Musk agreed to limit his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/china-updates-child-policy-amid-population-growth-worries\/\" title=\"China Updates Child Policy Amid Population Growth Worries\">social media commentary<\/a>, and Altman and OpenAI\u2019s leadership made similar commitments.<\/p>\n<p>The case is being heard in Oakland,with opening statements delivered after jury selection.Even though a nine-person jury will issue an advisory verdict, the judge-Yvonne Gonzalez rogers-will make the final decision, as she has in other <a href=\"https:\/\/amzn.to\/3YuVZYV\" >major technology company disputes<\/a>.<\/p>\n<p>Musk\u2019s lawsuit alleges Altman and OpenAI shifted away from the company\u2019s nonprofit mission after OpenAI expanded into a for-profit structure. He is asking the court to remove Altman from the board and reverse OpenAI\u2019s for-profit status. Altman and OpenAI President Greg Brockman agreed to do the same.<\/p>\n<p>\u201cI could have started OpenAI as a for-profit corporation,\u201d Musk wrote on X the day the trial started. \u201cInstead, I started it, funded it, recruited critical talent and taught them everything I know about how to make a startup successful FOR THE PUBLIC GOOD. Then they stole the charity.\u201d<\/p>\n<p>Opening statements from both sides were heard on Tuesday at the federal courthouse in Oakland after jury selection the day before.<\/p>\n<p>A nine-person jury will deliver a verdict, but unlike other trials, the jurors merely serve an advisory role here. The final decision will be determined by Rogers, who often oversees high-profile lawsuits involving <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/technology\/\" type=\"post_tag\" id=\"11416\">technology<\/a> companies. She decided the outcome of a 2021 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/antitrust\/\" type=\"post_tag\" id=\"1187\">antitrust<\/a> case brought by Epic Games against Apple regarding its App Store policies, ruling against the latter company.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4544068\/elon-musk-lawsuit-against-sam-altman-could-change-ai-industry\/\">WHAT ELON MUSK\u2019S LAWSUIT AGAINST SAM ALTMAN COULD CHANGE ABOUT THE AI INDUSTRY<\/a><\/strong><\/p>\n<p>Musk is set to testify on Tuesday about his lawsuit against Altman and OpenAI, the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/artificial-intelligence\/\" type=\"post_tag\" id=\"1658\">artificial intelligence<\/a> firm they founded together as a nonprofit charity in 2015. The two split less than three years later, after Musk disagreed with the direction the company was going.<\/p>\n<p>In 2019, OpenAI launched a for-profit subsidiary that\u2019s controlled by the nonprofit foundation. By October 2025, OpenAI completed its conversion to a for-profit public benefit corporation.<\/p>\n<p>Musk, who wanted to keep OpenAI a nonprofit organization, accuses Altman of prioritizing monetary gain over the company\u2019s humanitarian mission.<\/p>\n<p>The plaintiff demands that the court remove Altman from OpenAI\u2019s board and roll back its for-profit status. If the judge rules in favor of Musk, OpenAI\u2019s business could be dealt a significant blow, opening the door to other AI industry rivals like Musk\u2019s xAI. Microsoft, which partners with OpenAI, is another defendant in the case.<\/p>\n<p>Musk and Altman will both participate in witness testimony, and Microsoft CEO Satya Nadella and former OpenAI chief technology officer Mira Murati are also slated to take the stand.<\/p>\n<p>The judge and jury may hear from former OpenAI board member Shivon Zilis, who is the mother of four of Musk\u2019s children, and three other OpenAI board members who fired Altman in November 2023. In one post at the top of his feed, the tech mogul claimed \u201cScam Altman and Greg Stockman stole\u201d OpenAI\u2019s charitable arm by focusing on profit.<\/p>\n<p>\u201cGreg got tens of billions of stock for himself and Scam got dozens of OpenAI side deals with a piece of the action for himself, Y Combinator style.
