He argues that people born in the U.S. should be considered subject to U.S. jurisdiction only if at least one parent is a U.S. citizen\/national, a lawful permanent resident, or a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >legally authorized foreigner serving active duty<\/a> in the Armed Forces.<\/p>\n<p>The proposal follows a Trump executive order titled \u201cProtecting the meaning and value of American citizenship,\u201d which asserts that birthright citizenship should not extend to children born to parents who are in the country illegally or on a visa. That order is being challenged in the Supreme Court,where oral arguments began in April.<\/p>\n<p>Paul says the current interpretation allowing automatic citizenship regardless of parents\u2019 legal status is incorrect and contradicts the intent of the 14th Amendment. In Trump\u2019s order, \u201cProtecting the meaning and value of American citizenship,\u201d the president claimed that birthright citizenship in the U.S. through the 14th Amendment should not include children who were born in the U.S. but to parents who are in the country illegally or on a visa. The directive is being challenged in the Supreme Court. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4509805\/birthright-citizenship-first-supreme-court-test-100-years\/\">Oral arguments<\/a> for the case began in April. <\/p>\n<p>In announcing his proposed amendment, Paul agreed with Trump that such children should not be considered natural citizens of the U.S., nor was it the intention of \u201cthose who wrote the 14th Amendment.\u201d<\/p>\n<p>\u201cUnder current interpretations of American law, anyone born on American soil automatically becomes a U.S. citizen, regardless of whether the parent was here legally or not,\u201d Paul said in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/steve-scalise-blasts-biden-order-allowing-covid-vaccine-to-illegal-immigrants\/\" title=\"Steve Scalise Blasts Biden ... Allowing Covid Vaccine To Illegal Immigrants\">press release issued<\/a> by his office. \u201cThis is wrong and not at all the intent of those who wrote the 14th Amendment.\u201d <\/p>\n<p>The 14th Amendment was ratified on July 9, 1868, in response to the U.S. Civil War. It codified in the Constitution that rights and liberties enshrined in the Constitution also applied to former slaves, including U.S. citizenship.<\/p>\n<p>\u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,\u201d <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\">reads<\/a> the first section of the 14th Amendment. \u201cNo State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.\u201d<\/p>\n<p>Contemporary concerns regarding the citizenship clause of the 14th Amendment concern illegal immigrants in the country and their children who were born here. President Trump has moved to seal our border from illegal immigrants more than any other president. But we will have more to do.
