The ruling targets districts drawn to boost Black voters’ power under the Voting Rights Act, and Louisiana will have to redraw boundaries for its six House seats-likely reducing the number of democratic seats from two to one.

The process was complicated by timing rules: Louisiana can’t start redrawing until the Court issues its final order, leaving primary elections on hold. The state asked the Court to waive a 32-day waiting period between the decision and the enforcement order so elections can proceed, effectively letting the new maps and elections move forward sooner.

Justice Ketanji Brown Jackson issued a strongly worded dissent warning that “principles give way to power” and criticizing colleagues for allowing immediate effect. Justice Samuel Alito responded, arguing the dissent incorrectly claims it would be improper to shorten the Court’s default rule and that the dissent’s criticisms are baseless, including that elections shouldn’t proceed under what he views as an unconstitutional map without sufficient justification.

    Read more…

The Supreme Court agreed Monday to throw out racial gerrymandering in Louisiana’s congressional districts, triggering a war of words among justices.

The court ruled last week that districts drawn to enhance the power of <a href="https://www.conservativenewsdaily.net/breaking-news/its-happening-trump-now-up-in-michigan-florida-pennsylvania-and-tied-in-wisconsin-and-black-hispanic-and-evangelical-vote-is-up-from-2016/" title="IT'S HAPPENING! Nor does the dissent assert that it is not feasible for the elections to be held under such a map,” Alito wrote.

“Instead, the dissent offers two reasons for its proposed course of action. One is trivial at best, and the other is baseless and insulting,” he added.

“The first is compliance with the 32-day default rule set out in this Court’s Rule 45.3, but as the Court’s order ex- plains, there is good reason to depart from the default rule here,” Alito wrote.

“The second reason offered by the dissent is that we should allow the 32-day period to run out in order to ‘avoid the appearance of partiality,’” he continued.

Alito said Jackson’s leap of logic was faulty.

“But the dissent does not explain why its insistence on unthinking compliance with Rule 45.3’s default rule does not create the appearance of partiality (by running out the clock) on behalf of those who may find it politically advantageous to have the election occur under the unconstitutional map,” he wrote.

“The dissent goes on to claim that our decision represents an unprincipled use of power,” Alito said, adding, “That is a groundless and utterly irresponsible charge.”

“What principle has the Court violated? The principle that Rule 45.3’s <a href="https://www.conservativenewsdaily.net/breaking-news/alito-torches-jacksons-trivial-and-insulting-hot-take-on-supreme-courts-latest-callais-order/" title="... The principle that we should never take any action that might unjustifiably criticized as partisan?” he wrote.

“The dissent accuses the Court of ‘unshackl[ing]’ itself from ‘constraints.’ It is the dissent’s rhetoric that lacks restraint.”

Choose The Western Journal as your preferred source on Google and never miss reporting that defends truth, protects freedom, and advances Western civilization

Advertise with The Western Journal and reach millions of highly engaged readers, while supporting our work. Advertise Today.

       * Name

       *

      * Message

* All fields are required.

Success!

       function firefly_sc() {     if( typeof window.captchaPublicKey == typeof undefined ){      console.error('window.captchaPublicKey is not defined');     }     grecaptcha.execute( window.captchaPublicKey, { action: 'submit_correction' } ).then( function( token ) {      var opts = {       action:    'firefly_sc_submit',       name:      document.querySelector( '.entry-submit-correction [name="name"]' ).value,       :     document.querySelector( '.entry-submit-correction [name=""]' ).value,       message:   document.querySelector( '.entry-submit-correction [name="message"]' ).value,       post_id:   firefly_post_id,       cap_token: token      }       var inputs = [ 'name', '', 'message' ];       for( var i = 0; i < inputs.length; i++ ) if( !
