Medicaid Fraud Control Unit in Minnesota Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/Keith-Ellison\/\">Keith Ellison<\/a>\u2019s office, said his staff is \u201cdrowning in referrals.\u201d<\/p>\n<div class=\"article-paywall\">\n<p>Wanka <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.startribune.com\/were-all-drowning-fraud-allegations-swamp-investigators\/601786971\">told<\/a> the <em>Minnesota Star Tribune<\/em> that they will rely heavily on federal law enforcement to lead the investigative efforts, while state prosecutors serve in an ancillary support role providing \u201csome data analysis or other secondary help.\u201d<\/p>\n<p>\u201cIt\u2019s a volume issue,\u201d James Clark, inspector general of the Minnesota Department of Human Services, told the <em>Minnesota Star Tribune<\/em>.<\/p>\n<p>Clark said it may otherwise take years to sift through the growing backlog of fraud referrals, from the time a tip comes in to when charges are actually filed against alleged fraudsters.<\/p>\n<p>According to Minnesota DHS <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/mn.gov\/dhs\/program-integrity\/\">data<\/a>, the state agency referred 265 cases of Medicaid fraud for criminal prosecution in 2025, more than triple the previous year\u2019s referrals.<\/p>\n<p>This year, DHS has submitted 53 referrals as of March 6, appearing to be on track for a record-breaking year.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><figcaption class=\"wp-element-caption\">Annual referrals, based on credible allegations of Medicaid fraud, to prosecutors within the Minnesota Attorney (Minnesota Department of Human Services)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Minnesota Legislative Auditor Judy Randall said that her office, which audits state agencies and their taxpayer-funded programming, is also swamped with reports of fraud, waste, and abuse of public funds. Over the past year, the Minnesota Office of the Legislative Auditor received 765 reports, a significant increase from the 481 reports submitted the year prior.<\/p>\n<p>\u201cThe only way the state is going to get a handle on this is to prevent it from happening in the first place,\u201d Randall told the <em>Minnesota Star Tribune<\/em>. \u201cIn the short term, I think we\u2019re all drowning, and it\u2019s not sustainable.\u201d<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/state\/4546825\/walz-skips-oversight-hearing-fraud-prevention-probably-in-basement\/\"><strong>WALZ SKIPS STATE OVERSIGHT HEARING ON FRAUD PREVENTION: \u2018HE\u2019S PROBABLY IN THE BASEMENT\u2019<\/strong><\/a><\/p>\n<p>Minnesota state Rep. Kristin Robbins, the Republican chairwoman of the Minnesota House Fraud Prevention and State Agency Oversight Policy Committee, attributed the spike in tip-offs to the national spotlight on fraud and whistleblowers inspiring other witnesses to come forward.<\/p>\n<p>Robbins, however, sees the <em>Minnesota Star Tribune<\/em> article spotlighting the latest logjam of fraud referrals as a thinly veiled plea from state administrators for bigger budgets.<\/p>\n<p>\u201cI think it\u2019s a story they planted at the end of session to put pressure on the state legislature to give them more money,\u201d Robbins said in an interview with the <em>Washington Examiner<\/em>.<\/p>\n<p>The article comes as Minnesota\u2019s legislative session is set to close on May 18. Robbins suspects that these state agencies are trying to push through funding within the next two weeks by rallying public support behind additional allocations.<\/p>\n<p>But they have not earned the extra funds, Robbins said. \u201cUnless we\u2019re getting a return on our money, I don\u2019t know we should put more money into it,\u201d she said.<\/p>\n<p>Bill Glahn, a policy fellow at the Minnesota-based Center of the American Experiment, similarly <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.americanexperiment.org\/another-fraud-another-probation-sentence\/\">advocated<\/a> against \u201crewarding the very people whose inaction created the problem.\u201d<\/p>\n<p>In a piece for the think tank on the state spending requests, Glahn observed that the pileup of fraud cases was built year after year \u201cfrom looking the other way.\u201d<\/p>\n<p>Glahn said if state officials or their predecessors \u201chad taken the issue of fraud seriously at any point in the past decade, it would not have reached this crisis state.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-dhs-the-department-responsible-for-the-fraud-crisis-demands-more-state-funding\">DHS, the department responsible for the fraud crisis, demands more state funding<\/h2>\n<p>Clark, in his <em>Minnesota Star Tribune<\/em> interview, cited a lack of administrative and technological capacity for state investigators in DHS to handle all the cases themselves, claiming that they have not had a \u201ccorresponding increase\u201d in resources to match the influx of referrals on their own without <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-hospice-fraud-has-flourished-in-california\/\" title=\"How hospice ... has flourished in California\">advanced fraud-detection tools<\/a>.<\/p>\n<p>\u201cThere\u2019s not enough people in the world, right, to oversee $20 billion of [the state\u2019s yearly Medicaid] spending,\u201d Clark said. \u201cWe need to have modernized technology.\u201d<\/p>\n<p>As for addressing the delays in processing fraud claims, Clark said, \u201cThe answer is more resources. If folks want things to move faster, law enforcement definitely needs more resources, and [Minnesota DHS] needs more resources.\u201d <\/p>\n<p>This legislative session, Gov. Tim Walz (D-MN) has proposed <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4491949\/walz-state-takeover-medicaid-funds\/\">a multimillion-dollar plan<\/a> to, in part, update DHS\u2019s \u201cantiquated\u201d computer software.<\/p>\n<p>Walz\u2019s costly proposal would also place DHS, the state agency responsible for allowing Medicaid fraud to proliferate within its public assistance programs, in charge of locally administered Medicaid funds.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3904631\/walz-appointees-failed-to-stop-rampant-minnesota-fraud\/\"><strong>THESE ARE THE WALZ APPOINTEES WHO FAILED TO STOP RAMPANT MINNESOTA FRAUD<\/strong><\/a><\/p>\n<p>If passed, the state takeover would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/walz-proposes-state-takeover-of-medicaid-funds-as-fraud-solution\/\" title=\"... proposes ... takeover of ... funds as ... solution\">drastically shift oversight duties<\/a> from Minnesota counties onto DHS, cutting individual jurisdictions out of the beneficiary application process completely and replacing them with a state-managed vetting system.<\/p>\n<p>DHS, under Walz\u2019s framework, would solely determine who is eligible to enroll in Medicaid, instead of the state\u2019s 87 counties. Minnesota\u2019s healthcare benefits are supervised by the state but delivered at the local level.<\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/content.govdelivery.com\/attachments\/MNGOV\/2026\/03\/10\/file_attachments\/3578838\/mndhs-transform_Fact%20Sheet-tall%20%282%29.pdf\">sweeping changes<\/a> would also consolidate all Medicaid billing into a fee-for-service model through which the state directly pays providers for services rendered. Minnesota contracts with insurance companies, classified as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.medicaid.gov\/medicaid\/managed-care\">managed care organizations<\/a>, to pay out the majority of Medicaid claims billed to the state\u2019s safety net system.<\/p>\n<p>Walz argued that centralizing state control of Medicaid disbursements and enrollment would \u201cstreamline\u201d the system, supplanting the \u201ccomplex, layered\u201d patchwork of counties and private insurers with a single state-run entity.<\/p>\n<p>\u201cWe think this is a way of simplification,\u201d Walz said.<\/p>\n<p>The transition project is <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.fox9.com\/news\/mn-fraud-gov-walz-announcing-major-changes-department-human-services-watch-live\">projected to cost<\/a> $72 million to implement, including $17 million in the first fiscal period and another $55 million in the following budgetary cycle.<\/p>\n<p>Robbins said she would rather see significant reforms at DHS before lawmakers approve funding for any technological upgrades or payroll expansions.<\/p>\n<p>The state representative recalled that DHS had shut down its Criminal Investigations Unit early into Walz\u2019s first term. Now the agency only has the ability to cut off payments to providers and revoke licenses, while criminal investigations are referred to law enforcement.<\/p>\n<p>\u201cIf they\u2019re willing to reopen a criminal investigation unit and not just flag overpayments, I would consider it,\u201d Robbins told the <em>Washington Examiner<\/em>.<\/p>\n<p>In testimony in front of the state oversight committee last week, DHS leadership <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/kstp.com\/kstp-news\/top-news\/their-only-goal-was-to-destroy-the-unit-former-minnesota-fraud-investigator-speaks-out\/\">declared<\/a> that they would not want to reinstate the department\u2019s investigative arm.<\/p>\n<p>\u201cSo that\u2019s a hard no, unless they\u2019re willing to carry out the reforms we need to make sure we\u2019re actually getting justice and accountability,\u201d Robbins said.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-state-prosecutors-blame-backlog-on-small-staff-budget\">State prosecutors blame backlog on \u2018small\u2019 staff budget<\/h2>\n<p>Wanka, echoing Clark, said that state prosecutors cannot be expected to take on two to three times as many cases as they are used to and churn out results quickly.<\/p>\n<p>He added that the Minnesota attorney general\u2019s fraud division will have to be judicious about which claims it decides to investigate, opting to pursue cases that are more sweeping in scope, involve larger sums of theft, and were committed most recently.<\/p>\n<p>\u201cOther cases are going to fall by the wayside,\u201d Wanka said.<\/p>\n<p>The state attorney general\u2019s office is prodding the state legislature to expand the size of its Medicaid fraud task force, insisting they have too few prosecutors, analysts, and paralegals on the payroll to properly investigate and hold fraudulent medical providers accountable.<\/p>\n<p>Ellison himself has been throwing his weight behind a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.revisor.mn.gov\/bills\/94\/2025\/0\/HF\/2354\/\">bill<\/a>, introduced by Minnesota House Democrats, that would add 18 employees to the fraud-fighting team, bringing their ranks from 32 to 50 total staffers.<\/p>\n<p>\u201cGiving this vitally important unit more support is a no-brainer for people on either side of the aisle who are serious about fighting fraud,\u201d Ellison said at a February <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.youtube.com\/watch?v=mft0uBC6dsQ\">press conference<\/a> at the Minnesota Capitol.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4541758\/how-minnesota-attorney-general-keith-ellison-is-embroiled-in-the-feeding-our-future-scandal\/\"><strong>HOW MINNESOTA ATTORNEY GENERAL KEITH ELLISON IS EMBROILED IN THE FEEDING OUR FUTURE SCANDAL<\/strong><\/a><\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.revisor.mn.gov\/bills\/94\/2025\/0\/HF\/2354\/versions\/3\/#:~:text=Sec.%207.,Statutes%2C%20section%20609.467.\">fiscal cost<\/a> of the bill, dubbed the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.house.mn.gov\/comm\/docs\/80-stfyJVE21v-r5Z5SUBQ.pdf\">Medical Assistance Protection Act<\/a>, is priced at $1.23 million in additional appropriations per year. Currently, the anti-fraud unit\u2019s annual budget is about $5 million, of which the state only pays 25%. The other 75% comes from federal government grants.<\/p>\n<p>Staffing levels of Medicaid fraud control units across the country are typically proportional to the scale of a state\u2019s Medicaid budget. Minnesota\u2019s 32-person MFCU was previously set in accordance with the state\u2019s Medicaid budget of $13 billion at the time. Minnesota\u2019s Medicaid budget is now nearly $20 billion.<\/p>\n<p>HF 2354 failed to advance last legislative session, and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ag.state.mn.us\/Office\/Communications\/2026\/02\/25_MedicaidFraud.asp\">a reintroduced version<\/a> of it in 2026 remains <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.house.mn.gov\/comm\/docs\/xE8KGA2xHUCaEKrGjNketQ.pdf\">under review<\/a> in the Minnesota House Ways and Means Committee.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.revisor.mn.gov\/bills\/94\/2025\/0\/SF\/2689\/\">SF 2689<\/a>, its companion bill in the upper chamber, is headed to the Senate floor for consideration after the measure was amended into an appropriations package and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ag.state.mn.us\/Office\/Communications\/2026\/05\/01_MAP-Act.asp\">passed<\/a> by the Minnesota Senate Finance Committee on May 1.<\/p>\n<p>Robbins said that Ellison\u2019s office, the primary prosecutorial authority over Minnesota Medicaid cases, has hardly produced meaningful results in fraud prosecutions.<\/p>\n<p>While he has dissolved fraudulent nonprofit organizations, many of them already not properly filing with the Minnesota secretary of state, Robbins said that when Ellison seeks their dissolution, his office seldom successfully claws back the stolen funds.<\/p>\n<p>Robbins previously sent a letter to Ellison requesting evidence of his office\u2019s work.<\/p>\n<p>\u201cYou claim you\u2019ve done all this,\u201d Robbins said of Ellison in a phone call with the <em>Washington Examiner<\/em>. \u201cShow me what money you\u2019ve recovered.
