More on them in a moment.<\/p>\n<p>On Wednesday, the Supreme Court <a href=\"https:\/\/www.westernjournal.com\/breaking-supreme-court-rules-6-3-drawing-congressional-districts-based-race-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> one of the most important judicial decisions in American history.<\/p>\n<p>In the case of Louisiana v. Callais et al. (\u201cCallais\u201d), SCOTUS <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-109_21o3.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> by a 6-3 majority that Louisiana\u2019s new congressional map based on \u201cracial gerrymandering\u201d violated the Constitution, a decision that one user on the social media platform X called a \u201cgame changer\u201d from a political perspective.<\/p>\n<p>Louisiana drew a new congressional map in 2022. Such districts presumably ensure that more racial minorities win elections to the House of Representatives.<\/p>\n<p>Indeed, in response to the federal judge\u2019s ruling, Louisiana drew another <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-some-democrats-concerned-their-voting-rights-bill-might-be-racist\/\" title=\"Report: Some Democrats Concerned Their \u2018... Rights\u2019 Bill Might Be Racist\">majority-minority district<\/a> in a congressional map named \u201cSB8.\u201d<\/p>\n<p>According to the case syllabus, SCOTUS decided that \u201cthe time had come to resolve whether compliance with the Voting Rights Act can indeed provide a compelling reason for race-based districting.\u201d<\/p>\n<p>In short, SCOTUS held that \u201c[b]ecause the Voting Rights Act did not require Louisiana to create an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/louisiana-congressional-map-fight-tests-supreme-courts-racial-gerrymandering-rules\/\" title=\"Supreme ...&#039;s racial gerrymandering rules tested in ... ... dispute.\">additional majority-minority district<\/a>, no compelling interest justified the State\u2019s use of race in creating SB8, and that map is an unconstitutional racial gerrymander.\u201d<\/p>\n<p>Justice Samuel Alito wrote the majority opinion. Chief Justice John Roberts joined in the opinion, as did Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. The three liberal judges \u2014 Justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson \u2014 dissented.<\/p>\n<p>\u201cCorrectly understood, \u00a72 does not impose liability at odds with the Constitution, and it should not have imposed liability on Louisiana for its 2022 map,\u201d Alito wrote. \u201cCompliance with \u00a72 thus could not justify the State\u2019s use of race-based redistricting here.\u201d<\/p>\n<p>Of course, legal scholars and political commentators alike recognized the decision\u2019s significance.<\/p>\n<p>\u201cWhile the majority did not find Section 2 unconstitutional, it has delivered a major victory for the Administration and those opposed to racial criteria in redistricting,\u201d law professor and legal analyst Jonathan Turley wrote on X.<\/p>\n<blockquote class=\"twitter-tweet\" data-conversation=\"none\">\n<p dir=\"ltr\" lang=\"en\">\u2026While the majority did not find Section 2 unconstitutional, it has delivered a major victory for the Administration and those opposed to racial criteria in redistricting. Callais. While not overturning section 2 of the VRA, it construes it into near-irrelevance. He also served as vice president of the United States during President James Madison\u2019s second term.<\/p>\n<p>As governor of Massachusetts in 1812, Gerry signed a bill that created a strange, salamander-looking congressional district. Designed to give his own party an advantage, the bill came under heavy criticism, and the practice thereafter became known as \u201cgerrymandering.\u201d<\/p>\n<p>Nearly a century later, in 1892, civil rights activist Homer Plessy, a man of one-eighth African descent, boarded a whites-only Louisiana railroad car with the express purpose of being arrested and subsequently challenging one of the state\u2019s segregation statutes in federal court.<\/p>\n<p>Four years later, SCOTUS upheld those segregation statutes in the infamous 1896 Plessy v. Ferguson case.<\/p>\n<p>Why now, therefore, will the ghosts of Gerry and Plessy haunt us?<\/p>\n<p>From Gerry, we derived the insidious practice of drawing <a href=\"https:\/\/www.westernjournal.com\/supreme-court-gives-republicans-much-needed-redistricting-win-texas-ruling\/\" target=\"_blank\" rel=\"noopener\">congressional districts<\/a> for partisan advantage.<\/p>\n<p>In the Plessy decision, SCOTUS affirmed the constitutionality of <a href=\"https:\/\/amzn.to\/3YuVZYV\" >state laws requiring separate accommodations<\/a> for people of different races.<\/p>\n<p>Of course, in Brown v. Board of Education (1954), SCOTUS overturned the substance of the Plessy decision. It is not the specific ruling that will haunt us, but the poisonous notion, never stricken from the public mind, that skin color may inform decisions about resources, privileges, and the like.<\/p>\n<p>From that notion comes the morally indefensible practice of drawing congressional districts for people of different complexions.<\/p>\n<p>Unfortunately, the twin practices of gerrymandering and race-based representation have existed long enough for Americans to get used to them.<\/p>\n<p>Moreover, they have existed long enough that Democrats regard majority-minority districts as consistent with civil rights. And it goes without saying that Democrats see their political prospects harmed by the Callais decision.<\/p>\n<p>Had we done away with gerrymandering long ago, and had SCOTUS never legitimized \u201cseparate but equal,\u201d modern Americans would never tolerate race-based congressional districts. As it stands, however, we do.<\/p>\n<p>After Callais, we can tolerate those districts no longer.<\/p>\n<p>Thus, based on what we have <a href=\"https:\/\/www.westernjournal.com\/fbi-assassins-messages-reveal-kavanaugh-wasnt-justice-hit-list\/\" target=\"_blank\" rel=\"noopener\">seen from Democrats<\/a> in recent years, we cannot discount Langman\u2019s prediction.
