The court said it should be allowed to consider the impact of the U.S.proceedings, including a superseding indictment that added Smartmatic as a defendant-an event the court viewed as unusual and unanticipated.<\/p>\n<p>The federal case involves allegations that Smartmatic and executives conspired to bribe foreign officials and launder money to win business in the Philippines, with further amendments drawing the appeals court\u2019s attention. Fox argues that any potential financial harm to Smartmatic may stem from its legal troubles rather then Fox\u2019s broadcasts about voter fraud.  <\/p>\n<p>Smartmatic initially sued Fox news in 2021 for $2.7 billion. A <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal grand jury returned<\/a> the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/usao-sdfl\/pr\/voting-machine-company-charged-philippine-bribery-and-money-laundering-scheme\" type=\"link\" id=\"https:\/\/www.justice.gov\/usao-sdfl\/pr\/voting-machine-company-charged-philippine-bribery-and-money-laundering-scheme\">superseding indictment<\/a>, which already charged three Smartmatic executives and a Filipino election official back in August 2024.<\/p>\n<p>The amended charging document was of interest to the appeals court, leading to its ruling in favor of Fox News.<\/p>\n<p>\u201cThe filing of the superseding indictment, which added Smartmatic as a defendant, was both an unusual and unanticipated circumstance, and defendants would be substantially prejudiced by the disallowance of discovery with respect to the impact of the superseding indictment,\u201d the order reads.<\/p>\n<p>Smartmatic\u2019s defamation lawsuit against Fox News stems from <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/voter-fraud\/\" type=\"post_tag\" id=\"1582\">voter fraud<\/a> allegations related to the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/2020-elections\/\" type=\"post_tag\" id=\"228\">2020 election<\/a> that the network spread on air.
