The article claims Hemingway traces the timeline: Alito\u2019s majority draft was circulated by early February 2022; the three dissenting justices allegedly still weren\u2019t close to finishing by shortly after the leak; and the decision was further delayed, including via what Hemingway calls an \u201cevil easter egg\u201d reference in the dissent that pushed the release back by weeks.<\/p>\n<p>It also argues that legacy media avoided covering these claims, citing searches showing little to no prominent reporting on the key allegations during a specific window around the book\u2019s release, while still running headlines that portray conservative justices as partisan or dangerous.The piece broadens this into an argument about media \u201cdouble standards,\u201d pointing to earlier controversy involving Brett Kavanaugh, and then to reporting about Clarence Thomas and flag-related stories about Alito, contrasting those portrayals wiht less sensational coverage of incidents involving liberal justices.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Mollie Hemingway\u2019s <a href=\"https:\/\/www.amazon.com\/Alito-Justice-Reshaped-Restored-Constitution\/dp\/1541607139\" target=\"_blank\" rel=\"noreferrer noopener\">new book<\/a> on Justice Samuel Alito, released last week, explosively revealed that the liberal justices on the Supreme Court intentionally delayed the release of the <em>Dobbs<\/em> decision \u2014 even as their conservative colleagues\u2019 lives were at risk after the unprecedented leak of the majority opinion in May 2022.<\/p>\n<p>The media outlets that feign concern about SCOTUS propriety and accountability \u2014 only insofar as it harms conservatives \u2014 have unsurprisingly shrugged off this clearly political behavior of the Democrat-appointed members of the high court. They don\u2019t care that the liberal minority put their conservative colleagues\u2019 lives at risk in a seeming attempt to preserve the so-called \u201cright\u201d to murder babies. In fact, they cheered the threats on. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Discussing her new book, ALITO, Mollie Hemingway notes how the media played &#8220;a major role&#8221; in ginning up threats against SCOTUS after the Dobbs leak. <a href=\"https:\/\/t.co\/iUKZRUN4b4\">pic.twitter.com\/iUKZRUN4b4<\/a><\/p>\n<p>\u2014 The Federalist (@FDRLST) <a href=\"https:\/\/twitter.com\/FDRLST\/status\/2046341452611957019?ref_src=twsrc%5Etfw\">April 20, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>According to Mollie Hemingway, the draft of the <em>Dobbs<\/em> majority opinion overturning the devastating abortion precedents of <em>Roe<\/em> and <em>Casey<\/em> was penned and circulated by Justice Samuel Alito by <a href=\"https:\/\/x.com\/FDRLST\/status\/2047413452159815898\" target=\"_blank\" rel=\"noreferrer noopener\">early February<\/a> of 2022. Three whole months later, after a draft of the opinion was leaked, the three dissenting justices \u2014 Stephen Breyer, Sonia Sotomayor, and Elena Kagan \u2014 were reportedly still \u201c<a href=\"https:\/\/x.com\/FDRLST\" target=\"_blank\" rel=\"noreferrer noopener\">nowhere near done<\/a>\u201d with the dissent.<strong> <\/strong>It had been months since they had the opinion \u2014 not to mention the 50 years they had to decide how they felt about <em>Roe<\/em>. Despite urging to get their dissents in after the leak, the liberals on the court slow-walked all the way to June 1.<\/p>\n<p>However, that was not the end of the delay. As Hemingway noted, they included an \u201c<a href=\"https:\/\/x.com\/FDRLST\/status\/2046338892379369639\" target=\"_blank\" rel=\"noreferrer noopener\">evil Easter egg<\/a>\u201d in the dissent \u2014 a footnote reference to another decision that was not yet released, thus delaying <em>Dobbs<\/em> by another three weeks. Meanwhile, the conservative majority faced angry protestors outside their homes, threats against their families and children, and a literal assassination attempt. Hemingway also reported how, although Justice Breyer was the \u201cmost willing\u201d to speed things up for his colleagues\u2019 sake, Justice Kagan \u201cscreamed\u201d at him so loudly <a href=\"https:\/\/x.com\/FDRLST\/status\/2047741383683760389\" target=\"_blank\" rel=\"noreferrer noopener\">not to accommodate<\/a> them that observers said the \u201cwall was shaking.\u201d<\/p>\n<p>But you won\u2019t find this story in legacy outlets that have previously rushed at the opportunity to perpetuate smear campaigns against the conservative justices they deem a \u201cthreat to democracy.\u201d<\/p>\n<p>Hemingway\u2019s book, <em><a href=\"https:\/\/www.amazon.com\/Alito-Justice-Reshaped-Restored-Constitution\/dp\/1541607139\" target=\"_blank\" rel=\"noreferrer noopener\">Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution<\/a><\/em>, was released April 21. Many of the aforementioned bombshell details in the book were <a href=\"https:\/\/www.foxnews.com\/politics\/kagan-screamed-so-loudly-liberal-ally-after-dobbs-leak-wall-shaking-book-claims.amp\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> days earlier. More than a week later, a search of New York Times articles using keywords \u201c<a href=\"https:\/\/www.nytimes.com\/search?dropmab=false&#038;endDate=2026-05-01&#038;lang=en&#038;query=Alito&#038;sort=newest&#038;startDate=2026-04-01&#038;types=article\" target=\"_blank\" rel=\"noreferrer noopener\">Alito<\/a>,\u201d \u201c<a href=\"https:\/\/www.nytimes.com\/search?dropmab=false&#038;endDate=2026-05-01&#038;lang=en&#038;query=Kagan&#038;sort=newest&#038;startDate=2026-04-01&#038;types=article\" target=\"_blank\" rel=\"noreferrer noopener\">Kagan<\/a>,\u201d \u201c<a href=\"https:\/\/www.nytimes.com\/search?dropmab=false&#038;endDate=2026-05-01&#038;lang=en&#038;query=Dobbs%20decision&#038;sort=newest&#038;startDate=2026-04-01&#038;types=article\" target=\"_blank\" rel=\"noreferrer noopener\">Dobbs decision<\/a>,\u201d and \u201c<a href=\"https:\/\/www.nytimes.com\/search?dropmab=false&#038;endDate=2026-05-01&#038;lang=en&#038;query=Mollie%20Hemingway&#038;sort=newest&#038;startDate=2026-04-01&#038;types=article\" target=\"_blank\" rel=\"noreferrer noopener\">Mollie Hemingway<\/a>\u201d on Friday morning revealed the outlet did not run a single headline on the explosive reporting between April 18 and May 1. There is, however, a headline from Wednesday smearing the conservative justices as \u201c<a href=\"https:\/\/www.nytimes.com\/2026\/04\/29\/opinion\/supreme-court-voting-rights-act-2026.html?searchResultPosition=6\" target=\"_blank\" rel=\"noreferrer noopener\">partisan<\/a>\u201d for their decision to effectively block unconstitutional racial gerrymandering. Notably, Hemingway\u2019s book is already an <a href=\"https:\/\/www.nytimes.com\/books\/best-sellers\/hardcover-nonfiction\/\" target=\"_blank\" rel=\"noreferrer noopener\">NYT bestseller<\/a>.<\/p>\n<p>A search for the same keywords in <a href=\"https:\/\/www.politico.com\/search?s=newest&#038;userInitiated=true&#038;q=kagan\" target=\"_blank\" rel=\"noreferrer noopener\">Politico<\/a>, <a href=\"https:\/\/www.cnn.com\/search?q=Alito&#038;from=0&#038;size=10&#038;page=1&#038;sort=newest&#038;types=all&#038;section=\">CNN<\/a>, and <a href=\"https:\/\/www.propublica.org\/?s=Alito&#038;fs%5Btaxonomy_pp_topic%5D%5B%5D=&#038;fs%5Brelative_date%5D%5B%5D=30\">ProPublica<\/a> revealed similar blackouts, although the censorship certainly goes far beyond them as well.<\/p>\n<h2>Targeted Hypocrisy<\/h2>\n<p>Although the media\u2019s suppression of this major story is unsurprising, it is an important reminder of how these outlets operate on a double standard that not only benefits a left-wing agenda, but ultimately seeks to undermine the integrity of the Supreme Court. Democrats and their media friends have spent decades unabashedly smearing Supreme Court justices who don\u2019t fit into their progressive molds. Within the last decade in particular, they have stopped at nothing, including disregarding common sense and reality, to smear them as predators, radicals, insurrectionists, or corrupt.<\/p>\n<p>For Trump nominee Justice Brett Kavanaugh, it was the egregious rape hoax. The media relentlessly peddled unsubstantiated, salacious claims during his confirmation hearings that Kavanaugh had committed sexual assault \u2014 even though there was <a href=\"https:\/\/thefederalist.com\/2019\/12\/02\/21-reasons-not-to-believe-christine-blasey-fords-claims-about-justice-kavanaugh\/\" target=\"_blank\" rel=\"noreferrer noopener\">no proof<\/a> he and his primary accuser actually ever met. Then came the allegations that, somehow, after \u201c<a href=\"https:\/\/thefederalist.com\/2020\/04\/16\/media-coverage-of-kavanaugh-was-criminal-heres-how-they-can-fix-it-going-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">favorably<\/a>\u201d going through six FBI background checks, the husband, father of two, and former D.C. Circuit judge was \u201cthe secret leader of an underage gang rape cartel that roamed the streets of suburban Maryland.\u201d Meanwhile, when Joe Biden, a presidential candidate at the time, was accused more credibly of sexual assault, outlets like the New York Times <a href=\"https:\/\/thefederalist.com\/2020\/04\/16\/media-coverage-of-kavanaugh-was-criminal-heres-how-they-can-fix-it-going-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">comparatively ignored it<\/a>.<\/p>\n<p>Mollie Hemingway helped expose the media for its role in perpetuating the hoax, although they have yet to be held accountable for their <a href=\"https:\/\/thefederalist.com\/2020\/04\/16\/media-coverage-of-kavanaugh-was-criminal-heres-how-they-can-fix-it-going-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">criminal conduct<\/a>. As Hemingway <a href=\"https:\/\/thefederalist.com\/2020\/04\/16\/media-coverage-of-kavanaugh-was-criminal-heres-how-they-can-fix-it-going-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">indicated<\/a>, the media\u2019s effort to derail the confirmation of the Trump appointee and ensure the allegations follow him around forever reveals their ultimate goal was not just to harm Kavanaugh but to undermine \u201can originalist understanding of the Constitution\u201d and \u201cdelegitimize the Supreme Court.\u201d<\/p>\n<p>This same goal is seen in how Clarence Thomas \u2014 who also endured questionable allegations against him during his confirmation back in the \u201990s \u2014 was dragged by propaganda outlet ProPublica for having a <a href=\"https:\/\/thefederalist.com\/2023\/04\/06\/propublica-exposes-clarence-thomas-he-has-a-rich-friend\/\" target=\"_blank\" rel=\"noreferrer noopener\">rich friend<\/a> or <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/propublica-smear-of-justice-thomas-reveals-a-partisan-double-standard-for-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">giving a perfectly normal speech<\/a> at a nonprofit. Or the subject of Hemingway\u2019s new book \u2014 Alito \u2014 who the <a href=\"https:\/\/www.nytimes.com\/2024\/05\/22\/us\/justice-alito-flag-appeal-to-heaven.html\" target=\"_blank\" rel=\"noreferrer noopener\">NYT<\/a> and <a href=\"https:\/\/www.politico.com\/news\/2024\/05\/18\/upside-down-flag-at-justice-alitos-home-another-blow-for-supreme-court-under-fire-00158772\" target=\"_blank\" rel=\"noreferrer noopener\">other outlets<\/a> painted as an insurrectionist following Jan. 6 because historic and otherwise widely flown flags were spotted at his private residences.<\/p>\n<p>To the Times, et al., the fact that Alito\u2019s wife flew an upside-down American flag at their Virginia home amid a tense standoff with a neighbor means the justice was prepared to overthrow the government. But Elena Kagan screaming at a colleague who was concerned about the safety of his co-justices is not news \u201cfit to print.\u201d<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Leftists launch &#8220;propaganda efforts and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/super-pac-backing-tim-scott-is-canceling-millions-of-dollars-in-tv-ads\/\" title=\"Tim Scott-supported Super PAC cancels TV ad spending worth millions.\">political campaign strategies<\/a> to go after any [Supreme Court] justice who they dislike&#8221; and undermine the integrity of the court, Mollie Hemingway noted <a href=\"https:\/\/t.co\/3yH7Byo8js\">pic.twitter.com\/3yH7Byo8js<\/a><\/p>\n<p>\u2014 The Federalist (@FDRLST) <a href=\"https:\/\/twitter.com\/FDRLST\/status\/2049232286986518996?ref_src=twsrc%5Etfw\">April 28, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>These outlets not-so-subtly seek to <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/alito-rejects-calls-to-recuse-himself-from-supreme-court-cases-because-of-flag-controversies\" target=\"_blank\" rel=\"noreferrer noopener\">pressure<\/a> originalist justices into <a href=\"https:\/\/www.nytimes.com\/2024\/05\/22\/us\/justice-alito-flag-appeal-to-heaven.html\" target=\"_blank\" rel=\"noreferrer noopener\">recusing<\/a> from <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/propublica-smear-of-justice-thomas-reveals-a-partisan-double-standard-for-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">particular cases<\/a> where leftists did not want them to rule a certain way. More specifically, as evidenced by the Kavanaugh hoax, their clear aim is to undermine conservative legal philosophy that seeks to uphold the Constitution.<\/p>\n<p>The <a href=\"https:\/\/twitter.com\/FDRLST\/status\/2049512176474349585\" target=\"_blank\" rel=\"noreferrer noopener\">double standard<\/a> with which the media treats the liberal and the conservative justices has perhaps never been more evident than now, when major outlets like The New York Times have apparently decided to completely ignore the explosive report that the liberal justices were willing to put their colleagues\u2019 lives at risk \u2014 seemingly for radical political reasons. But then again, why should we ever expect anything different from legacy media? After all, these same outlets were complicit in the \u201c<a href=\"https:\/\/x.com\/FDRLST\/status\/2049229001537782134\" target=\"_blank\" rel=\"noreferrer noopener\">horrific<\/a>\u201d fallout of the <em>Dobbs<\/em> leak, essentially cheering on the protests and the threats against a conservative majority brave enough to side with the Constitution over activism.<\/p>\n<hr>\n<p>      Maisey Jefferson is a staff editor at The Federalist.
