The court saeid louisiana had shown it would suffer irreparable harm without a stay-not just from potential safety risks to women and pregnancies, but also from ongoing financial costs tied to emergency treatment covered by Medicaid.  <\/p>\n<p>The opinion addressed arguments from Danco Laboratories (the company that produces mifepristone) claiming any pause would cause major financial losses and that the state\u2019s concerns were outweighed by the FDA\u2019s regulatory process. The appellate panel rejected those points, concluding Danco\u2019s predicted losses were minor compared with Louisiana\u2019s interest in protecting public health and its laws. It also found Danco had little ability to monitor adverse events because it lacked a direct relationship with patients.  <\/p>\n<p>The article further asserts that mail-order access has increased opportunities for misuse and for people to obtain the medication without appropriate medical oversight, and it describes side effects and complications associated with mifepristone. It notes congressional and pro-life efforts to restore restrictive safeguards (such as in-person doctor requirements), and criticizes the FDA leadership\u2019s pace in acting on data the FDA says it needs before revisiting the drug-safety measures.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The company responsible for manufacturing the most popular abortion pill on the market are more concerned about its profits than the harm its drugs are inflicting on women and babies. <\/p>\n<p>The confession from mifepristone maker Danco Laboratories came in its defense against Louisiana\u2019s landmark lawsuit targeting the U.S. Food and Drug Administration\u2019s \u201cmail-order abortion scheme.\u201d The 5th Circuit Court of Appeals <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2026\/05\/2026-05-01-Fifth-Circuit-Order-Granting-Stay-of-2023-REMS.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unanimously granted<\/a> Louisiana\u2019s request for a stay, effectively pausing the FDA\u2019s mail-order abortion drug permissions. While the U.S. Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/05\/04\/supreme-court-temporarily-revives-fda-rule-allowing-mailing-of-harmful-abortion-drugs\/\" target=\"_blank\" rel=\"noreferrer noopener\">temporarily halted<\/a> the 5th Circuit\u2019s block just two days until both parties can brief the court, the case is considered ongoing.<\/p>\n<p>Tucked in the 5th Circuit Court of Appeals\u2019 ruling on Friday are Danco\u2019s suggestions that its \u201csubstantial financial interest\u201d in selling abortion drugs should outweigh Louisiana\u2019s claims that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-can-fulfill-3-campaign-promises-at-once-by-reinstating-safety-guardrails-on-abortion-pill\/\" title=\"Trump Can Fulfill 3 Promises By Restoring Abortion Pill Guardrails\">mail-order abortion pills pose<\/a> a danger to women and babies. The abortion pill manufacturers\u2019 concerns about \u201ccompliance costs and mifepristone profits,\u201d however, pale in comparison to the financial and physical harm that the 5th Circuit agreed Louisiana and <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion pill poisoning survivor Rosalie Markezich<\/a> demonstrated in their lawsuit. <\/p>\n<p>\u201cLouisiana argues the district court erred by finding its irreparable harms are outweighed by FDA\u2019s interest in continuing its review and Danco\u2019s financial interests in selling mifepristone. We agree,\u201d the 5th Circuit panel wrote.<\/p>\n<p>For Louisiana to successfully secure a stay, the state had to demonstrate it was \u201cirreparably harmed without a stay\u201d and that \u201cits harm is not outweighed by harm to other parties.\u201d As outlined in original filings, Louisiana and Markezich recognized the severe and life-threatening effects the Biden administration\u2019s <a href=\"https:\/\/thefederalist.com\/2024\/03\/05\/selling-abortion-pills-bloodies-the-hands-of-walgreens-and-cvs\/\" target=\"_blank\" rel=\"noreferrer noopener\">radically relaxed <\/a><a href=\"https:\/\/chrissmith.house.gov\/news\/documentsingle.aspx?DocumentID=398811\" target=\"_blank\" rel=\"noreferrer noopener\">abortion pill policies<\/a>, which allowed virtually anyone to secure the drug without seeing a doctor, had on women and their babies. <\/p>\n<p>Chemical abortion, the most prevalent means for ending pregnancy in the U.S., comes with a host of side effects such as <a href=\"https:\/\/prochoice.org\/wp-content\/uploads\/phone_triage_guide.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">bleeding<\/a>, <a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfast, weak pulse,\u201d \u201ctrouble breathing,\u201d diarrhea, dizziness, headache, vomiting<\/a>, <a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cpain\u201d across the back, arms, neck, and abdomen<\/a>. One recent analysis of insurance data suggested that more than <a href=\"https:\/\/thefederalist.com\/2025\/04\/28\/study-rate-of-serious-or-life-threatening-complications-after-abortion-pill-is-22-times-higher-than-fda-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">one in 10 women<\/a> who take mifepristone suffer a serious adverse event such as hemorrhage or infection. The risk of contracting a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/despite-promise-to-be-pro-life-ally-trump-admin-wont-regulate-abortion-drug-endangering-women\/\" title=\"Trump Admin Claimed To Be Pro-Life, But Won&#039;t Regulate ...\">life-threatening side effect linked<\/a> to pill-induced abortion is at least 22 times higher than what the FDA and Danco claim, especially when a mother whose pregnancy is further along than the recommended <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s025Lbl.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">10 weeks<\/a> uses mifepristone. <\/p>\n<p>The prevalence of mail-order mifepristone also paved the way for abuse and injury to plague women who wanted to keep their pregnancies. A majority of abortions, 70 percent, <a href=\"https:\/\/lozierinstitute.org\/hidden-epidemic-nearly-70-of-abortions-are-coerced-unwanted-or-inconsistent-with-womens-preferences\/\" target=\"_blank\" rel=\"noreferrer noopener\">are believed to be unwanted, coerced, or inconsistent<\/a> with the mother\u2019s values and desires.<\/p>\n<p>Not only did the plaintiffs prove the physical damage wrought by mail-order abortion, but Louisiana also showed a significant financial burden presented by the taxpayer-funded treatment of women who needed emergency care due to taking mifepristone unsupervised. The 5th Circuit agreed, despite Danco\u2019s protests that \u201cLouisiana waited too long to sue and seek a stay,\u201d that \u201cLouisiana\u2019s financial harms are also irremediable.\u201d<\/p>\n<p>\u201cLouisiana has shown the 2023 REMS causes it daily irreparable harm by<br \/>undermining its laws and costing it irremediable Medicaid funds. \u2018Those costs are<br \/>ongoing . . . and more than sufficient to satisfy the irreparable harm standard in this<br \/>circuit,\u2019\u201d the panel quoted. <\/p>\n<p>Danco also suggested it would suffer as the result of a stay that stopped the profitable sale of abortion drugs by mail. The abortion drug manufacturer even tried to undermine claims of an increase in severe adverse events by stating it is required to report such complications to the FDA. <\/p>\n<p>The 5th Circuit did not buy it. The panel ultimately determined that Danco\u2019s \u201cpotential financial losses pale beside Louisiana\u2019s sovereign interest in its laws protecting the unborn and the public\u2019s interest in not exposing women to unsafe medical procedures.\u201d<\/p>\n<p>\u201cWhile we acknowledge a stay would impose costs on Danco, cf. Alliance II, 78 F.4th at 252, the company exaggerates by predicting a stay would destroy any \u2018valid legal framework for distributing\u2019 the drug. To the contrary, a stay would only pause a method of prescribing<br \/>mifepristone that began five years ago and was formally approved only three years ago,\u201d the panel wrote.<\/p>\n<p>The appeals court also agreed with plaintiffs that Danco \u201chad no direct relationship with Mifeprex patients and little ability to track [adverse] events.\u201d <\/p>\n<p>Polling suggests a <a href=\"https:\/\/thefederalist.com\/2025\/10\/28\/trumps-trusted-pollster-even-pro-aborts-say-mifepristone-is-dangerous-and-needs-fda-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">majority of likely voters<\/a> want the FDA to protect women from the dangers of abortion pills. <a href=\"https:\/\/www.dailywire.com\/news\/most-americans-want-trump-admin-to-reverse-course-on-abortion-pill\" target=\"_blank\" rel=\"noreferrer noopener\">Polling also shows seven in 10 Americans<\/a> want the FDA to reinstate in-person doctor visits as a requirement to obtain abortion pills.<\/p>\n<p>For years now, <a href=\"https:\/\/thefederalist.com\/2025\/10\/10\/51-gop-senators-urge-hhs-fda-to-end-distribution-of-dangerous-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">Congress<\/a> and pro-life organizations <a href=\"https:\/\/harshbarger.house.gov\/media\/in-the-news\/175-gop-lawmakers-call-fda-reverse-biden-admins-mail-order-abortion-scheme#:~:text=%E2%80%9CAs%20Members%20of%20Congress%20who,of%20the%20drug%20mifepristone%20be\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> for the FDA to at least roll back Biden-era expansions that make it easier for people to obtain and take mifepristone without medical evaluation. Sen. Josh Hawley even introduced <a href=\"https:\/\/www.foxnews.com\/politics\/hawley-introduces-bill-strip-fda-approval-from-inherently-dangerous-abortion-pill\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a> to ban the popular abortion drug and give survivors a legal remedy against foreign abortion pill makers. <\/p>\n<p>In their <a href=\"https:\/\/thefederalist.com\/2026\/03\/26\/senate-republicans-probe-mifepristone-manufacturers-over-mail-order-abortion-scheme\/\" target=\"_blank\" rel=\"noreferrer noopener\">March 25 letter<\/a> to Mifeprex maker Danco Laboratories, GOP Sens. Bill Cassidy, Steve Daines, Lindsey Graham, Cindy Hyde-Smith, and James Lankford expressed concerns that \u201cDanco is not ensuring the REMS requirements are met, especially as it pertains to the online prescribing of Mifeprex.\u201d<\/p>\n<p>\u201cIt seems unlikely that Danco is effectively enforcing compliance with the Mifepristone REMS Program when it appears to actively facilitate access to its drug outside of the window for which it is approved by FDA,\u201d the letter stated, noting that it is also \u201cunclear how an online prescriber could adequately explain the risks of the mifepristone treatment regimen to the patient in accordance with the existing REMS.\u201d<\/p>\n<p>Both\u00a0U.S. Health and Human Services Secretary <a href=\"https:\/\/www.finance.senate.gov\/hearings\/hearingto-consider-the-nomination-of-robert-f-kennedy-jr-of-california-to-be-secretary-of-health-and-human-services\" target=\"_blank\" rel=\"noreferrer noopener\">Robert F. Kennedy Jr.<\/a> and\u00a0Commissioner of Food and Drugs Marty <a href=\"https:\/\/www.npr.org\/sections\/shots-health-news\/2025\/03\/06\/nx-s1-5319894\/fda-commissioner-makary\" target=\"_blank\" rel=\"noreferrer noopener\">Makary<\/a> pledged throughout 2025 to review the data suggesting the abortion pill drug regimen. Their promises, however, have fallen short and resulted in <a href=\"https:\/\/sbaprolife.org\/newsroom\/press-releases\/sba-pro-life-america-intensifies-call-to-fire-makary\" target=\"_blank\" rel=\"noreferrer noopener\">calls from pro-life organizations<\/a> for Makary to be fired.<\/p>\n<p>As the <a href=\"https:\/\/www.wsj.com\/politics\/policy\/trump-anti-abortion-movement-76393c1c?st=NkQf2G&#038;reflink=article_copyURL_share\" target=\"_blank\" rel=\"noreferrer noopener\">Wall Street Journal<\/a> reported this week, Makary \u201chas said publicly that his agency is working on the data acquisition needed to finish the review\u201d but privately \u201ctold others in the administration that he can\u2019t produce the study until a new drug-safety data-monitoring system, known as Sentinel 3.0, is up and running.\u201d<\/p>\n<p>No <a href=\"https:\/\/www.fda.gov\/media\/128651\/download\" target=\"_blank\" rel=\"noreferrer noopener\">review is required<\/a> for the FDA to reinstate some of the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >common-sense abortion pill safeguards<\/a>, such as an in-person doctor visit, that were removed at President Joe Biden\u2019s direction. Yet, the FDA was firm that it <a href=\"https:\/\/thefederalist.com\/2026\/01\/29\/fda-wants-pause-on-landmark-abortion-pill-suit-pro-lifers-say-it-will-cost-lives\/\" target=\"_blank\" rel=\"noreferrer noopener\">does not plan to act on those REMs<\/a> until it concludes its official abortion drug evaluation.<\/p>\n<p>Until then, <a href=\"https:\/\/thefederalist.com\/2025\/06\/11\/tx-man-arrested-after-allegedly-poisoning-his-girlfriend-murdering-his-child-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">women<\/a> across the nation\u00a0like Rosalie <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">Markezich<\/a>, one of the plaintiffs in the landmark case, are <a href=\"https:\/\/thefederalist.com\/2025\/08\/11\/man-allegedly-murdered-his-unborn-baby-by-spiking-her-moms-hot-cocoa-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">susceptible<\/a> to the <a href=\"https:\/\/thefederalist.com\/2024\/09\/24\/nations-top-ob-gyn-org-could-combat-lies-about-pro-life-laws-but-that-would-hurt-their-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">injuries and even death<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/05\/02\/media-blackout-on-abortion-pill-study-proves-they-never-cared-about-amber-thurmans-death\/\" target=\"_blank\" rel=\"noreferrer noopener\">linked to<\/a> <a href=\"https:\/\/thefederalist.com\/2024\/10\/02\/tim-walz-repeats-lie-blaming-pro-lifers-for-woman-killed-by-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>, whether they take it under duress, without medical supervision, or both.<\/p>\n<hr>\n<p>      Jordan Boyd is an award-winning staff writer at The Federalist and producer of \u201cThe Federalist Radio Hour.\u201d Her work has also been featured in The Daily Wire, Fox News, and RealClearPolitics.
