Doe** and **Trump v.Miot**, two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bessent-says-hell-have-ringside-seat-at-scotus-tariff-hearing\/\" title=\"Bessent says he\u2019ll have \u2018ringside seat\u2019 at SCOTUS tariff hearing\">consolidated cases challenging<\/a> the Trump administration\u2019s attempt to end **Temporary Protected Status (TPS)** for **about 6,000 Syrians** and **about 350,000 haitians**.Lower courts previously blocked the terminations, and the justices are now considering weather TPS rulings that are described as \u201ctemporary\u201d can effectively be changed or withdrawn in ways courts must review.<\/p>\n<p>The Trump administration argued that a **jurisdiction-stripping provision** in the Immigration and Nationality act bars courts from reviewing DHS decisions about **designating, terminating, or extending** TPS, including earlier steps leading to those determinations. Several justices-including **Ketanji Brown Jackson** and **Sonia Sotomayor**-pressed on what, if anything, remains reviewable, while **elena Kagan** focused on how the administration\u2019s required country-condition assessments and consultation obligations fit within the \u201cno judicial review\u201d argument.<\/p>\n<p>Questions from conservative justices also targeted the challengers\u2019 legal theories and the reasoning offered for alleged discriminatory motives. During questioning of the attorneys for the respondents, the court probed the scope of permissible procedural review (for example, review of whether required consultation or information-gathering occurred) versus review of the underlying substance of decisions about country conditions.<\/p>\n<p>A ruling is expected later in the court\u2019s term, with the **decision anticipated in late June or early july**.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court is gearing up to effectively decide whether temporary status for hundreds of thousands of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/multiple-nations-urge-citizens-to-evacuate-lebanon-as-iranian-terrorists-escalate-attacks-on-israel\/\" title=\"Nations urge citizens to leave Lebanon due to escalating Iranian attacks on Israel.\">foreign nationals residing<\/a> in the United States is actually temporary. <\/p>\n<p>The high court held <a href=\"https:\/\/www.c-span.org\/program\/public-affairs-event\/justices-review-termination-of-temporary-protected-status-for-haitians-syrians\/676931\" target=\"_blank\" rel=\"noreferrer noopener\">oral arguments<\/a> on Wednesday in a pair of consolidated cases known as <em>Mullin v. Doe<\/em> and <em>Trump v. Miot<\/em>, which center around Trump\u2019s revocation of <a href=\"https:\/\/www.uscis.gov\/humanitarian\/temporary-protected-status#Countries%20Currently%20Designated%20for%20TPS\" target=\"_blank\" rel=\"noreferrer noopener\">Temporary Protected Status (TPS)<\/a> for <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-deportation-protections-syrians-haitians\/\" target=\"_blank\" rel=\"noreferrer noopener\">approximately<\/a> 6,000 Syrian and 350,000 Haitian nationals, respectively. Both groups of migrants are currently living in America under the TPS program, which <a href=\"https:\/\/thefederalist.com\/2026\/02\/10\/9th-circuit-rules-dhs-can-ax-temporary-protected-status-for-60k-foreign-nationals\/\" target=\"_blank\" rel=\"noreferrer noopener\">may be used<\/a> by the executive branch to offer temporary residency to foreign nationals from countries experiencing natural disasters, violent conflicts, and other \u201cextraordinary and temporary conditions.\u201d<\/p>\n<p>The Trump administration\u2019s efforts to end TPS for the aforementioned groups were <a href=\"https:\/\/thefederalist.com\/2025\/09\/30\/the-federalists-guide-to-the-2025-supreme-court-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">halted<\/a> by lower courts. This was done despite SCOTUS <a href=\"https:\/\/thefederalist.com\/2026\/03\/16\/scotus-to-hear-arguments-on-trumps-bid-to-end-temporary-status-for-foreign-nationals\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously pausing<\/a> similar injunctions in a separate TPS case involving Venezuelan nationals. <\/p>\n<p>Arguing on behalf of the Trump administration, U.S. Solicitor General John Sauer <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2025\/25-1083_k5fm.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">contended<\/a> that a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1254a\" target=\"_blank\" rel=\"noreferrer noopener\">provision<\/a> within the Immigration and Nationality Act that governs TPS prohibits any form of judicial review \u201cof any determination by the [DHS] secretary with respect to the designation or termination or extension of a designation of a foreign state for Temporary Protected Status.\u201d <\/p>\n<p>\u201cThat provision means what it says \u2026  [and] bars judicial review of both the secretary\u2019s ultimate decision whether to designate, extend, or terminate, and of each antecedent step along the way to that determination,\u201d said Sauer, who added that \u201ceven if [challengers\u2019] claims are not barred [by judicial review], they are meritless.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-solicitor-general-nom-may-have-to-recuse-self-from-harvard-affirmative-action-case\/\" title=\"Biden\u2019s Solicitor General Nom May Have To Recuse Self From Harvard Affirmative Action ...\">solicitor general\u2019<\/a>s biggest pushback came from the court\u2019s more outspoken Democrat appointees. <\/p>\n<p>Associate Justice Ketanji Brown Jackson kicked off the inquisition by pressing Sauer on what, if any, executive actions regarding TPS are reviewable by federal courts. The Biden appointee\u2019s back-and-forth with the solicitor general ultimately prompted Associate Justice Sonia Sotomayor to join the fray and pile on with questions about the scope of judicial review as it relates to the TPS program. <\/p>\n<p>Sotomayor\u2019s refusal to allow Sauer to respond one of her queries on the issue prompted Chief Justice John Roberts to interject and permit Sauer to answer. It was sometime after this exchange in which Sotomayor and Jackson referenced President Trump\u2019s <a href=\"https:\/\/amzn.to\/3YuVZYV\" >past \u201csh-thole countries\u201d remarks<\/a> to push the narrative that, as the former put it, \u201ca discriminatory purpose may have played a part\u201d in the administration\u2019s decision to end TPS for the various groups in question. <\/p>\n<p>Associate Justice Elena Kagan took a more sober-minded approach, pressing Sauer about his argument that \u201call the things that the statute says that the secretary is supposed to do in order to determine country conditions are unreviewable.\u201d She also probed him about whether, under his view, the secretary is required to consult with relevant administration officials about a country\u2019s conditions before taking specific actions on TPS, as well as the substance of that consultation. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Justices Sonia Sotomayor and Ketanji Brown Jackson invoke Trump&#8217;s comments on &#8220;sh*thole countries&#8221; and &#8220;they&#8217;re eating the dogs&#8221; as having some bearing on whether he can end temporary amnesty for Haitians.<\/p>\n<p>An increasingly exasperated Solicitor General John Sauer explains to them\u2026 <a href=\"https:\/\/t.co\/CQNwA2YzJT\">pic.twitter.com\/CQNwA2YzJT<\/a><\/p>\n<\/div>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/2049507126955901141?ref_src=twsrc%5Etfw\">April 29, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Sauer also fielded questions from several of the court\u2019s Republican appointees. <\/p>\n<p>While Associate Justice Clarence Thomas asked if Congress possesses the power to limit TPS regulations if the executive \u201chas constitutional authority to do this in a discretionary way,\u201d Roberts questioned whether Sauer\u2019s argument amounts to a \u201csignificant expansion\u201d of the court\u2019s holding in <em><a href=\"https:\/\/www.oyez.org\/cases\/2017\/17-965\" target=\"_blank\" rel=\"noreferrer noopener\">Trump v. Hawaii<\/a><\/em>  (2018). That was the case in which a majority effectively upheld Trump\u2019s travel restrictions on several countries. <\/p>\n<p>Meanwhile, Associate Justice Amy Coney Barrett pressed the solicitor general on respondents\u2019 \u201cprocedural objection\u201d argument and what \u201cstandards a court would apply when reviewing the sufficiency of the consultation\u201d issue if the court were to rule against the government\u2019s argument that the matter is not subject to judicial review. Associate Justice Brett Kavanaugh, on the other hand, asked Sauer to \u201cexplain the reasons why Congress would have barred judicial review as broadly\u201d as he claimed. <\/p>\n<p>The conservative justices\u2019 more pressing concerns, however, seemingly came during their questioning of the attorneys representing the respondents, Ahilan Arulanantham (Syrian case) and Geoffrey Pipoly (Haitian case). <\/p>\n<p>Both lawyers argued that the legal provisions governing TPS do not bar courts from reviewing an administration\u2019s actions on the program and that the government is required to undertake certain steps (ex. consultation and assessment of a country\u2019s conditions) before implementing such policies. They further claimed that the Trump administration did not adhere to this purported process, with Pipoly separately arguing that the president\u2019s decision to end TPS for Haitians was racially motivated.<\/p>\n<p>Thomas extensively probed Arulanantham and (to a lesser extent) Pipoly on how they interpret the statute at hand\u2019s \u201cjurisdiction-stripping provision.\u201d The Bush 41 appointee\u2019s questioning of the latter led Roberts to ask the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-taps-sanctuary-city-supporter-to-oversee-ice-prosecutions\/\" title=\"Biden Taps \u2018Sanctuary City\u2019 Supporter To Oversee ICE Prosecutions\">left-wing attorney<\/a> if whether, \u201cmore generally, there was anything [Arulanantham] said that you disagree with,\u201d to which Pipoly replied, \u201cNo.\u201d<\/p>\n<p>In her questioning of Arulanantham, Barrett posed a hypothetical in which a DHS secretary decides to terminate TPS for Syria even after she consulted with members of the State Department, who told her that conditions in the country \u201cremain terrible.\u201d Testing how far challengers\u2019 argument would go, the Trump appointee asked if such a decision could be reviewed by courts. <\/p>\n<p>Arulanantham acknowledged that they \u201ccould not challenge on the ground that [the secretary] is wrong and the State Department is right\u201d but added that \u201cwhat is reviewable is whether she actually asks anything and gets any information about country conditions.\u201d The response prompted Barrett to pose a question highlighting the absurdity of such a standard. <\/p>\n<p>\u201cIs this going to get you very much? I mean, if it\u2019s just kind of a box-checking exercise, I mean, why would Congress permit review of the procedural aspect when, really, what everybody cares about much more is the substance?\u201d Barrett asked. <\/p>\n<p>Another particularly notable moment occurred when Kagan was questioning Pipoly about how he squares his claims that the president\u2019s termination of TPS for Haitians is racially motivated with the notion that TPS programs are being revoked \u201cacross the board.\u201d The left-wing attorney circled back to the previously cited Trump comments to subsidize his argument \u2014 which Jackson eagerly piled onto. <\/p>\n<p>The argument didn\u2019t appear to sit well with Associate Justice Samuel Alito, who interjected and <a href=\"https:\/\/x.com\/BreitbartNews\/status\/2049523641616941236?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E2049523641616941236%7Ctwgr%5Ed8a8a656b80c46355561bd5978ad497cb01a0421%7Ctwcon%5Es1_c10&#038;ref_url=https%3A%2F%2Fthefederalist.com%2Fwp-admin%2Fpost.php%3Fpost%3D374197action%3Dedit\" target=\"_blank\" rel=\"noreferrer noopener\">forcefully challenged<\/a> the attorney on his claims.<\/p>\n<p>\u201cI don\u2019t like dividing up the people of the world arbitrarily into three racial groups, but you \u2026 say [the groups whose TPS is being revoked are] all non-white,\u201d Alito said. \u201cBut do you think that \u2026 if you put Syrians, Turks, Greeks, and other people who live around the Mediterranean in a lineup, do you think you could say \u2026 that all of them, are they all non-white?\u201d<\/p>\n<p>The Bush 43 appointee also expressed concerns about the potential consequences arising from Arulanantham\u2019s judicial review arguments.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>An attorney for Haitians says the only reason Trump ended TPS for migrants from a variety of nations is that they&#8217;re non-white<\/p>\n<p>Justice Samuel Alito trips him up asking whether Syrians, Greeks, and &#8220;southern Italians&#8221; are white<\/p>\n<p>&#8220;You have a really large definition of who&#8217;s white\u2026 <a href=\"https:\/\/t.co\/XAdhJqsCX0\">pic.twitter.com\/XAdhJqsCX0<\/a><\/p>\n<\/div>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/2049523641616941236?ref_src=twsrc%5Etfw\">April 29, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Associate Justice Neil Gorsuch also appeared skeptical of Arulanantham and Pipoly\u2019s arguments. <\/p>\n<p>A decision in <em>Mullin v.
