We can have our disagreements, even on important points of principle and policy.<\/p>\n<p>Nonetheless, we should assume good faith debate and try not to talk past one another. This holds true especially in what we might call the \u201ccreed\u201d vs. \u201cculture\u201d debate.<\/p>\n<p>In a recent interview with the libertarian-minded Reason Magazine, conservative Supreme Court Justice Neil Gorsuch characterized the United States as a \u201ccreedal nation,\u201d rooted in the principles of the Declaration of Independence, thereby prompting outrage from some conservatives on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-new-acting-attorney-general-jeff-rosen-recently-wrote-an-essay-on-foreign-influence-in-us-elections-this-tells-us-a-little-about-his-knowledge-of-whats-going-on-today\/\" title=\"The New Acting Attorney General Jeff Rosen Recently Wrote an Essay on Foreign Influence in US Elections \u2013 This Tells Us A Little About His Knowledge of What\u2019s Going On Today\">social media platform<\/a> X, including one former advisor to President Donald Trump, who worried about Gorsuch potentially \u201c\u2018prepping\u2019 us for an absurd Birthright Citizenship ruling.\u201d<\/p>\n<p>\u201cThe Declaration of Independence had three great ideas in it: that all of us are equal; that each of us has inalienable rights given to us by God, not government; and that we have the right to rule ourselves,\u201d Gorsuch said in a clip posted to X.<\/p>\n<p>Indeed, Thomas Jefferson penned those words \u2014 or at least a version of them \u2014 in 1776.<\/p>\n<p>\u201cWe hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. \u2014 That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,\u201d Jefferson wrote in the <a href=\"https:\/\/www.archives.gov\/founding-docs\/declaration-transcript\" target=\"_blank\" rel=\"noopener\">Declaration of Independence<\/a>.<\/p>\n<p>So far, so good. In fact, no American patriot could quarrel with Jefferson\u2019s words.<\/p>\n<p>What came next, however, got Gorsuch into trouble with some \u201cculture\u201d conservatives.<\/p>\n<p>\u201cOur nation is not founded on a religion,\u201d he added. \u201cIt\u2019s not based on a common culture even, or heritage. After all, we can and must answer the first <em>two<\/em> questions in the affirmative. Having done so, we can still answer the third question in the negative.<\/p>\n<p>Alas, one senses that the third question \u2014 involving citizenship and illegal immigration \u2014 informs some conservatives\u2019 views of the first two questions. After all, if Biden supports the \u201ccreed\u201d side of the debate, then we should regard the \u201ccreed\u201d side with immediate suspicion.<\/p>\n<p>There is a problem, however. Namely, Biden does not actually believe in that creed. Can any observer of his administration honestly conclude that he believes in equality, natural rights, or consent of the governed? Biden oversaw the most <a href=\"https:\/\/www.westernjournal.com\/watch-tucker-carlson-takes-aim-wannabe-dictator-joe-biden-latest-twitter-show\/\" target=\"_blank\" rel=\"noopener\">tyrannical regime<\/a> in U.S. history. It was an evil they knew not well how to deal with, but the general opinion of the men of that day was that, somehow or other in the order of Providence, the institution would be evanescent and pass away. This idea, though not incorporated in the constitution, was the prevailing idea at that time.\u201d<\/p>\n<p>In other words, <a href=\"https:\/\/www.westernjournal.com\/vance-holds-jeffersons-madisons-view-freedom-religion-based-christianity-tells-tpusa-crowd\/\" target=\"_blank\" rel=\"noopener\">Jefferson<\/a> and his contemporaries recognized that slavery violated natural rights, part of Gorsuch\u2019s three-pronged creed.<\/p>\n<p>\u201cOur new government is founded upon exactly the opposite idea; its foundations are laid, its corner-stone rests, upon the great truth that the negro is not equal to the white man; that slavery subordination to the superior race is his natural and normal condition,\u201d Stephens added moments later.<\/p>\n<p>Confederates, according to the Confederacy\u2019s vice president, rejected the doctrines of equality and natural rights. Thus, Confederates had no choice but to renounce their U.S. citizenship. <em>That<\/em> is a profound consequence.<\/p>\n<p>Moreover, if culture and heritage alone dictate nationhood, then what do we make of Jefferson\u2019s many comments to the contrary?<\/p>\n<p>\u201c[I]n truth the ultimate point of rest &#038; happiness for them is to let our settlements and theirs meet and blend together, to intermix and become one people, incorporating themselves with us as citizens of the US,\u201d President Jefferson <a href=\"https:\/\/founders.archives.gov\/documents\/Jefferson\/01-39-02-0456\" target=\"_blank\" rel=\"noopener\">wrote<\/a> of the American Indians in 1803.<\/p>\n<p>Likewise, in his 1801 Annual Message to Congress, President Jefferson asked for a liberalization of naturalization laws.<\/p>\n<p>\u201c[S]hall we refuse the unhappy fugitives from distress that hospitality which the savages of the wilderness extended to our fathers arriving in this land? Shall oppressed humanity find no asylum on this globe?\u201d Jefferson <a href=\"https:\/\/avalon.law.yale.edu\/19th_century\/jeffmes1.asp\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p>Perhaps we might settle the matter with the following distinctions:<\/p>\n<p>A Frenchman may become an American, but an American may never become a Frenchman.
