The lawyers argue the move violates the state constitution\u2019s Fair Districts Amendment, which prohibits partisan <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/gerrymandering\/\" type=\"post_tag\" id=\"5304\">gerrymandering<\/a>.<\/p>\n<div class=\"article-paywall\">\n<p>\u201cFlorida made no efforts to amend its constitution when it sought to join the partisan wars and conduct a mid-decade redistricting for partisan gain,\u201d the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2026\/05\/2026-05-04-Complaint.pdf\">complaint<\/a> reads. \u201cFlorida\u2019s constitution continues to expressly prohibit partisan gerrymandering\u2014a constraint the Legislature chose to ignore.\u201d<\/p>\n<p>DeSantis, on the other hand, has argued that the Supreme Court\u2019s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4410470\/supreme-court-strikes-down-race-based-redistricting-map-in-louisiana\/\">recent decision in <em>Louisiana v. Callais<\/em> <\/a>striking down race-based redistricting justifies\u00a0new districts under the Republican-drawn map.<\/p>\n<p>\u201cThe decision implicates a district in FL \u2014 the legal infirmities of which have been corrected in the newly-drawn (and soon to be enacted) map,\u201d DeSantis had written on X last week.<\/p>\n<p>The <em>Washington Examiner<\/em> has reached out to DeSantis\u2019s office for comment on the lawsuit.<\/p>\n<p>Florida\u2019s legislature <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4547856\/florida-desantis-redistricting-map-four-seats\/\">passed the map<\/a> last week in a special legislative session called after voters in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/virginia\/\" type=\"post_tag\" id=\"96\">Virginia<\/a> approved the Democratic legislature\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bipartisan-approved-arizona-redistricting-map-threatens-democrat-tom-ohallerans-reelection-chances\/\" title=\"Bipartisan-Approved Arizona Redistricting ... The push from DeSantis and the Florida GOP is the latest push-and-pull move in the country\u2019s redistricting wars, sparked in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/texas\/\" type=\"post_tag\" id=\"253\">Texas<\/a> last year.<\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/in_focus\/4552172\/democrats-florida-passed-desantis-map-gerrymander\/\">four Democratic representatives<\/a> at risk\u00a0of losing their seats under the new Florida map are Reps.
