Jean Carroll\u2019s case, and to seek consideration by the U.S. Supreme Court. The DOJ filed a petition at the Second Circuit,asking the justices to review issues tied to Carroll\u2019s defamation claims.<\/p>\n<p>Trump\u2019s lawyers have asked the appeals court to pause enforcement of the judgment while the Supreme Court request is pursued. An appellate court and a panel previously rejected Trump\u2019s challenges to the verdict for statements Trump made in 2019 denying Carroll\u2019s claim that he raped her.<\/p>\n<p>In the filing, Trump\u2019s attorneys argue the Supreme Court should decide weather presidential \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-rejects-trump-bid-to-shield-financial-records\/\" title=\"... Rejects Trump Bid To Shield Financial Records\">absolute immunity<\/a>\u201d from civil suits over official acts can be waived, and whether the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >government properly handled legal certification<\/a> under the Westfall Act. Carroll claims Trump defamed her by denying her allegation that he raped her at a Bergdorf Goodman dressing room sometime in the mid-1990s. Trump has repeatedly denied that the incident occurred, and his 2019 denials of the allegation led to Carroll filing the first of two defamation lawsuits against him.<\/p>\n<div class=\"article-paywall\">\n<p>Trump\u2019s lawyers said in the filing that the petition to the Supreme Court will address \u201cwhether the President\u2019s absolute immunity from civil claims based on official acts can be waived at all\u201d and if the DOJ \u201ctimely filed, and did not waive, a renewed Westfall Act certification.\u201d The Westfall Act gives federal government employees immunity from civil claims that fall under the scope of their federal jobs by moving liability to the government and away from the person.<\/p>\n<p>The DOJ will ask the Supreme Court to allow the replacement of Trump with the federal government in the case, arguing that when he denied the rape allegations publicly in 2019, he was acting in the scope of his job as a federal employee, in this case as the president. The appeals court had denied claims by Trump that he was entitled to immunity for the comments he made as president.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3796921\/appeals-court-upholds-e-jean-carroll-defamation-judgment-trump\/\" type=\"post\" id=\"3796921\">APPEALS COURT UPHOLDS $83.3 MILLION E. JEAN CARROLL DEFAMATION JUDGMENT AGAINST TRUMP<\/a><\/strong><\/p>\n<p>The Supreme Court is sitting on a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3882164\/trump-supreme-court-verdict-e-jean-carroll\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3882164\/trump-supreme-court-verdict-e-jean-carroll\/\">petition<\/a> from the other defamation lawsuit Carroll filed against Trump for denying her allegations against him. The other defamation lawsuit stems from comments Trump made in 2022, when he was out of office, and resulted in a $5 million verdict.<\/p>\n<p>The high court has set the case for discussion for one of its closed-door conferences, then rescheduled it seven times.
