FFLC\u2019s chief counsel Josh Hetzler said the wording \u201cdeceives voters on issues of major importance,\u201d asserting it leaves out key policy changes the amendment could trigger.<\/p>\n<p>\u201cIt\u2019s not just bad policy, it\u2019s that the ballot language is misleading and people are not made aware of how bad the proposal really is,\u201d Hetzler told the <em>Washington Examiner<\/em>, emphasizing that the lawsuit is focused on what voters are not being told, rather than the policy debate itself.<\/p>\n<p>Under the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/lis.virginia.gov\/bill-details\/20261\/SB449\/text\/CHAP0003\">proposed language<\/a>, voters would be asked: \u201cShould the Constitution of Virginia be amended to protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; protect doctors, nurses, and patients from being punished for these decisions; and allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient\u2019s health is at risk or the pregnancy cannot survive?\u201d<\/p>\n<p>Opponents of the measure argue that summary omits other sweeping consequences that a vote for \u201cyes\u201d would create. Hetzler pointed specifically to the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >ballot measure stripping parental involvement laws<\/a>, arguing that \u201cthe law today protects that in Virginia, and it would go away, and voters would not know that,\u201d referring to consent and notification requirements for minors.<\/p>\n<p>He also warned that the amendment\u2019s language preventing the state from penalizing those involved in providing abortions could mean \u201canyone could perform an abortion \u2026 whether they\u2019re trained or not, and nothing can happen to them,\u201d a consequence he said is not disclosed in the ballot summary.<\/p>\n<p>Democrats and advocates for access to abortion dispute those claims, maintaining the amendment is designed to preserve access to \u201creproductive healthcare,\u201d rather than to dismantle existing safeguards.<\/p>\n<p>\u201cVirginians have made it clear time and again that we support reproductive freedom and do not want our healthcare controlled by politicians,\u201d Democratic state Sen. Jennifer Boysko said in a statement.<\/p>\n<p>Virginia Attorney General <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/jay-jones\/\">Jay Jones<\/a> called the lawsuit an effort to interfere with voters\u2019 choices ahead of the November election. <\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">Virginia Gov. Marchers from across the state, including church groups, students, and advocacy organizations, described the amendment as a defining issue heading into the election.<\/p>\n<p>\u201cI don\u2019t think the public is aware of what\u2019s in the amendment, and just how far it goes,\u201d John Curran, a participant who traveled from Williamsburg, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.osvnews.com\/virginians-march-against-extreme-abortion-amendment-seeking-to-devour-life\/\">told<\/a> <em>OSV News<\/em> in April. \u201cWe need to bring awareness to it.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">Virginia\u2019s former Republican Gov. Bishop Barry Knestout of Richmond warned of what he described as \u201ca dragon hovering over Virginia,\u201d urging activists to confront what they see as an expansion of pro-abortion policies.<\/p>\n<p>Organizers are also shifting toward sustained engagement beyond demonstrations, with advocacy training sessions aimed at preparing volunteers to campaign against the amendment in the months leading up to the vote.<\/p>\n<p>The case marks the second legal challenge tied to the amendment. A separate lawsuit <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/lc.org\/PDFs\/Attachments2PRsLAs\/2026\/030326-Complaint-(Bansleyv.Nardo)file-stamped.pdf\">filed in Bedford County in March<\/a> challenged whether lawmakers followed proper procedures in placing the measure on the ballot, an issue the legislature addressed through a retroactive change to state law. The new case instead zeroes in on the wording presented directly to voters, with plaintiffs asking a judge to order revisions before early voting begins in September.<\/p>\n<p>Hetzler said the legal strategy is modeled in part on other recent ballot litigation in the state, arguing that courts may not stop the election outright but could still intervene. <\/p>\n<p>\u201cThe Virginia Supreme Court has made it pretty clear they don\u2019t want to stop an election,\u201d he said, but added that a ruling declaring the language unconstitutional could force lawmakers to rewrite it. If the litigation stalls and no ruling comes before November, it could risk the results being invalidated after the vote takes place.<\/p>\n<p>If that sounds familiar, it is because something similar has played out recently.
