The groups argue the law violates the U.S.Constitution\u2019s Supremacy Clause by trying to create and enforce a state-controlled immigration system that should remain under federal authority.<\/p>\n<p>The law had been blocked in lower courts, but a federal appeals court lifted that restriction in late April, enabling Texas enforcement to begin later this month.Plaintiffs are seeking to stop implementation, contending that SB 4 gives Texas officials powers similar to federal immigration enforcement-arrest, detention, prosecution, and deportation to Mexico-without federal involvement or oversight. Immigration law has historically been enforced solely by the federal government, and federal law should preempt state law, the groups argued.\u00a0The lawsuit was filed in the District Court for the Western District of Texas against Freeman Martin, director of the Texas Department of Public Safety.<\/p>\n<div class=\"article-paywall\">\n<p>\u201c[SB 4] purports to give Texas state officials the unprecedented power to arrest, detain, and deport noncitizens in the State of Texas,\u201d the lawsuit reads. \u201cUnder this novel system, the State of Texas has created its own immigration crimes; state police arrest noncitizens for alleged violations of these crimes; <a href=\"https:\/\/amzn.to\/3YuVZYV\" >state prosecutors bring charges<\/a> in state courts; state judges order deportation to Mexico (no matter the country a person is from); and state officers carry out those orders. The federal government has no role in, and no control over, Texas\u2019s scheme.\u201d<\/p>\n<p>The bill was set to take effect on May 15, after the U.S. Circuit Court of Appeals for the 5th Circuit lifted a hold on the law last month.
