Marvit-appointed by Joe Biden and confirmed in 2022-says he was dismissed on May 1 via an email with no stated reason, and that immediately after the notice his access to agency systems was cut off and his government phone was disabled. Trump, I am writing to inform you that your position as Federal Mine Safety and Health Review Commissioner is terminated, effective immediately. Thank you for your service.\u201d<\/p>\n<p>Court filings say that within minutes of receiving the email, Marvit lost access to all agency networks. Within an hour, his government-issued cellphone was placed into \u201clost phone mode,\u201d rendering it unusable. The filing also notes that the commission later announced layoffs affecting additional staff.<\/p>\n<p>The lawsuit argues Trump\u2019s removal of Marvit violated both federal law and multiple sections of the Constitution.<\/p>\n<p>\u201cThe Constitution empowers Congress to set reasonable limitations on the removal of the heads of independent agencies and it does not confer on the President an authority to violate Congress\u2019s scheme,\u201d the filing states.<\/p>\n<p>\u201cThe President\u2019s purported removal of the Commissioner Marvit violates the authorities vested in Congress by the Constitution and further violates the President\u2019s duty to \u2018take Care that the Laws be faithfully executed,\u2019\u201d it adds.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/state\/4556389\/gop-democrats-gerrymander-targets-supreme-court-ruling\/\"><strong>RED OR BLUE?
