The dispute traces back to an investigation and subpoena issued by Attorney General Matthew Platkin, which First Choice said aimed to pressure the institution into disclosing donor identities and contact information-information the donors and the center argued is protected under the First Amendment\u2019s associational rights.<\/p>\n<p>The Court ruled that First Choice had shown a present First Amendment injury despite lower courts treating the matter as premature. Justice Neil Gorsuch, writing for the majority, emphasized that the state\u2019s conduct resurrected a pattern of government demands that burden protected speech and association. The decision did not decide the underlying merits but sent the case back with the question framed in a way that rejects the lower courts\u2019 reluctance to hear it.<\/p>\n<p>Supporters of the center celebrated the decision as a confirmation that states cannot retaliate against or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-life-pregnancy-center-gets-last-laugh-after-brutal-firebombing-what-they-meant-for-evil-god-used-for-good\/\" title=\"... The ruling was also framed by related advocates as part of a broader trend of \u201clawfare\u201d and government or activist pressure against pregnancy centers, including misleading campaigns and other efforts in states with Democratic officials.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A New Jersey-based pro-life pregnancy center may proceed with its federal challenge to lawfare waged against it by the state\u2019s Democrat attorney general, the Supreme Court unanimously ruled in a <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-781_pok0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">25-page decision<\/a> on Wednesday.<\/p>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/09\/30\/the-federalists-guide-to-the-2025-supreme-court-term\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, <em>First Choice Women\u2019s Resource Centers, Inc. v. Platkin<\/em> came about when New Jersey\u2019s Democrat-run government began investigating First Choice Women\u2019s Resource Centers over seemingly baseless concerns that it was misleading its donors and misrepresenting its services. This investigation culminated in then-Attorney General Matthew Platkin\u2019s office issuing First Choice a subpoena in an attempt to strong-arm the nonprofit into doxxing its donors and forfeiting information to a state with a strong abortion activism agenda. <\/p>\n<p>As Justice Neil Gorsuch noted in his majority opinion, the New Jersey Division of Affairs nor the Attorney General\u2019s office documented any complaints against First Choice despite the state\u2019s attempts to solicit them from alleged \u201cvictim[s] of fraudulent, deceptive, misleading, or unlawful conduct.\u201d Yet, Platkin pursued a 2023 subpoena against the pregnancy center that demanded it \u201cdisclose documents reflecting the names, phone numbers, addresses, and places of employment of all individuals\u201d who donated to the nonprofit outside of First Choice\u2019s webpage.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/12\/02\/justice-thomas-dismantles-new-jerseys-lawfare-against-pro-life-center-with-a-single-question\/\" target=\"_blank\" rel=\"noreferrer noopener\">Justice Thomas Dismantles New Jersey\u2019s Lawfare Against Pro-Life Center With A Single Question<\/a>]<\/strong><\/p>\n<p>First Choice <a href=\"https:\/\/fedsoc.org\/events\/courthouse-steps-preview-first-choice-women-s-resource-centers-inc-v-platkin\" target=\"_blank\" rel=\"noreferrer noopener\">tried<\/a> to challenge the subpoena in a federal district court, citing concerns about sharing \u201cconstitutionally protected\u201d materials. The pregnancy center\u2019s donors also acknowledged across two declarations that they were nervous about New Jersey\u2019s \u201crecord of hostility toward pro-life groups\u201d and \u201cwould have been less likely to donate to First Choice if we had known information about the donation might be disclosed,\u201d signaling the state\u2019s chilling attempts to injure their First Amendment rights.   <\/p>\n<p>First Choice\u2019s plea, however, was ultimately dismissed for a state court to handle. In December 2024, the 3rd Circuit similarly held that a federal court should not weigh in until state proceedings concluded. <\/p>\n<p>In his majority opinion, Gorsuch was careful to note that the high bench was not ruling on the merits of the case. Instead, he determined that \u201cFirst Choice has established a present injury to its First Amendment associational rights,\u201d contrary to the rulings of lower courts.<\/p>\n<p>\u201cSince the 1950s, this Court has confronted one official demand after another like the Attorney General\u2019s. Over and again, we have held those demands burden the exercise of First Amendment rights. Disputing none of these precedents but seeking ways around them, the Attorney General has offered a variety of arguments. Some are old, some are new, but none succeeds,\u201d Gorsuch concluded. <\/p>\n<p>Alliance Defending Freedom counsel Erin Hawley, who argued the case, celebrated the decision as a \u201cresounding victory.\u201d<\/p>\n<p>\u201cIn this resounding victory, the Supreme Court held to its long-standing precedent of recognizing that the Constitution protects First Choice and its donors from demands by a hostile state official to disclose donor identities and contact information,\u201d Hawley said in a statement. \u201cNew Jersey\u2019s attorney general targeted First Choice \u2014 a ministry that provides parenting classes, free ultrasounds, baby clothes, and more to its community \u2014 simply because of its pro-life views. That is blatantly unconstitutional. Should the Attorney General continue these efforts on remand, we look forward to presenting First Choice\u2019s case in federal court.\u201d<\/p>\n<p>First Choice is one of many pregnancy centers facing <a href=\"https:\/\/thefederalist.com\/tag\/pregnancy-centers\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawfare and attacks<\/a> from Democrat officials and activists. <\/p>\n<p>In 2024, for example, Massachusetts\u2019 leftist-led government <a href=\"https:\/\/thefederalist.com\/2024\/07\/09\/massachusetts-state-government-rolls-out-misleading-anti-pregnancy-center-campaign\/\" target=\"_blank\" rel=\"noreferrer noopener\">rolled out<\/a> a misleading ad campaign targeting pro-life centers and encouraging women to \u201cavoid\u201d them. Several billboards erected as part of the campaign accused the facilities of \u201c\u2019mislead[ing] you about your options if you\u2019re pregnant\u2019 because these organizations do not provide <a href=\"https:\/\/thefederalist.com\/2024\/03\/19\/popping-abortion-pills-is-way-more-dangerous-than-big-pharma-wants-women-to-know\/\" target=\"_blank\" rel=\"noreferrer noopener\">dangerous<\/a> and <a href=\"https:\/\/thefederalist.com\/2024\/02\/16\/leftists-say-they-dont-like-late-term-abortions-but-then-lament-they-cant-kill-more-babies-after-34-weeks\/\" target=\"_blank\" rel=\"noreferrer noopener\">deadly<\/a> <a href=\"https:\/\/thefederalist.com\/2022\/10\/03\/abortion-is-not-safer-than-childbirth-heres-the-data-the-left-wants-to-hide\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion<\/a> <a href=\"https:\/\/thefederalist.com\/2024\/05\/06\/prolifers-sue-indiana-for-records-that-reveal-abortionist-atrocities\/\" target=\"_blank\" rel=\"noreferrer noopener\">services<\/a>,\u201d as Monroe Harless wrote in these pages. <\/p>\n<p>Wednesday\u2019s high court ruling also received favorable praise from Charlotte Lozier Institute Executive Director Karen Czarnecki.
