The court said Democrats did not follow required steps under the Virginia Constitution, finding no valid \u201cintervening election\u201d because early voting for the November 2025 race had already started when the amendment was first approved.<\/p>\n<p>If the referendum had stood, it would have flipped Virginia\u2019s congressional delegation from a 6-5 Democratic advantage to 10-1 in favor of Democrats heading into 2026, potentially adding four House seats. democrats, though, face a tough path at the U.S. supreme Court because the dispute is mainly about state constitutional procedure Appellants intend to file an Emergency Petition to the Supreme Court of the United States,\u201d the filing stated. Bush who oversees emergency petitions stemming from Virginia, will handle the request when it is filed and decide whether to refer the matter to the full court for consideration.<\/p>\n<div class=\"article-paywall\">\n<p>The notice to appeal came just hours after Virginia\u2019s high court ruled 4-3 that Democrats failed to comply with state constitutional procedures required to place the amendment before voters.
