In earnest, the Times said if it\u2019s unconstitutional for colleges and universities to racially discriminate in their admissions process, it should also be illegal for immigration authorities to detain suspected aliens based on obvious indicators of foreign nationality.<\/p>\n<p>In a video editorial, the Times said <a href=\"https:\/\/www.nytimes.com\/2026\/04\/29\/opinion\/ice-racial-profiling-supreme-court.html\" target=\"_blank\" rel=\"noreferrer noopener\">on Wednesday<\/a> that the Supreme Court \u201cneeds to address its contradictory rulings\u201d on the separate issues, \u201cotherwise millions of people will continue to live in fear of their own government.\u201d Using two different subjects who were detained by Immigration and Customs Enforcement (ICE) last year, the paper said authorities had \u201cno clear reason to approach [them] other than, it seems, the color of their skin.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1544656817\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>This is, predictably as ever, untrue. One of the subjects, Juana (\u201cJuanita\u201d) Avila, is literally a Guatemalan woman who, while permitted to reside in the U.S. legally, was apprehended while trying to <a href=\"https:\/\/innovationlawlab.org\/sites\/default\/files\/2026-01\/MJMA%20Dkt%2063%20Declaration%20of%20Juana%20Avila.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">retrieve the car<\/a> of a suspected alien who had been taken into ICE custody. If an actual foreign national, associated with an alien, and whose professed first language is Spanish, can\u2019t be reasonably suspected of also being in the country unlawfully, there\u2019s no point to immigration law enforcement (which, by the way, is exactly what Democrats and The New York Times want).<\/p>\n<p>The Department of Homeland Security, which oversees ICE, said in a statement to The Federalist that Avila \u201cbit and attacked\u201d an agent during her stop. \u201cUpon identifying Avila, law enforcement officers learned she had legal status in the U.S., and she was released.\u201d<\/p>\n<p>The other subject in the Times video, Javier Ramirez, was detained for <a href=\"https:\/\/www.nytimes.com\/2025\/09\/29\/us\/trump-immigration-agents-us-citizens.html\" target=\"_blank\" rel=\"noreferrer noopener\">haranguing officers<\/a> who were engaged in law enforcement operations at a car lot east of Los Angeles. He admits in the Times video that when officers subdued him to the ground, \u201cI was trying to move from it.\u201d The reason for his resistance, he says, is that \u201cI remember the video of George Floyd, and I\u2019m like, I don\u2019t wanna die.\u201d It\u2019s not clear whether, like Floyd, Ramirez called for his \u201cmomma,\u201d was high on fentanyl, or had tried stealing from a convenience store at any point prior to this altercation. In any event, it\u2019s worth repeating that resisting arrest is both dangerous and a crime, even when the suspect is having flashbacks to <a href=\"https:\/\/thefederalist.com\/2022\/10\/19\/if-what-kanye-west-said-about-george-floyd-is-crazy-wrong-the-corrupt-media-wouldnt-have-to-lie-about-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">a drug addict who died<\/a> while doing the same thing.<\/p>\n<p>DHS said in a statement that Ramirez \u201cwas arrested for\u00a0obstructing law enforcement \u2014 a felony and federal crime\u201d and that he was released on bond.<\/p>\n<p>What any of this has to do with the Supreme Court\u2019s 2023 <a href=\"https:\/\/thefederalist.com\/2023\/06\/29\/scotus-rules-race-based-college-admissions-violate-the-14th-amendment-ending-affirmative-action\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> that it\u2019s unconstitutional for higher education institutions to racially discriminate when admitting students is anyone\u2019s guess. The high court has stayed a court decision that would prohibit immigration authorities from stopping and questioning suspected illegal aliens based on accents, language, geographic location, and other factors. Under that guidance, a black woman who speaks fluent English in New York City is almost certain to never be detained by ICE. But a man with a dark complexion in Brownsville, Texas, and who greets officers with \u201chola\u201d might have different odds. That\u2019s reality.<\/p>\n<p>The reality is also that Americans are getting <a href=\"https:\/\/thefederalist.com\/2026\/04\/15\/a-drunk-illegal-alien-allegedly-killed-two-young-boys-with-his-car-but-corporate-media-couldnt-care-less\/\" target=\"_blank\" rel=\"noreferrer noopener\">killed<\/a>, <a href=\"https:\/\/thefederalist.com\/2025\/05\/09\/theres-no-sanctuary-for-family-of-woman-allegedly-killed-by-illegal-alien\/\" target=\"_blank\" rel=\"noreferrer noopener\">murdered<\/a>, and <a href=\"https:\/\/thefederalist.com\/2018\/08\/08\/illegal-immigrant-philly-refused-to-hand-over-to-the-feds-raped-a-child\/\" target=\"_blank\" rel=\"noreferrer noopener\">raped<\/a> because of the immigration problem created by the last administration. Democrats and the dying news media are just fine with that, so long as it helps them win elections. That doesn\u2019t mean the rest of us have to be. If a few Latinos are inconvenienced while the current administration tries to clean up this mess, that will be the least of America\u2019s problems.<\/p>\n<hr class=\"wp-block-separator\">\n<div
