Jean Carroll\u2019s allegation that he sexually abused her.<\/p>\n<p>This week, the 2nd U.S. Circuit Court of Appeals rejected Trump\u2019s request to rehear his appeal \u201cen banc\u201d (before the full court). She won a first case for $5 million in 2023 and a second case for more than $83 million under New York\u2019s adult Survivors Act. The first <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3796921\/appeals-court-upholds-e-jean-carroll-defamation-judgment-trump\/\">was in September 2025<\/a>, when the 2nd Circuit rejected Trump\u2019s argument that he was entitled to presidential immunity for the statements he made denying Carroll\u2019s accusation. This time around, Trump tried unsuccessfully to substitute the United States as a defendant in the case.<\/p>\n<div class=\"article-paywall\">\n<p>\u201cThe fact of the matter is that no other defendant would be permitted to move to substitute the United States in his place, fifteen months after trial and the entry of judgment against him,\u201d Judge Denny Chin wrote in a 34-page statement supporting the court\u2019s decision to dismiss Trump\u2019s appeal for the second time on Wednesday. \u201cThe Court appropriately declined to convene en banc to revisit this issue.\u201d<\/p>\n<p>Carroll has brought two lawsuits against Trump, both of them regarding defamation over her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotland-yard-closes-case-against-prince-andrew-after-reviewing-sex-assault-claims\/\" title=\"Scotland Yard Closes Case Against Prince Andrew After Reviewing Sex Assault ...\">sexual abuse claims<\/a>. The president has denied all her claims, arguing that the timing of her accusation was suspicious and helped promote her book tour. Trump has also claimed Carroll has lied about key evidence, including <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.breitbart.com\/politics\/2024\/01\/25\/report-dress-e-jean-carroll-claims-she-wore-during-alleged-trump-assault-did-not-exist-time\/\">the dress<\/a> she said she was wearing at the time of the alleged assault.<\/p>\n<p>\u201cE. Jean Carroll was forced to change her story about her \u2018dress\u2019 when Donna Karan, the designer of the dress, said that it wasn\u2019t conceived or manufactured until long after the date in question,\u201d Trump wrote in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111814756905837280\">2024 post to Truth Social<\/a>. \u201cIn other words, the Monica Lewinsky type gambit failed badly, then also learning that there was ZERO EVIDENCE on the dress, despite all of the threats. All of this HOAX run and funded by Political Operatives!!!\u201d<\/p>\n<p>Carroll filed the first lawsuit in 2019 and secured a $5 million victory in a 2023 court decision. She filed the second lawsuit in 2022, making additional claims under New York\u2019s Adult Survivors Act. She won that case as well, winning herself over $83 million.<\/p>\n<p>Trump has appealed both verdicts.
