Callais*, arguing that the majority-led by Justice samuel Alito-went beyond deciding the law by also shaping how the decision woudl be implemented on an expedited timeline. The order fast-tracked transmission of the ruling to lower courts rather than waiting the usual 32 days after Louisiana asked to waive that period so the state legislature and courts could correct the unconstitutional congressional map before the 2026 midterm elections.Jackson saeid this choice risks \u201cchaos\u201d in Louisiana and criticized her colleagues for not adhering to default procedures to avoid any appearance of partiality.<\/p>\n<p>Alito, joined by justices Clarence Thomas and Neil Gorsuch, responded in a concurrence that directly rebuts Jackson\u2019s objections. He argued that Jackson\u2019s concerns are based on unpersuasive premises-contending her dissent fails to show why following the Court\u2019s rule-abiding default creates any better appearance of neutrality than acting promptly to ensure elections are held under a compliant map.He also criticized her charge that the Court unshackled itself from constraints as irresponsible rhetoric, insisting the dispute is about whether there is good reason to shorten the default period.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Justice Ketanji Brown Jackson\u2019s Supreme Court opinions are often poorly argued and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >lack coherent legal reasoning<\/a>. And in the high court\u2019s latest release, Justice Samuel Alito made sure she knew it.<\/p>\n<p>The Alito-driven smackdown happened late Monday when the Supreme Court released an <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a1197_097c.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> related to its landmark <em>Louisiana v. Callais<\/em> decision, in which the majority (led by Alito) determined that Louisiana\u2019s most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-ohio-to-use-gop-friendly-maps-for-state-level-elections\/\" title=\"Federal Court: Ohio to Use GOP-Friendly Maps for ...-Level ...\">recent congressional map<\/a> is an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-blocks-congressional-maps-passed-by-fellow-republicans\/\" title=\"DeSantis Blocks Congressional Maps Passed By Fellow Republicans\">unconstitutional racial gerrymander<\/a>. Equally significant, however, is that the ruling effectively <a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">nuked<\/a> states\u2019 ability to partake in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-depth-federal-state-lawsuits-seek-constitutional-clarity-on-racial-gerrymanders\/\" title=\"Federal and ... lawsuits aim to clarify constitutionality of &quot;racial gerrymanders.&quot;\">race-based redistricting<\/a>. <\/p>\n<p>In its newest order, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-supreme-court-takes-up-trump-lawsuit-days-ahead-of-electoral-college-vote\/\" title=\"Wisconsin Supreme Court Takes Up Trump Lawsuit Days Ahead of Electoral College Vote\">high court agreed<\/a> to fast-track the transmission of its decision to the lower courts rather than wait 32 days, as per normal custom. The move came in response to a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1197\/405667\/20260429182953938_4-29-2026_Application%20to%20Expedite.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">request<\/a> by the Louisiana residents who challenged the unlawful map to waive the 32-day period. They argued that doing so would allow the lower courts and state legislature to quickly rectify the unconstitutional map ahead of the 2026 midterm elections. <\/p>\n<p>The Supreme Court\u2019s decision to grant the <em>Callais<\/em> appellees\u2019 request in accordance with existing SCOTUS rules did not sit well with Jackson. The Biden appointee penned an unhinged solo screed claiming the court\u2019s order \u201chas spawned chaos in the State of Louisiana.\u201d<\/p>\n<p>Jackson started off by recognizing Louisiana Gov. Jeff Landry\u2019s recent <a href=\"https:\/\/gov.louisiana.gov\/news\/5093\" target=\"_blank\" rel=\"noreferrer noopener\">suspension<\/a> of the state\u2019s U.S. House primaries in light of <em>Callais<\/em>\u2018 release to fix the illegal map, as well as the subsequent legal challenges to his decision. In doing so, she charged that \u201c[t]hese post-<em>Callais<\/em> developments have a strong political undercurrent,\u201d and attacked her colleagues for declining \u201cto stay on the sidelines and take no position by applying our default procedures\u201d as to \u201cavoid the appearance of partiality.\u201d<\/p>\n<p>\u201cBut, today, the Court chooses the opposite. Not content to have decided the law, it now takes steps to influence its implementation,\u201d Jackson wrote. \u201cThe Court unshackles itself from both constraints today and dives into the fray. And just like that, those principles give way to power. Because this abandon is unwarranted and unwise, respectfully, I dissent.\u201d<\/p>\n<p>Clearly fed up with Jackson\u2019s political activism from the bench, Alito, joined by Justices Clarence Thomas and Neil Gorsuch, wrote a concurring opinion addressing the junior justice\u2019s charges he said \u201ccannot go unanswered.\u201d <\/p>\n<p>The Bush appointee noted how Jackson\u2019s position \u201cwould require that the 2026 congressional elections in Louisiana be held under a map that has been held to be unconstitutional.\u201d He further highlighted how the Biden appointee \u201cdoes not claim that it is now too late for the state legislature or the District Court to adopt a new map that complies with the Constitution\u201d or \u201cassert that it is not feasible for the elections to be held under such a map.\u201d<\/p>\n<p>\u201cInstead,\u201d Alito wrote, \u201cthe dissent offers two reasons for its proposed course of action. One is trivial at best, and the other is baseless and insulting.\u201d<\/p>\n<p>Alito went on to rip the incoherence behind Jackson\u2019s opposition to the court\u2019s suspension of its 32-day default rule. He additionally admonished her claim that the court\u2019s order creates the appearance of \u201cpartiality,\u201d noting how she \u201cdoes not explain why [her] insistence on unthinking compliance with [Supreme Court] Rule 45.3\u2019s default rule does not create the appearance of partiality (by running out the clock) on behalf of those who may find it politically advantageous to have the election occur under the unconstitutional map.\u201d<\/p>\n<p>\u201cThe dissent goes on to claim that our decision represents an unprincipled use of power. \u2026 That is a groundless and utterly irresponsible charge,\u201d Alito wrote. \u201cWhat principle has the Court violated? The principle that Rule 45.3\u2019s 32-day default period should never be shortened even when there is good reason to do so? The principle that we should never take any action that might unjustifiably be criticized as partisan?\u201d<\/p>\n<p>But Alito wasn\u2019t done humiliating Jackson and her inability to act as a competent judge. <\/p>\n<p>In concluding his concurrence, the Bush appointee slammed the junior justice\u2019s accusations that the court \u201cunshackles itself from constraints\u201d by underscoring that it is her \u201crhetoric that lacks restraint.\u201d <\/p>\n<p>The concurrence was yet another example of Alito\u2019s legal acumen.
