ICE arrested him in the U.S. in early April, and on April 28 DuBose ordered him released from ICE custody. DHS then issued a second April 30 release claiming an \u201cactivist\u201d Biden judge put a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >violent criminal back<\/a> into communities. <\/p>\n<p>In court, though, DuBose said she had not been informed-through official court records-about the specific Dominican warrant allegations when she made the release decision.Prosecutors, including Justice Department attorney Kevin M. bolan, acknowledged that he did not disclose the overseas details, saying ICE had told him not to reveal or confirm the foreign allegations as the dominican government had not authorized sharing the details.<\/p>\n<p>DHS\u2019s public attacks used the same overseas allegations that government lawyers were effectively told not to share with the judge, which the court viewed as a breakdown in candor and coordination. DuBose, an appointee of former President Joe Biden,\u00a0ordered Gomez <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.rid.61986\/gov.uscourts.rid.61986.6.0.pdf\">released from ICE custody<\/a> on April 28, DHS escalated the matter publicly with a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.dhs.gov\/news\/2026\/04\/30\/activist-biden-judge-releases-violent-criminal-illegal-alien-wanted-murder\">second April 30 press<\/a> release titled \u201cActivist Biden Judge Releases Violent Criminal Illegal Alien Wanted for Murder.\u201d<\/p>\n<div class=\"article-paywall\">\n<p>\u201cAn <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-forces-ice-to-release-illegal-alien-murder-suspect\/\" title=\"... Forces ... to Release Illegal Alien Murder Suspect\">activist judge appointed<\/a> by <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\">Joe Biden<\/a> released this wanted murderer back into American communities,\u201d DHS spokeswoman Lauren Bis said in the statement.<\/p>\n<p>But by that point, DuBose had not actually been informed through records in the court about the Dominican warrant when she made her release decision.<\/p>\n<p>According to statements made in court this week, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\">ICE<\/a> officials had told <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-justice\/\">Justice Department<\/a> attorney Kevin M. Bolan not to disclose the overseas allegations to the judge because the Dominican government had not yet authorized the information to be shared in litigation.<\/p>\n<p>The contradiction \u2014 one Trump administration agency publicly promoting information that government lawyers from a different agency claimed they were barred from disclosing in court \u2014 triggered the current fallout.<\/p>\n<p>On Tuesday, DuBose said she would refer Bolan for a possible disciplinary investigation over what she described as a serious lack of candor to the court.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large\"><figcaption class=\"wp-element-caption\">Judge Melissa DuBose ( U.S. District Court for the District of Rhode Island)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>\u201cIt\u2019s the candor and the lack of candor to this court that has to be addressed,\u201d DuBose said. \u201cAnd it has to be fully investigated, so we don\u2019t have anything like this happen again.\u201d<\/p>\n<p>Gomez, who entered the United States illegally near Lukeville, Arizona, in 2022, was arrested in Worcester, Massachusetts, on April 4 on assault and battery charges before being transferred into ICE custody after local authorities honored an immigration detainer.<\/p>\n<p>Bolan acknowledged during hearings on Monday and Tuesday that he failed to disclose the information about the foreign murder charges to the court, although he said he was told by ICE not to confirm or deny the foreign charges because authorization from the Dominican Republic had not yet been secured.<\/p>\n<p>In a declaration filed with the court on May 4, a DHS official posted the Dominican Republic arrest warrant, though the contents of that filing are under seal.<\/p>\n<p>But the problem for the government was that ICE had already publicly disclosed the warrant in its April 16 press release, something Bolan said he did not know at the time.<\/p>\n<p>The situation worsened after DHS publicly attacked DuBose on April 30 using the same information she had not received before issuing her ruling. The department also amplified a Fox News report describing Gomez as \u201cthis accused killer\u201d who was \u201cback out in the streets.\u201d<\/p>\n<p>DuBose later described the administration\u2019s public attacks as \u201cdangerous.\u201d<\/p>\n<p>Art Arthur of the\u00a0Center for Immigration Studies\u00a0said the case exposed a major messaging and coordination failure inside DHS and ICE.<\/p>\n<p>\u201cIf certain information is so sensitive it can\u2019t be shared with a court, it likely shouldn\u2019t be highlighted in a press release, either,\u201d Arthur <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/cis.org\/Arthur\/ICE-Screws-Case-Activist-Biden-Judge-Rhode-Island\">wrote in an analysis<\/a> of the controversy.<\/p>\n<p>The DOJ later issued its own <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/usao-ri\/pr\/statement-regarding-recent-media-reports-court-ruling\">May 1 statement<\/a> conceding DuBose had been unaware of the overseas allegations when she ordered Gomez released.<\/p>\n<p>Attorneys for Gomez have also challenged how the government characterized the foreign charges. Defense lawyer Melanie Shapiro argued in court that the Spanish-language warrant referenced a manslaughter-related statute and firearm offense rather than murder.
