and Forward Justice attorney Whitley Carpenter told the DCNF. The two women litigated the case, along with lawyers from left-leaning groups Disability Rights North Carolina, National Youth Justice Network and Emancipate NC.<\/p>\n<p>\u201cI am not aware of anyone on plaintiffs\u2019 legal team having direct, personal communications with then-AG Stein,\u201d Graunke said. Carpenter confirmed the team had \u201cno direct interactions with\u201d him.<\/p>\n<p>\u201cThe resulting agreement focused on protecting the health and safety of the people inside our state prisons, including population reductions to enable social distancing, [protective equipment] distribution, non-punitive isolation for sick individuals, and proper testing protocols,\u201d Carpenter told the DCNF.<\/p>\n<p>Stein has gone long enough without having to answer for the deal, Berger\u2019s office said.<\/p>\n<p>\u201cIt\u2019s clear the North Carolina-based press corps doesn\u2019t want to jeopardize its access to both Gov. Stein and Roy Cooper by asking them real questions about why they released thousands of criminals and hid their identities through legal smoke screens,\u201d his representative told the DCNF. \u201cThere were violent, repeat offenders on the secret settlement list and Republicans in the General Assembly are going to get to the bottom of why the public was largely kept in the dark about who was released and why.\u201d<\/p>\n<h3>\u2018Cruel Or Unusual Punishment\u2019?<\/h3>\n<p>The 2020 lawsuit filed on the NAACP\u2019s behalf accused the state of \u201ccruel or unusual punishment\u201d for holding convicts during the coronavirus pandemic. State data showed that about 99% of COVID victims in North Carolina were surviving the virus, <a href=\"https:\/\/www.wcnc.com\/article\/news\/verify\/verify-covid-19-survivability-rate\/275-a4cda9a3-4a33-49f2-8977-6d2b5265d8a8\" target=\"_blank\" rel=\"noopener noreferrer\">WCNC Charlotte reported<\/a> in May 2021.<\/p>\n<p><a href=\"https:\/\/emancipatenc.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Emancipate NC<\/a>, <a href=\"https:\/\/forwardjustice.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Forward Justice<\/a> and <a href=\"https:\/\/nyjn.org\/about-us\/\" target=\"_blank\" rel=\"noopener noreferrer\">NYJN<\/a> \u2014 formerly National Juvenile Justice Network \u2014 explicitly center their activism around reducing supposedly racist incarceration and seized on the coronavirus as an opportunity for change.<\/p>\n<p>\u201cPrison is state-sponsored violence. We are all complicit in its harms,\u201d Emancipate NC\u2019s website says. \u201cAs an organization, we are dedicated to shifting the narrative on racialized mass incarceration through community education and mobilization. The mainstream narrative that criminalizes Black and Brown people must be transformed \u2014 so that we can all get free.\u201d<\/p>\n<p>Emancipate NC has received funding from leftist advocacy giants such as the George Soros-backed <a href=\"https:\/\/www.influencewatch.org\/non-profit\/vera-institute-of-justice-vij\/\" target=\"_blank\" rel=\"noopener noreferrer\">Vera Institute of Justice<\/a>, the Tides network and Black Lives Matter, according to its <a href=\"https:\/\/emancipatenc.org\/our-funders\/\" target=\"_blank\" rel=\"noopener noreferrer\">website<\/a>.<\/p>\n<p>The 2020 lawsuit also framed COVID\u2019s threat to inmates in racial terms, saying black people \u201cwill disproportionately bear the devastation\u201d because they make up 52 percent of the state\u2019s prisoners.<\/p>\n<p>\u201cThe data collected thus far shows that African Americans in the general population have been disproportionately impacted by this pandemic,\u201d the filing says, citing an article by <a href=\"https:\/\/dailycaller.com\/2025\/01\/31\/ibram-x-kendi-race-studies-center-howard-university\/\" target=\"_blank\" rel=\"noopener noreferrer\">race scholar Ibram Kendi<\/a> and other sources.<\/p>\n<p>Attorneys or representatives for Disability Rights North Carolina, NYJN and Emancipate NC did not respond to the DCNF\u2019s requests for comment. The attorney general\u2019s office under Stein <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/05\/2021.02.25_20cvs500110_joint_motion_for_stay_w_att.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">settled with the activists<\/a> in February 2021 after a <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/05\/20_cvs_500110_order_on_pi_with_cos.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">local judge ruled<\/a> they would likely win if the case proceeded, court records show.<\/p>\n<p>The three outcomes the deal authorized for inmates were full release, transfer outside a prison while under supervision and receiving \u201cpost-release supervision sooner than they would otherwise have,\u201d the 2021 settlement states. State officials told lawmakers in March 2021 that some violent offenders would be released under the plan, correcting previous statements that sparked confusion, <a href=\"https:\/\/www.wral.com\/story\/prison-official-apologizes-for-confusion-over-early-release-lawsuit-settlement\/19566093\/\" target=\"_blank\" rel=\"noopener noreferrer\">WRAL News reported<\/a>. The <a href=\"https:\/\/www.acluofnorthcarolina.org\/news\/prisonsettlement\/\" target=\"_blank\" rel=\"noopener noreferrer\">ACLU celebrated<\/a> the agreement as one of \u201cthe largest prison releases in the country achieved via COVID-19 litigation efforts.\u201d<\/p>\n<p>Stein has\u00a0advocated for lenient public safety stances as governor, though the GOP-controlled state legislature forces his hand on some issues. He announced in March that he was expanding diversion programs that provide \u201calternatives to punitive action for addressing low-level, non-violent crimes that typically involve substance use issues,\u201d according to <a href=\"https:\/\/governor.nc.gov\/news\/press-releases\/2026\/03\/24\/governor-stein-ncdhhs-and-nc-harm-reduction-coalition-announce-15-million-expansion-law-enforcement\" target=\"_blank\" rel=\"noopener noreferrer\">his office<\/a>. \u201cWe can\u2019t arrest our way out of addiction,\u201d Stein said. \u201cWe need treatment and recovery services so that people can get well, follow the law, and contribute to their communities.\u201d<\/p>\n<p>Stein <a href=\"https:\/\/dailycaller.com\/2025\/12\/01\/north-carolina-irynas-law-violent-crime-charlotte-stabbing-death-penalty\/\" target=\"_blank\" rel=\"noopener noreferrer\">signed a GOP-led bill<\/a> dubbed \u201cIryna\u2019s Law\u201d in October that implemented several tough-on-crime policies, though he <a href=\"https:\/\/www.instagram.com\/reels\/DPW4RG-lXyC\/\" target=\"_blank\" rel=\"noopener noreferrer\">called<\/a> its expansion of execution methods \u201cbarbaric\u201d and criticized its reliance on cash bail.<\/p>\n<p>\u201cI\u2019m troubled by its lack of ambition or vision,\u201d Stein said of the law. \u201cIt simply does not do enough to keep you safe.\u201d<\/p>\n<div class=\"disclaimer\">\n<p><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
