Doe* and *Trump v.Moit*, asked whether federal law permits courts to review the president\u2019s decision to end TPS. In the Haiti case, a lower court had blocked the revocation, alleging it was unlawfully motivated by discriminatory statements and intent tied to then-Homeland Security Secretary Kristi Noem and Trump.<\/p>\n<p>Sotomayor emphasized Trump\u2019s remarks describing Haiti in highly derogatory terms and comparing it to largely <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-k-race-report-says-country-is-a-relatively-open-society-not-rigged-against-ethnic-minorities\/\" title=\"U.K. Race Report Says ... Is \u2018A Relatively Open Society,\u2019 Not \u2018Rigged Against Ethnic Minorities\u2019\">white-majority countries<\/a>, arguing those comments could fit the Court\u2019s standard for discriminatory purpose from *Arlington Heights v. Metropolitan Housing*. Jackson pressed Sauer on further Trump language about immigrants \u201cpoisoning the blood\u201d and having \u201cbad genes,\u201d and also allegations about Haitians eating pets, contending this context points to racial animus under TPS law.<\/p>\n<p>Sauer argued the administration\u2019s position does not rely on race-based epithets and that the statements cited do not demonstrate the kind of racial motivation required to make the decision unlawful. Despite the justices\u2019 concerns-especially from Sotomayor and Brown Jackson-the overall tone suggested the Court may be inclined to allow the termination of TPS, potentially with only limited judicial review of the process. Doe<\/em> and <em>Trump v. And where he complained that the United States takes people from such countries instead of people from Norway, Sweden, or Denmark, where he declared illegal immigrants, which he associated with TPS, as poisoning the blood of America.<\/p>\n<p>\u201cI don\u2019t see how that one statement is not a prime example of the <em>Arlington<\/em> example at work and showing that a discriminatory purpose may have played a part in this decision,\u201d Sotomayor said, invoking the high court\u2019s standard for racial animus, which needs racism to be a motivating factor behind an action in order for it to be unlawful, set in a 1977 ruling <em>Arlington Heights v. Metropolitan Housing<\/em>.<\/p>\n<p>Sauer responded that the statements did not include race. Sotomayor pushed back by claiming that Trump\u2019s comparison of Haiti unfavorably to white-majority countries, such as Sweden, gets close to the <em>Arlington<\/em> standard for showing racial animus.<\/p>\n<p>Jackson then pressed Sauer on Trump\u2019s comments on illegal immigrants \u201cpoisoning the blood\u201d of the country and their \u201cbad genes,\u201d asking how that is not evidence of unlawful racial animus against Haitians in the U.S. under TPS.<\/p>\n<p>\u201cThe position of the United States is that we have to have an actual racial epithet, that we aren\u2019t allowed to look at all the context to include the president\u2019s insistence that immigrants from certain countries, largely if not almost exclusively countries with black African immigrants, are not allowed and calling these sorts of names and the types of things he said about Haiti,\u201d Jackson said.<\/p>\n<p>\u201cAt the same time that it is the policy of the United States to encourage and welcome immigrants from places like Norway and Denmark and white South Africans,\u201d Jackson said. \u201cYour view is that it\u2019s not appropriate for the court to take into account that kind of evidence or the context in which all of this is happening?\u201d<\/p>\n<p>Jackson also asked about Trump\u2019s comments alleging Haitian migrants were eating pets, along with other names he has called them.
