Associate Justice Samuel Alito issued an administrative stay on Monday, which halts the Friday ruling from a three-judge panel of the 5th Circuit while the parties prepare briefs to the full court; the stay remains in effect until May 11 at 5 p.m.<\/p>\n<p>The dispute centers on a Biden-era change to FDA rules that eliminated the requirement for an in-person doctor appointment, allowing prescriptions without that face-to-face safeguard. Louisiana, after suing in 2025, argued that the FDA\u2019s justification relied on flawed or nonexistent data and that the revised policy led to harm and costs. A unanimous panel of the 5th Circuit agreed and granted Louisiana\u2019s request to stay the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-returns-to-supreme-court-in-ongoing-ghost-gun-battle\/\" title=\"Biden Administration renews &#039;Ghost Gun&#039; fight at Supreme Court.\">rule pending appeal<\/a>.<\/p>\n<p>Louisiana\u2019s attorney general said the pause is temporary, while the article also criticizes the Trump governance for not quickly establishing what <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-hawley-says-biden-abortion-policies-are-an-insult\/\" title=\"Sen. That unanimous decision by a three-judge panel momentarily blocked a Biden-era rule promulgated by the Food and Drug Administration that authorized the dangerous abortion drug <a href=\"https:\/\/thefederalist.com\/tag\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a> \u201cto be mailed to women without so much as an in-person doctor appointment,\u201d as The Federalist\u2019s Elle Purnell <a href=\"https:\/\/thefederalist.com\/2026\/05\/02\/appeals-court-blocks-fda-policy-that-let-abortionists-traffick-deadly-illegal-drugs-by-mail\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. <\/p>\n<div id=\"fdrlst__b89e9-1877945145\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Alito\u2019s order came in response to an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1207\/407852\/20260502123104939_Danco%20SCOTUS%20Stay%20Application%205-2-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency application<\/a> filed by Danco Laboratories LLC that sought to temporarily pause the 5th Circuit\u2019s decision. The mifepristone distributor also asked the high court to take up and hear arguments in the case before its summer recess. <\/p>\n<p>Alito\u2019s administrative stay is designed to give parties time to brief the full court on the matter, and as such, will remain in place until 5 p.m. on May 11. Louisiana \u2014 which challenged the Biden-era rule \u2014 has been instructed to file its response no later than 5 p.m. on Thursday, according to the order. <\/p>\n<p>As described by Purnell, \u201cMifepristone is the primary drug in the regimen that euthanizes a baby in utero and expels it from a mother\u2019s body.\u201d While \u201cfederal safety guardrails\u201d requiring a doctor\u2019s in-person examination before prescription were enacted upon the drug\u2019s FDA approval in 2000, the Biden administration ended such protections in 2023, \u201callowing abortion pills to be trafficked through the mail without any in-person safeguards.\u201d<\/p>\n<p>The decision prompted the state of Louisiana to file a lawsuit challenging the new policy in 2025.  It argued that, as <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2026\/05\/2026-05-01-Fifth-Circuit-Order-Granting-Stay-of-2023-REMS.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">summarized<\/a> by the 5th Circuit, the FDA\u2019s \u201cjustifications for remotely dispensing mifepristone were based on flawed or nonexistent data\u201d and \u201cdocumented how the new regulation had resulted in numerous illegal abortions in Louisiana and in Louisiana paying thousands in Medicaid bills for women harmed by mifepristone.\u201d<\/p>\n<p>Given these arguments, the Pelican State requested a stay of the rule while litigation in the case continued. <\/p>\n<p>Writing for a unanimous panel granting the state\u2019s request, Judge Kyle Duncan concluded that \u201cthe balance of equities and public interest weigh in Louisiana\u2019s favor.\u201d<\/p>\n<p>\u201cWe have now three times found that the agency\u2019s progressive relaxation of mifepristone\u2019s guardrails likely lacked a basis in data and scientific literature,\u201d Duncan wrote. \u201cFDA\u00a0itself now concedes the regulations were marred by \u2018procedural deficits\u2019 and a \u2018lack of adequate consideration.\u2019 The public interest is not served by perpetuating a medical practice whose safety the agency admits was inadequately studied. Indeed, the public interest demands the opposite.\u201d<\/p>\n<p>\u201cAccordingly, IT IS ORDERED that the motion to stay the 2023 REMS under 5 U.S.C. \u00a7 705 pending appeal is GRANTED,\u201d he added. <\/p>\n<p>Responding to the Supreme Court\u2019s pause of the ruling, Louisiana Attorney General Liz Murrill emphasized in a statement that the stay is \u201ctemporary.\u201d She further expressed confidence that \u201clife and the law will win in the end.\u201d<\/p>\n<p>\u201cBig abortion pharma claims they need an emergency stay because they will lose massive amounts of money if they can\u2019t kill more babies quickly and efficiently by mail without medical oversight,\u201d Murrill said. <\/p>\n<p>Despite its significant documented harms and President Trump\u2019s <a href=\"https:\/\/thefederalist.com\/2026\/02\/24\/despite-promise-to-be-pro-life-ally-trump-admin-wont-regulate-abortion-drug-endangering-women\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-life pledge<\/a> on the 2024 campaign trail, the Trump administration has <a href=\"https:\/\/thefederalist.com\/2026\/05\/02\/appeals-court-blocks-fda-policy-that-let-abortionists-traffick-deadly-illegal-drugs-by-mail\/\" target=\"_blank\" rel=\"noreferrer noopener\">seemingly slow-walked<\/a> establishing effective safeguards on the abortion drug.
